I hope he goes on to clarify that threats can be considered assault, however. I don't like these snippets. They are so misleading at times, which we realise once we read full length articles later that day.

So would it be correct to assume that one possible scenario is that there are some on the jury who are satisfied Tostee physically assaulted Warriena, but there are others who don't believe he did. So if there is disagreeance on physical assault but agreeance on accepting the verbal statements of Tostee to be assault (if the judge so allows it), then they could agree with the prosecution and return a guilty verdict?

Justice Byrne tells jurors "no". They should only be concerned with "physical force" when considering defences

Oh, okay ... I guess I jumped to the wrong conclusion thinking if Justice Byrne says language can't be considered force, then the jury won't convict him. My bad.

Keep deliberating, jury. See if you can persuade the holder-out(s) that Warriena was gasping for air and terrified, not talking a casual stroll along a balcony ledge.
