Spedding has already tried official complaints, via his legal rep .... unsuccessful. As ruled by the Press Council and by a Magistrate, who both know the laws in this regard very well.
As long as the media do not point the finger only at him, seems they will be fine.


The Sydney Morning Herald has been found not to have breached the Press Council’s privacy standards over reporting of the police investigation into missing NSW toddler William Tyrrell.
A complaint was brought against the newspaper after print and online articles appeared on January 22, 2015, which covered the police search of William Harrie Spedding’s property.

Mr O'Brien argued in the age of social media publication of the details of the Victorian charges against Spedding would lead to "perverse, unusual and bizarre results".
Magistrate Mark Stratmann refused the suppression order application, ruling properly directed jurors could be trusted to judge evidence on its own merit, regardless of media reports.

When it is all said and done, and *if* BS is not involved, I'm quite sure he will get somewhere with a good lawsuit or two or three. jmo.

Yes, I have read a lot of articles that say that it very frequently/usually is not about the sex of the child, but more about the child's stage of development.

The reason why i had already heard about that several years ago was because i was so confused thinking that an adult male pedophile who sexually assaulted male children was homosexual... but I was corrected by being told that it doesn't make the pedo homosexual, since the sex of the child didn't matter, since they are relatively similar before a certain age. I still don't believe it though, that a pedo who chooses male children isn't also homosexual. i just can't seem to be convinced.

In the first place he apparently hasn't the money to jump into litigation. Secondly as his official complaints have failed, suing the media is unlikely to be successful. Who do you think he could sue--the police? Surely they're entitled to investigate anyone they reasonably suspect, not just actual perpetrators.

I have a feeling that he will get help with a lodging and pursuing a lawsuit, WHEN the case is all resolved and all said and done. One body (was it a media body?) may have ruled it was okay to treat him that way, however if he took it further, through the courts, I'm quite certain they would see it differently.... afterall, he did lose his ability to continue doing business, likely lost his home if he couldn't afford it without his business income, lost his grandchildren who he was fostering with his wife, lost his right to be viewed as innocent until proven guilty, etc. That is just my opinion, but time will tell, on all counts (at least I am hoping this case gets resolved very very soon, so that BS can either be charged or cleared, and whoever the perp may be, will proceed through the courts for justice to be served).

Further to that.... your average 'joe' citizen wouldn't have the funds to pursue litigation against a giant media outlet.. but if there was no recourse available to fight it, then that would mean the media giants could just go around abusing whoever they felt like, knowing that nobody could dare question it in a court of law. That is why i believe that he will receive assistance in that regard from somewhere. jmo.

Normally I'm a fan of yours Deugirtni but this sounds like we're living in different worlds. In my world the media regularly take advantage of the unemployed and vulnerable, if they can make a story of it. They're a lot more careful with anyone with the funds and willingness to sue--Nicole Kidman for example.

In relation to WT's case, I have seen BS named as a "suspect" in at least 3 different publications over the course of the investigation. He doesn't need to take his complaint to the press council over that. If someone else is charged in relation to WT, BS will have a good chance with a compensation lawyer, many I bet have handed him their card already.

The victim who complained of being lobbied, has had an ongoing and apparently current relationship with BS and his wife at the time he was being investigated for WT's disappearance. Until now, like Deugirtni said, I had never read an article that he asked her to state that he had not sexually assaulted her, but more asked for a reference for his good character. I can't help but think the article has been embellished as well, since it was 1st published, however, I will reserve judgement on that. MOO

One alleged victim told police “the accused has directly lobbied her for a declaration that states he did not sexually abuse her or similar when she was a child”.

After his arrest on Wednesday, this alleged victim received calls and a text message from a “third party” known to Mr Spedding, which read, “It really saddens me you’re involved in this”, the documents allege.

Looking at the quote, it is what the police said she reported to them. Not a direct quote from her. The article also contains many other disgusting allegations that the police thought charges would be layed for in the forseeable future. There have been no new adults charged so far and no new victims that I know of in the Victorian case. Moo

The damages BS has sustained are likely to be low in monetary value. Washing machine repair isn't lucrative I think and he doesn't seem to have worked at it full time; furthermore, in his sixties, he wouldn't have had many working years left. Weigh against that the court costs and the risk of them being awarded at least partly against him. I've heard of someone losing their house as a result of pursuing litigation on a no-win-no-fee basis, because apparently no-fee only applies to the solicitor's fees and not the total costs of the action.

Perhaps also loss of the society of his grandchildren. I'm open to correction but my impression is that in Australia, damages for such intangibles are small $$$$.

Another thing I meant to say is that involvement in court proceedings is typically draining, frustrating, traumatic, and just a waste of life. The Speddings have seen a lot of it lately and may well be reluctant to jump back in.

i wonder if theres a process where you can apply to have your name publicly cleared from being "a person of interest" in a crime, once police have finished investigating you?
could your lawyer do that for you?
i dont think police release a statement to specificly clear people, unless they are asked by journos at media releases, but even then i think it would be a no comment
i think hes still very much a poi, not necessarily because he took william but because he knows who did and there are far too many coincidences and he knows so many of the other pois and hes been linked to a paedo ring, and it seems there were/are a lot of them in that small area

This is possibly too cynical, but I think it suits police to have public suspicion lingering over BS in relation to William until after the other cases are decided.

I was going to address the long list of "happens" a number of you have put forward but for the most part they are things that seem suspicious after a person has been named as a POI in this case. One example is him travelling the Ghost road on the day of bush searches by police. It is the main link road through that area to get to the Pacific Highway and to my mind not suspicious at all. Most of what has been put forward as suspicious is just an assumption. MOO

Agree..I dont find that overly suspicious as it is the main road in and out of a small town. I have also always thought the spiderman toy in the car was a little too convenient. I am not saying BS was 'set up' but that it is possible that someone went to some trouble to make sure that he was in the spotlight on this issue (rightly or wrongly).

I certainly to understand and applaud your points D. All most relevant. However, I struggle with accepting a scenario where the 'legals' would continue to hang someone out ( or allow media ill-presentation of ) anyone, BS, etc. if there was not at least an inkling of a valid reason to do so.

Like you, I hope & pray for answers. I wake every day in the belief that today we will hear that William has been found. Other than that I pretty much don't care .. I just want him safe. I wish who ever has him would drop him at a servo, at a shop, on my doorstep even .. just put this little boy somewhere where he can be returned to a familiar and secure environment with his sister. Any other stuff can be worked out pretty easily, the main thing IMO is that William is known to be, and that he feels to be, safe.

You will notice though, that it seems, according to reports from our own members here, that the media seems to be taking slightly more care/caution in their reporting than may previously have been the case... ie wording changed after the fact, more often I have noticed it is added in that one case has nothing to do with the other case, whereas previously, i got the distinct impression that the media seemed almost trying to convey that one had everything to do with the other, type of thing... I believe the media is at least more cognizant of what their potential liability could be in this, and that they are taking a little greater care. jmo again. Where I live, I have noticed for about a year or two, it seems that media, when they report on an 'accused', they seem to always specify after that, something like, 'the charges have yet to be proven in court'.. it makes sense. Their liability can turn out to be HUGE. They have conflicting interests, they want to sell their news, and keep it dragging on and on if they know it is a high interest case, but if they can juice it up a bit.. even at the expense of someone's life.. so be it.
