She’s no longer a PYT who may have made a silly mistake. She’s in her 30s and has a long rap sheet. The only thing that may save her from jail are her children, if they’re still in her care. If she doesn’t get a custodial sentence, I still don’t know if she’ll be walking out of the courtroom — if she does — with a smile on her face. Comes a time everyone has to pay the piper.

She may have put herself in real danger of losing these two children. If she gets a custodial sentence, and they are put into foster care and not kincare ......

As a bit of a former wild child myself, in some ways, I’d hate to see that happen. But ‘the best interests of the child’. Hopefully, she can put their needs above her own. Honestly, I can’t see anyone falling much further but, sadly, it happens.

Is there a world drought on contraceptives?
Does the govt. still give $5,000 for having a baby. WTF.

Baby bonus ended in March 2014. Started in 2002.
In 2014, it changed to Newborn Supplement and Family Tax Benefit A .... $540 upfront payment, then ongoing additional Centrelink payments.

In Karlie’s case, I think it might’ve been a little more complicated than wanting cash for a big screen TV. God, I hope someone can give her some help to truly turn her life around. The right kind of help.

I guess that we can consider whatever we want as reasons for why Karlie is continually in this kind of situation. We will never really know.

Personally, I am sick and tired of parents who bring children into this world and do not put the children first, all the time. I don't care what their excuse is. If you are not capable of being a good parent, don't be a parent. If you are going to be self-focused, don't be a parent. Use birth control, all the time, until you are capable of doing everything you can to give any children a good, stable life. Even when life sometimes blindsides you. Stability for your children is a must.

Children are not cute teddy bears to provide the unconditional love that people desire. I fear that too often that is the motivation for young people having children.

In the meantime, I hope that while Karlie decides if she is going to finally put her nose to the grindstone and sort herself out, someone is watching over her children. Someone stable.

Section 10's will be abolished under new penalties set to come into effect in NSW in 2018 ( not sure when thou ) with a push to ICO ( Intensive Corrections Order ) .

Lots of info in this link, I'd be surprised if Karlie gets a custodial sentence.....

https://www.criminaldefencelawyers.com.au/blog/new-penalties-to-be-introduced-in-nsw/

In another case, we were looking at CCOs not long ago, the Victorian equivalent of this new ICO in NSW. They are really struggling to keep up with the high amount of CCOs being issued.

More than 3,000 criminals serving their sentences in the community are considered a "high risk" of reoffending, a damning report by the Victorian auditor-general has found.

Between 2013 and 2016, the number of criminals on CCOs doubled to 11,730.
According to auditor-general Andrew Greaves, 27 per cent had a "high risk of reoffending".

"CV (Corrections Victoria) admits significant workloads for case managers - more than 60 offenders per officer in some locations - hamper prompt management of offenders who do not comply with the conditions of their CCO," he said.

In the 2014-2015 financial year, nearly 25 per cent of those on CCOs ended up returning to the corrections system.

Karlie has obviously been around the block a few times, and knows her way around a courtroom.

Firstly, in the case of common assault:
"By pleading guilty at an early stage, you will be spared the time and expense of a defended hearing. You may also receive a more favourable outcome, as you will demonstrate to the court that you are accepting responsibility for your actions by pleading guilty.
You may even avoid a criminal conviction altogether by persuading the magistrate to make a Section 10 order - which means guiilty but no criminal conviction is recorded against you."

https://www.sydneycriminallawyers.com.au/criminal/offences/assault/common-assault/

An intervention or good behaviour bond is often the result of a Section 10 order.

Also, from what I can see among the many NSW sites I have looked at, "duress" is the only defence/reason available to her for her actions. She does not meet the requirements for any other defence/reason.
Hence, her handwritten note about panic attacks? Could that have helped her to attain the pre-sentencing review, that may result in a Section 10 order?

.

Maybe on legal/attorney advice too?

I wonder if KT has ever been incarcerated in her life? Seems like her legal probs. started when she got with BC? The had a couple of charges that were the same previously.

A bit more info - it is the DM though.

When the officers arrived Tyrrell launched into a sweary tirade, saying 'yous(e) are c***s', police alleged. The tirade continued even after they asked her to stop because children were present.

'The accused became very angry when (the) Constable ... asked the (boy) what the marks on his legs were.
'The accused has grabbed (the child's) leg and stated 'none of your f***ing business,' police alleged.
The facts said when the officer began to speak to Tyrrell she said 'f*** off ranga c***', police alleged.

At this time the accused has began to draw saliva into her mouth by making a throat clearing noise. 'She has then recoiled her head back and projected her lips forward, launching saliva from her mouth towards (the constable).'
The hocked up spit landed on the police officer's right eyebrow and cheek.
Tyrrell spat on the officer again before police restrained her on the ground and handcuffed her.

I only just worked out what IANAL means. I feel a bit silly now.

Makes me feel sick. Poor little boys . Maybe they are used to that behaviour . So the cycle begins.

"SCUM who spit at our cops would be put behind bars for up to 14 years under tough new laws to crack down on the “filthy attacks”.

Police Minister Troy Grant last night confirmed to The Saturday Telegraph he had “prepared” a cabinet proposal for a “new offence with tough penalties for spitting on officers and a mandatory testing regimen for offenders who spit”.

The former police officer (left) slammed spitting as a “particularly filthy form of assault”.

Mr Weber said NSW laws were behind other states.

“It’s a major issue. Most officers I know would much rather be punched, hit or shoved than spit on,” he said."

(I think someone posted this article before to show what happens to a police officer after he/she is spat on - details are in the article.)

Can you imagine the distress they would have felt at seeing their mother slammed to the ground and handcuffed?
Then what happened to the boys, as their mother was led away? Was someone else there to care for them and comfort them?
Were they brought to the police station and cared for by a 'c*nt' police officer or welfare advocate?

And then to take them to court (unless she was meeting their carer there). That risked running into the media, which they did. What was she thinking? Something is wrong here, that much is obvious.

Well we don't know why she took them to the court and perhaps she didn't have anyone else to leave them with that day. and didn't want to get in trouble for missing the court appearance? Difficult to say when we have no clue as to the why?
If her Panic attacks cause aggression as they can because of the fight/flight response in some people, she has a form of mental illness and needs to seek medical help/treatment for that so she can better cope with life in general. She might have had these untreated issues for a long time undiagnosed and then an episode like this last one really needs to wake her up to the fact she needs help. All IMO.
