I only had a few minutes to read it through ... will go back and read it again a bit later.

It wasn't so much what it was that I read, more what it wasn't.
just from a quick read through it seems he just did it because he could, these youths were vulnerable and didnt have the capacity to fight back, so he took advantage?

Detective Deas said, "Do you understand what you are being charged with?". The applicant said, "No, not really". Detective Deas said:
I'm charging you with aggravated sexual assault and sexual assault take advantage of impairment, of [Complainant B and Complainant C], and sexual assault take advantage of impairment on [Complainant A]. The aggravated charges are for where the boys did not give you permission to do sexual acts to them, and the take advantage of impairment charges are for when you had sexual acts with these boys regardless of whether … they gave you permission. Basically…, you are not allowed to take advantage of intellectually impaired people and have sex with them.

The applicant said:
Well how was I supposed to know that. I didn't know there was a law against that.

Although the fact of impairment was not in issue at the trial (the Crown called expert evidence to establish that all three complainants were cognitively impaired), it was the applicant’s case that he was not aware of the cognitive impairment of any of the complainants and, further, that he had not had sexual intercourse with any of them.

Not looking forward to hearing what Mr Robert Donohoe has to say in court tomorrow. Or maybe I am. It depends on whether he has been eliminated from the investigation or not. Mostly looking forward to hearing from SF Rosann detectives.

I think he plays up his own mental disability. However, I disbelieve the evidence of the psychologist who found his intelligence at the upper end of average.

He did complete Tertiary Education including Diploma of Community Studies.... including subjects such as working with people with a disability...,

Taken from the court transcript (see below)
  1. undertook studies for and obtained a Diploma of Community Studies from the Canberra Institute of Technology, including some subjects specifically directed to working with clients with disabilities, including clients with mental illness. The applicant agreed in cross-examination that in order to achieve the Diploma he was required to attain certain competencies, including "Preparing for the care and protection of clients in specific need" and "Assessing and delivering services to clients with complex needs". A copy of the applicant's record of results was tendered. The applicant also attained a "Certificate 3" in Community Services Mental Health Studies.

  2. After finishing his tertiary studies, the applicant worked in a number of casual jobs such as service station attendant, bar tendering and as a traffic controller.

I know. They are passing too many people. It is scary to think someone like him is qualified to care for people with mental illness.

His attempt to argue his case for the appeal shows cognitive impairment in my view. It was in his interest to put a coherent argument; that trumped the incentive to malinger. His behaviour while working at the service station taken as a whole also suggests a low level of intelligence.

I don’t know but the second search area was at Batar Creek Road on the corner of Cedar Loggers Lane IIRC.

(Sorry on my phone and posting Google Maps are difficult).
That’s ok, I’m terrible at reading maps, just wondered if they were nearby

also its a little alarming how easily donohue was cleared to join the ses searches, i guess if you have no record? but i also notice on that grid search map a lot of the people were neighbours, so what happens if /when a neighbour is the perp and could easily cover their tracks while searching?

Exactly. They mustn’t check.

Well I guess it makes it easier to conceal your crime.

Thanks for the court updates today everyone.

Can someone please clarify: the man mentioned today at the inquest- does his brother or had his brother lived on Benaroon Drive? Or was this at a different location?
