Yes, it very well could be deferred again.

The charges could even be dismissed by the judge. imo

Seriously, how big could the brief of evidence be?? It is charges about 4 recordings. It should have been ready right from the start.

Has there been any talk of what time the postie usually comes?
I am sure the police have spoken to them re potentially seeing something that morning etc. Had FFC said she's seen the postie that morning?
Just wondering if this topic had been discussed (sure it was and i just missed it) and what the outcome was.

I want to know more about the postie too. Just not sure if there is much information out there, unfortunately. Hopefully someone has some local info.

I have looked and looked for any similar case where a police officer has been charged for illegal recording. I cannot find anything at all, and I am sure that Jubes is not the first police officer to record without a warrant or permission when gathering info for their case.

Considering the offence, what could a jail term be? 34 days? That is what the frightening stalker of William's foster father got.

Or perhaps even no jail time and no recorded conviction at all. That is what the person got who was found with over 2 million child sex abuse images on his computer.

Our justice system can be very screwed up in its sentencing.

I do not think there is much info.... only the one line that said postie had submitted her times for the morning of the disappearance....

One can only speculate as to why ??? Very important or not deemed relevant and everything in between....

I wonder if might have been a couple of casual or part time postie employees that shared the run?? Different people different days and if a postal contractor then there is a real possibility there could also be different cars????

AFAIK ...the postie hasn’t given evidence to the inquest in person.... just that she had submitted her times in writing to the coroner.... in 1st tranche ...

Really need local info for this.....

Yes, I’m baffled by how our justice system works sometimes. Let’s just hope that there is a good outcome and the charges are dropped. I hope that Jubes then somehow returns to investigating William’s case, even if it is privately. But I think that may be wishful thinking.

With regard to the penalty for this, I've also looked and can't see a definite penalty. From what I can see, and I'm not a lawyer :confused: if your a Police Officer, The Surveillance Device Act links to Law Enforcement (Controlled Operations) Act which then links to Law Enforcement Conduct Commission Act. So I'm totally confused, so please don't ask me to quote sections etc. :confused::confused::confused:

The fact they his lawyer is yet to receive a brief is ridiculous, and IMO I don't think the Police have got a water tight case.

Would the Benaroon Drive resident have thought they heard postie because they were accustomed to the sound of postie around that time of day?

Or would the Benaroon Drive resident have noticed the postie sound because it was unusual to hear them at that time of day?

If the police got down off their high horse, he could work as a consultant to the police. Like the other specialists they consult for ideas and insight ..... profilers, psychologists, etc.

He could even be re-hired. I looked into that once. They can re-hire if all parties agree.

From the photos I can’t tell if it is a bike or a car due to the letterbox being so close to the road and I can’t see tyre marks in the grass.
I was a small parcel postie for 6 years with a Mitsubishi van. I did rural and residential.
The other ‘letter’ posties had 4x4s for rural and bikes for residential.
It might depend were the AusPost sorting station is.

I’ve spoken about how children pick up on the anticipation of a parent awaiting a delivery and when I’d arrive the kids would race out to the van and at times wanted to climb in and the parent didn’t know I’d arrived and I’d have to yip & yahoo for them to come out to sign for delivery, many times I thought how easy it was for someone to abduct a child.

Does it equate to too much trust or laziness, dunno.

Surveillance warrants

Police can apply for a surveillance warrant in order to lawfully record a person.

To apply for a warrant, a police officer has to have reasonable grounds to suspect that someone is about to commit an offence, or that an offence has been committed, or that an offence is likely to be committed.

There also has to be an investigation into the alleged offence, or be likely that an investigation will arise, and the police officer has to show that surveillance will be necessary in that investigation.

Whether or not a warrant will be granted depends on the judge or magistrate’s discretion.

Some of the factors which will be considered include the nature and severity of the alleged offence, the likely intrusion on the privacy of the person or persons being recorded, and whether there are alternative ways of obtaining the evidence that is needed.

They will also consider what value the evidence which is likely to be obtained will have to the case as a whole.

Once a surveillance warrant is granted, it will give very specific guidelines as to the type of device which is approved, and how it can be used.

Perhaps they will once his court case is done depending on the outcome, and if he wants to go that route?

Yes, the point I was making was the resident hearing the postie sound - whether it was actually postie or a sound just like postie - was it around the time that postie usually shows up, or not?

When we researched this before we found that rural posties can use many different types of vehicles. If AusPost contracts the services out, it could be a 4WD, a van, a car - whatever suits the purpose, because it will be a privately owned vehicle.
