Prosecutor Phil Hogan is now making his submissions to the Magistrate, telling the court “we’re entitled to not have our conversations recorded by people acting as agents of the state”.

I suspect the tall poppy syndrome is very much alive and well in this case on several fronts. IMO.
I agree.

Imo, there's one person responsible for going after Jubelin, and the others, who did their bidding, are probably feeling pretty foolish after all is said and done, nothing to be proud of. :(

Ms Cunneen has asked the magistrate to not record a conviction, arguing Jubelin is entitled to a degree of leniency because of the "extraordinary circumstances" and his life until this point.

He told the court “it’s not for an individual police officer to take it upon himself to make recordings on a device that’s not authorised by a warrant and that’s what Mr Jubelin did”.

The prosecutor, Phil Hogan, submits the removal of the right to privacy and not to have conversations recorded by "representatives of the state" can only be authorised in "very, very confined ways". Says Jubelin was a senior officer and the community was entitled to trust him.

Hogan told the court the Tyrrell case was “a terrible crime” and that means the officers investigating have “an even greater obligation to act in accordance with the strict requirements of the law”.

Hogan told the court Jubelin’s punishment should “make it clear to other police officers... this type of a beach of the act cannot and will not be tolerated”.

The Magistrate has told the court he is not considering imposing jail time. Hogan is arguing for a conviction to be recorded with a “monetary penalty” and a “community release order”.

Prosecutor Phil Hogan says a monetary penalty would adequately reflect the criminality of Jubelin's offending. "It is very serious offending, and it's offending that infringes fundamental civil rights."

Asked if she “has any concern about the future of the investigation”, she replied “yes I do”. She’s now been excused and the court has adjourned until midday.

Being excused just means that the person has finished giving evidence and the court lets them know they can leave.

Back at 2.05pm for #Jubelin’s sentence. Magistrate makes the obvious clear, he isn’t considering jail time.

He told the court, despite there being warrants in place to record Savage when some of these offences took place “those were warrants for those devices, not for the telephone that was used”.
