You're gonna make me break out iTunes and queue up some BM now lol...

How about "Stir it up"?

seems fitting around here today, ya know :floorlaugh:

I'm baaaack....I know y'all missed me! lol

Saw Dark Shadows with the dreamy Mr. Depp, was really good I highly recommend.

I saw upthread or last thread where the builders were prolly different, plus the accessor site is down, so I will quit yammering away about the silly floorplan (of which we already have a perfectly good one to use). I guess I just wanted to be useful and I feel so useless in this discussion most of the time without much to go on. I did however spend an hour on an Arizona real estate site getting some info. on different builders and what have you, but I will let it go.

I don't know what to do to help. Is there any ideas out there? Any other areas we feel need to be discussed? Hope you all are having a nice day :blowkiss:

Thanks AZlawyer, that was me stalking you :)
The confusion was "we don't know if it's an order" that's what some were questioning.

Well, it isn't an "order" in the sense that it is not issued by a judge and almost certainly does not include the usual "stay 100 feet away" type of language that an order against harassment would include.

But it is important for him to comply with the voluntary agreement unless he wants to fight in court whatever the issue is that CPS has with him.

Thanks for the re-explanation. I remember seeing your posts on this a bit ago.

Maybe one of the questions now is the legality of releasing CPS actions to the public. Are they protected/restricted from public announcement? (I imagine not, since LE has announced them... LOL). Are there any ethical considerations vis a vis the public? I believe those court records are NOT in the public domain... correct?

They are not court records at all, at the stage of a voluntary agreement. The court is not involved. I don't know of any law prohibiting LE from releasing the information.

Thanks... I wasn't clear. If there is a closed CPS case or action in court initiated by CPS, those types of documents or even dockets are NOT available to the public, correct?

Correct.

ETA to clarify: But if by a "closed CPS case," you mean a CPS investigation that never went anywhere (e.g., dropped as "unsubstantiated," etc., then there are no documents at the courthouse at all--public or not.

Yes the question I was getting was about the 90 days and that 'we did not know if it was 'an order' and therefore would not apply.
Thanks for explaining (again)

Someone hurry, do a look up for BBM cause what I picture when I see that is something NO ONE else wants to think about lol.

BBM= Bolded By Me

Ohh thank you lol.

 I see BBM frequently on Michigan License Plates followed by three digits on the standard plate. I chuckle about both meanings ;)

Hi AZlawyer ~ it's always so reassuring to have your input.

I was wondering about the limitations of offering a voluntary agreement. Is there a cap on it? IOW, if the investigation is in place due to suspected sexual abuse they could not offer it as an option while if it were for a lesser suspected offense, i.e., drug use in the family home it would qualify for the voluntary agreement? TIA!

I think we all owe AZlawyer some cake or something.

I've never seen them do one where they think the children are in actual physical danger from the parent. I don't think they would do it for sexual abuse. For drug use by one parent, they might do a voluntary like this one, although there would certainly be other provisions in the agreement like substance abuse treatment and testing.

Thanks! I was mostly curious if SC's presence at the vigil was in violation of the agreement, even though he wasn't right next to the boys. But you answered my question!

So there are perimeters then? Do you have any knowledge if they are decided on a case by case basis by CPS or if (and where) they might be documented?

I know that the CPS case manager handbook sets out the parameters, but I don't have a copy and I very much doubt it is accessible online.

ETA: They have guidelines for everything. :)

In case anyone missed it, here is Sergio's sister Elena Lukasiewicz speaking at last night's vigil.

http://www.tucsonnewsnow.com/story/...art=true&topVideoCatNo=default&clipId=7303044

Whoa! Hang on!

Is this the only source for the statement that SC had not had any contact with CPS prior to Thursday? His sister?

Has LE or CPS confirmed that claim?

I saw this posted on the thread last night and took it as fact from reliable sources, but I do sorta think SC's sister might be a little biased.

I thought LE stated CPS had made several calls to the home, the last being in Dec. i don't recall them saying they had no contact with SC.

TIA! And thanks for that link!

Well, has LE EVER stated kidnapping anywhere? The only thing that I've ever seen them use, and that was just recently when they finally came out and stated that it was an ABDUCTION. It's just an interesting take on two seemingly seperate things.

They pretty much are the same but I think because no ransom demand has been made they are calling it an abduction.

OT: I hope everyone is enjoying beautiful weather wherever you call home. It's sunny and quite summery north of the "D" - same conditions as in Baltimore for the Preakness. My pick - no particular reason - is Went the Day Well.
