The request of Fox 10 News for camera coverage having been considered,
IT IS ORDERED that:
Camera coverage is permitted only in the courtroom in which a proceeding is being held.
All authorized persons with cameras shall comply with all provisions of Rule 122, whether court
is in session or not. There shall be no use of flashbulbs, strobe lights or other artificial lights
anywhere in the courthouse. There shall be no use of cameras in any hallway, stairwell, elevator,
cafeteria, or other public or private area of the courthouse, without specific judicial approval.
Note: Jurors are not to be videotaped or photographed

This is the time set for oral argument re Defendant’s Motion to Have Deputy County Attorney Juan Martinez Removed as the Trial Prosecutor in this Case; and Various Connected Motions in Limine.
The Court addresses counsel as to its interpretations of the Defendant’s Motion, State’s Response and Defendant’s Reply.

LATER:
The Court has considered the Defense Motion to Remove Juan Martinez as the Prosecutor and for Related Discovery Material, the State’s Response, the Reply in Support, and arguments of counsel.

From the Defense perspective, a fair trial will be compromised with Juan Martinez as the assigned trial prosecutor. Defense counsel, Robert Stein, cites Martinez’ conduct in the Beemon matter (a case they had against each other) and the appellate decision in Beemon addressing the prosecutor’s conduct. The Defense also cites the Morris opinion and certain remarks made by Martinez the Appellate Court found improper. Counsel further argues that prior circumstances in this case illustrate this prosecutor’s embedded indifference to candor and justice.

The State contends that the Defense arguments from other cases bear no relevance to the handling of this case. If the past is deemed relevant, the State urges the Court to consider Stein’s lack of candor in Beemon and here, to get a complete picture of lawyer behavior. Martinez further directs the Court to the record in this case and the absence of any sanction- discovery
issues having been addressed by the Court.

The Court declines the invitation to remove Martinez based on conduct in prior cases. What occurred in those cases was addressed by the trial and appellate courts. Furthermore, while the Defense is concerned about honesty and compliance here, this Court has not found any intentional or bad faith attempt by the State to conceal evidence or violate the Rules.

While it is impossible to fashion an order to preclude every potentially inappropriate argument, this Court is ordering that there will be no mention of Hitler (or implication to that regime), no engagement of specific trial jurors, and no reference to the religious affiliation of any counsel.

In light of the discussion at the hearing, the Court must reiterate the obvious.

All counsel are reminded that misconduct must be avoided before it occurs. While objections highlight and preserve issues for appeal, at some point, misconduct jeopardizes the trial and calls for sanctions against the offending lawyer.

IT IS THEREFORE ORDERED denying the Motion to Remove Juan Martinez as the trial prosecutor.

IT IS FURTHER ORDERED denying the Defense Motion for Specific Discovery
(Martinez cases).

IT IS FURTHER ORDERED that there shall be no mention of Hitler (or implication to that regime), no engagement of specific trial jurors, and no reference or implication to the religious affiliation of any counsel.

Is the defense REACHING? :floorlaugh: And this is just one of many Public defenders that came and went as the pre-trial hearings and motions continued. The defendant himself, at one point decided to represent himself. :facepalm:

In my post above I typed (bbm) what was on the minute entry of the 17th (most recent) about cameras during trial, hope the media submitted the new request as the judge asked.

I'll look at the minute entries and see if I can find anything about Patsy Jones.

For some reason the defendant wanted his sister present during Patsy Jones' deposition, on the 6/28/07 m.e. the Court ruled against the sister being present, it was supposed to happen on 7/26 but that was delayed by defense motions, set to be heard on 8/2/07, here's the m.e. on that hearing:

HOLY COW!!!!

Patsy Jones has some prior "issues" that are mentioned in the beginning of the endless stream of "minutes". What connection she has in this particular case, I won't take a stab at. Prior "bad acts", criminal record, a vehicle with drug paraphernalia, a request for an order of protection..........geesh! The last 2 items MAY be related to the case.

There was a motion by Hulsey for "exhumation"........exhume whom, I again don't know, but it was DENIED.

*Covered the whole "Hitler" issue.*

Many, many Judges in and out of this case. (Don't have a count)

Husley's motion to have a LAPTOP (!!!!!!!)......DENIED.

Almost constant motions for change of attorneys or attorneys wanting out. (I lost count, if someone else wants to?)

Have several Dr.s also changing. (again, if someone wants to count them)

Hulsey refuses IQ test.

Hulsey way, way later decides to be evaluated for competency.

Another inmate is drug into the hearing process and concessions are made to make sure she is not transported or housed near Hulsey. (Name: Giota, or something like that, wish I had made note of the date)

Motion to recuss the Judge because of a phone conversation with an inmate...DENIED.

I think Sheriff Joe will make sure he gets there. From what I gleaned from the minutes, the court had granted all the hearings to take place in the afternoon to accommodate the defendant. THAT didn't fly when he stopped showing up. He's going to be on the bus at a bit past 4:00am (after his peanut butter sammich) for the trial.

Evidently, he was AWOL at the hearings after he had surgery on his knee (valid excuse), maybe that had something to do with a previous motion to get his medical records and a prescription for Vicodin, 2x a day.:scared:

"According to a police report, Hulsey was a back seat passenger in the car and was asked to get out so he could be patted for weapons. Hulsey is accused of then pulling a .357 Magnum revolver from his waistband and shooting at the officers."

Found the m.e/hearing on the exhumation, they did want to exhume Officer Holly but he had been cremated so denied.

Post if you come across "Giota", another inmate. Husley and Giota are to have "no contact". When I use the minute search, the link goes purple......thus, all the minute links are purple cause I read all of them!

"Police have not released the names of two other people with Hulsey in the vehicle, but Officer Matt Barnett, a Glendale police spokesman, said the pair has been questioned."
"Officer Holly had responded as backup to another officer who had stopped a vehicle with three occupants. They had taken one suspect out of the vehicle and were removing a second suspect when he produced a handgun from his waistband and fired at the officers, striking Officer Holly.

The other officer returned fire, wounding the shooter, who was later captured and taken into custody. The third occupant was also taken into custody. Officer Holly was taken to St. Joseph's Hospital in Phoenix where he was pronounced dead."

2 posts show 2 and 3 occupants, respectively, but because the incident is so old, I don't think we'll find links still working that far back (2007).

Just once I would like to watch a trial where a nutbar defendant actually DOES try to defend themselves.
Just for pure entertainment value, of course.

(And I know the courts strongly discourage it...wonder why :giggle:)
