Invited papers address Atkins evaluations, the prison behavior of former death-sentenced offenders, evaluations of competency for execution, and findings from capital jury research.

Accuracy of Violence Predictions by Capital Juries

Dr. Cunningham and co-investigators Dr. Jon Sorensen and Dr. Tom Reidy presented the findings of a major study on the accuracy of predictions of future violence made by federal capital jurors. This paper appeared in Psychology, Public Policy, and Law. Though judgments that a capital offender will be seriously violent in prison have a major influence on death verdicts, the risk predictions of the federal capital jurors were no better than random guesses. These findings have significant implications for the legitimacy of this factor in individualizing the application of the death penalty. These findings have been replicated in an examination of three decades of risk predictions by Texas capital juries, reported in a recently published article in Behavioral Sciences & Law."

More on Dr. Cunningham- in Steven Hayes trial:

"..With red pointer in hand bouncing across page after page of a PowerPoint presentation projected on a courtroom movie screen, Cunningham spent the entire day on the witness stand trying to convince jurors that Hayes would be likely to have "a positive adjustment," free of violence, if given a lifetime prison term.

Hayes' defense team hopes Cunningham's testimony will help persuade jurors to vote against executing Hayes for the July 23, 2007 killings of Jennifer Hawke-Petit and her daughters, Hayley, 17, and Michaela, 11, at their Cheshire home...

Hayes' defense team had asked Cunningham to conduct a violence risk assessment of Hayes. He testified that he received $300 an hour for 50 hours of work. Cunningham said he has testified in about 100 state death-penalty cases...

"Being convicted of a murder doesn't make you more likely to commit violence in prison," Cunningham said. "Murderers look just like the other guys they are side by side with."
