Mara Siegel, a Maricopa County deputy juvenile public defender who is working with the defense team in this case, said there is reason to believe that the boy didn't kill his father and another man. But she can't talk about it.

Judge's gag order. Interesting, isn't it, that we can see and hear the “confession” but not the other side of the story?

Even if the boy told the truth and if by some miracle it's admissible in court – hardly likely given that they didn't even bother to read the kid his Miranda rights -- both Siegel and Drizin say it's unlikely the boy will face trial. For hundreds of years, we've presumed that kids his age are incapable of forming the criminal intent necessary to commit murder.

Do you have a link???? Give some little tidbit for those of us who have been holding out hope that there was evidence somewhere that could actually show this child to be innocent and that he had been held incorrectly!!!!
I hope this is the first of many statements that swing the pendulum the other way in this case.

True. And just because he may have shot two people, doesn't mean he isn't. Life isn't so black and white. There are a plethora of reasons why he could have done what I believe he probably did. Many which do NOT make him a psychopathic 8 year old. He could be...but he could just as easily NOT be.....with the information that has been parsed out, and now the gag order, it's too soon to make that determination, IMO.

That is absolutely untrue. Given the fact that abuse can take the form of physical, emotional, or verbal (even the combination of anyone of them), this does not make this statement remotely true. Abuse is all about intimidation and control of another. Having power over another. If a person has been fortunate not to experience any form of abuse, it is difficult to understand the dynamics of it and what it does to the victim of it. It can be subtle or violent. Either way, the victim of it carries with them the "scars" as a result.

I noticed in reading that this blog entry was posted on 11/22, so the idea that there is evidence to suggest his innocence has been in place for a while now -- but discussion of it is part of the gag order.

Hmmmm -- are the keeping the child in detention to protect him, maybe, while they vett out the real culprit????

Imo, there is now enough or as much circumstantial evidence to prove his innocence, as there is circumstantial evidence to prove his guilt. Part of my opinion on that is from things posted at anonther site in conjunction with this site & I'll see if I can put all the items in a "theory post" later, because, I'm already late for work now!

OK, found this on another site. Lot's of discussion going on there about the stepmom & where is she? Lot's of speculation as to her involvement, too, as she has apparantly been somewhat MIA since this all happened. I will repeat -- speculation. No proof of anything, just commentary based on this link.

IDK, Grandma & Grandpa thought him capable of murder. They started to tell the police something else about the boy but stopped. If there is a trial it will come out, it sounds like there is some history there. But as I have said all along he will plea bargin. I hope he gets the help he needs because someone else's safty in the future depends on it.

Colette & Ocean - please don't think I discount your points of view or your arguments. Joe Duncan started his deviant behavior at a very young age also and IIRC there was no history of abuse in his young life.

I also believe that some people are born without some crucial element in their makeup that allows most of us to understand behavior. But.... I also want to be convinced of this boy's guilt and then want to understand how he was thinking. He is only 8 and I think he deserves a thorough investigation.

On another note - Ocean-I understand now what you were saying about the truck and TR getting out on the passenger side. Apparently the men rode together and were both in that truck.

I thought in the link up above that the poster was very rude and posted things when everything is not known yet and maybe they should not have posted untill all the information was out or comes out.I do not think this person knew the family or not at the time.I don't think any one really knew what this family was like.It was said what goes on here stays here.I believe all the other comments with that one poster where they say just how bad the police screwed up.I will say untill all this information is out we really do not know what happened and maybe shouldn't say things like this untill all this is known.I will try and just post about things where there is evidence and facts now.

Wow. This might really be throwing a curve into the boy's reasoning. Tiffany and Romero were married in Sep, whatever that means in today's world, since she could have been pregnant before the marriage.

You really can't tell in these few photos. She is very close to the altar bench in the one close up.

Sorry, but this is nothing other than gossip fodder with absolutely nothing to show as fact. Some random poster (like many of us) stating what? Their opinion.

The wedding pics mean nothing. Regardless how close she was to the alter. Sorry, but this is one piece I do not include into any "puzzle". concerning this crime.

He's also not a villian. Let's please not lose sight of the fact that this is an 8-year-old CHILD who, at least not that we know of, does not have a past that paints him as anything other than an 8-year-old child.

We also need to remember that there are two men dead. The dad didn't have a history of child abuse and hadn't ever been convicted of any crimes. We haven't heard that he was an alcoholic or drug addict. In fact, we have heard nothing negative about the father to this point. It seems that this father was a hard working man who loved his family. He came home from work never dreaming that it was his last day on earth possibly by the hand of his 8 yr old son.
