Why would he have to wait on any forensic reports if he believes 100% that his client is innocent?

Any good lawyer would base the defense of his client best when most or all facts are known. The forensics would be the base to build a good defense, how else can he defend his client, he has nothing to start with, and he also needs the evaluation, which is common sense to do. If they have no conclusive evidence, that would not point to any side particular, than it is obvious he needs more info. I would have write more, but I'm tired and have to get up for work in 3 hours.

Yes, it was and it was opened OUTWARD TOWARD the body of TRs who lay on the porch. He was not between the screen door and the main door when found.

I doubt that the DA is going to disclosed those results now. I know of no other DA that divulges all of his evidence before a trial.

You don't?? Why did he allow the "confession" released to the media? LE is not a loose canon and if they did release it without clearing with the DA LE should have been publicly reprimanded. As far as future jurors I'm afraid that is ALL the evidenbce they need to know about. Forensic evidence is important but that that confession was horrendous and a never ending miscarriage of justice. This is an eight year old child with a very harsh background. That completely overshadows striations positions of dam bullets and everything else.

They couldn't go one step further if Judge Roca had not found probable cause and he doesnt strike me as an idiot but a very learned and wise Judge.

I don't think they did as bad as you are trying to infer they did.

Because this was done before the gag order and the media had a right to public access. Read Judge Roca's motions. He fully recognizes the power of the media. Look at how many times Nancy Grace has actual documents and transcripts of ongoing high profile cases. That is the very reason information is being disseminated on the Apache Court website now.

They didn't leak anything. The media is given full access to public records until a Judge denies them that priviledge and then they will petition the court if they are cut off and 9 times out of 10 a Judge will decide to let them see certain things.

There will be no jurors. He is a juvenile. Juveniles are tried by a sole presiding Judge not a jury.

Well, the Apache County attorney, Mr. Criss E. Candelaria, who will soon be replaced by the newly elected attorney, bears the burden of the released tape. When he loses this case, as he did the election, he will be back representing DUI and personal injury cases.
Unless there is a conviction of 'the boy', there will be no jury trial. But there might be if there is a conviction. This case could very well go to the U.S. Supreme Court. I don't think the shoddy work of Apache County AZ. wants it to go that far, but they know it will if they don't do the right thing.

Yes, he has judged drug addicts and thieves, and perhaps others. He has never been confronted by a murder case involving an eight year old!
St. Johns has never confronted a homicide, at least not within the term of their current chief. He never investigated a homicide in New England either. He's only been chief for four months in St. Johns.

How convenient. The DA and LE enforcement knew they were doing something very unethical and if the judge knew about this confession before the gag order he was unethical too. That tape should NEVER have reached the media to poson the waters. The DA had to know about the tapes and LE knew those tapes were confidentail (involvement of a minor) if not officially gaggeed. This was a "child's " confession to people he didn't know and no one there to advise him. Even hardened criminals have more help than that. They poisoned the waters.

No he wasn't. I just saw a picture of his body laying there. He was NOT between the screen and the door.

His body is laying at an angle and the screen door is up beyond where his head is. They do not move the body until it is ready for transport.

He never made it to open that door. He most likely went down for the final count right in the position he died in.

Even the boy said when he walked in the home that day that he hit Tim in the head when he opened the door. If he were already in between the screen and the main door it wouldn't be necessary to open the already opened door.
