Okay, if it was known that there were some issues going on between these men, why did they not interview them? This makes absolutely no sense to me especially since the two men are dead! I mean, don't you want to cover *ALL* bases in a murder investigation???

You think??? Geez, LE admits in the media they had taken classes for this knid of stuff. What is their excuse? I truly wonder if one of the reasons the prosecution is pulling back on charges is due to the fact of LE incompetence. If the DA honestly believed he could run with this crime, he'd being doing so.

Soooo much more in the background that we are not privy to. Look what we do know and how whacked out it is! Can you even imagine what is held back because of the gag order????

Fran - you go girl!!!!!! I'm behind you 100%. Both Shock & Ocean Blue Eyes have some experience with guns and have posted some really great stuff. Keep in mind this child had only 8 minutes to commit BOTH crimes. So yes, he did have to be an expert marksman and a very, very quick reloader!

I didn't mean to mislead anyone here. I just cut off the quote from the pdf to show about the argument between the men.

From what I THINK from reading that PDF,.....the officer or detective the lawyer was questioning, she was not a regular member of that police force that covered the territory where the crime occurred. I think she was sheriff. Anyway, when the call went out, they called in 'All available units' or whatever. She was close by so she responded.

From what she said, everything was kind of chaotic when she first arrived. The first responders were still trying to figure out what had occurred. So they just assigned her to question various persons, etc. Then I believe she was to talk to the 'wife' and found her at the next door neighbors, 'Smith's.' Anyway, she did questioning that first night and the next morning, but it wasn't her job to 'follow-up' on anything. She was basically doing the questioning, taking notes, and turning them over to the proper agency.

So, the local LE may have talked to this Curley person. We just don't know what the result is. LOL, or I might find it IF I ever get a chance to finish reading the documents.....(I keep getting side-tracked ;))

But,.........the point still is, there's MUCH MORE to this story than trying to BLAME a little 8 yo for the crime. They might TRY doing a REAL INVESTIGATION first! ............Before they start pointing their fingers at a child!

Well,this is just a very sad story.I guess there is nothing too much that be done now untill the rest of the information is out.Maybe I shouldn't think about it way too much and just pray all this is in good hands.It's all just really bothering me.

Yep! If he was that great at loading, aiming, and shooting with such accuracy and speed (do not forget timing), he'd be up as a competitor in the Olympics at the young age of 8 years. IMO

Suspected is the key word yet everyone jumped right on that and if I recall it has even been spoken as if it was recently and he was doing it right in St. Johns and on the reservation.

Hi Bobbisangel - I see this was a rant, so I am not taking it personally. But, I did say IF they were getting divorced. And I said I thougt it was strange he called her Babe IF they were getting divorced. I never said I believed the stories, I just said I thought it was strange behavior if the stories were true. And I continue to think it is strange behavior IF the stories are true. You might be right - it might just be rumors and if that is the case, then the behavior would not be strange.

As for the drugs - my understanding was that he was convicted on the reservation and yes it was a few years back. However, quite honestly, once a person is a known drug user/seller, you must always look at this aspect in other circumstances. Yes, some users stop. In fact many, many users stop. Some sellers stop. But some don't and in my own opinion, it seems to be that most convicted drug users/sellers have PRIOR convictions. Not always, but I can not ignore the question until I am sure that it has been ruled out.

Yes, and Candy was mentioned in the court hearings and questioned by LE.

OhMyGoodness, can you just imagine. Tim's poor wife, talking about how wonderful he was and how loving. Finding out he was brutally murdered, and within hours, IF not minutes, ALSO finding out he'd asked someone else to marry him just the night before? :(

Truly, how heartbreaking for her! Not to mention humiliating now that everyone in the country knows about it.

Sorry Linda, I wasn't ignoring you. I just got busy......anyway, the red flag to me is that there was a recent major blow-up at the home between husband and wife. I'm NOT saying it's anything, but it's something that needs to be looked at.

Sorry, I'm still not running with the 8 yo being the perp yet. TOO MUCH going on to wrap it up so soon. I want to know more,...........MUCH more!

Oh......FWIW, about Tim and his wife MAYBE getting a divorce. It seems she was NOT aware of it and from the pdf this am, I THINK ;), there's no record of a divorce proceeding began. HOWEVER, I guess Candy didn't know that when Tim asked her to marry him the night before AND it must have been a REAL SURPRISE to Tim's wife.

Actually, I feel badly for his wife finding out this way. :(

THIS has always been a stickler with me! Children are treated as if they're 1/2 a person.

IF an adult murders a child, quite often they're given very light sentences compared to IF it had been and adult. Did you ever notice that?:mad:

NOW, the RULE is that LE has 45 days to file a complaint or free the perp. YET, this judge has STOPPED the 45 day period, and now, what? They can hold him until they get around to it?

What the heck?! He's not on lay-a-way!

Either charge him and start the clock to a speedy trial or let him out of jail!:furious:

I think he needs a new attorney that specializes in juvenile cases and understands the juvenile laws. Too much time is spent trying to discredit the confession when it isn't going to be used anyway because it was unlawfully obtained.

Boy, local LE really screwed up the evidence, IMO. Can the clothes even be used as evidence? There wasn't a warrant, it was the day after the murders, and they weren't even located in the house.

They screwed up by interviewing the child without his legal guardian's consent (the stepmom may act in loco parentis, but not after the father is dead. The mother had joint legal custody, IIRC, with visitation. Her rights would have superceded the stepmother's rights.

the prosecution wanting to drop one murder charge is in no way a gift for the defense. Far from it. It's so they can charge him with it when he's older.
