Not buying what Baez is peddling. ICA not only remembers names but she knows the middle and hyphenated names too IMO.

JB already gave us the real reason for why he wants KC there. He said so right in court. We've asked her about so and so and she doesn't remember names. She had a similar story with ZFG and couldn't id her from a pic. They simply can't get truthful answers from her. Imagine being her lawyers, looking at the discovery then going to Casey and the questions that followed. In those letters she invented yet another story about what happened to Caylee. Makes you wonder what she's told them if anything.

JB also stated that he believes that there is "something funky" going on down at the jail. Dunno how or if that statement relates to him wanting KC there for those depos.

He's obsessed with that jail.

I really interpreted the request to include current jail employees and the one(s) terminated due after their internal affairs investigations. JB named as his "reason" for wanting KC there that she didn't remember names or couldn't identify what was done or facilitated by whom (who? editors???? ).

If we look at the continually increasing witness list...is it plausible to assume that KC can identify each and every person on the list (or at a minimum...ALL non-LE an expert witnesses) ??? I think no.

Excluding JB's reasoning, what other benefit would KC's defense gain by having her attend the depo? I'll list a few that come to mind and offer them for consideration. They may or may not be plausible but I like to imagine the BIG picture.

Intimidation:
Having ICA present would likely intimidate someone from being as candid as they would otherwise. Additionally jail employees that saw KC every day would have an added ingredient in their depos. The ability for ICA to signal JB that he needs to dig further or the ability for ICA to dispute a fact in real time!

Defense use of misidentification of a witness:
The esteemed Ms. Lyon has spent countless hours educating students about witness mididentification. She teaches that refuting a witness ID can benefit the client. People forget a face, confuse parties, can't recall after a long period of time. Did JB not state the reason was based on witness identification??????

Imagine KC sitting in a depo and saying to JB...."no that's is not the one I... was talking to / about / remember".
Does the defense then open a door to reasonable doubt to specific testimony by saying.....she's not sure who passed letters? She doesn't recognize this person.

I can hear JB in court now.....

"There must still be a rogue jail employee on the staff doing something funky."

Enter premeditated "daisy chain" garbage here.

Not to mention the absurdity of Casey making a statement about anything. She's a bit lacking in the credibility department to say the least.

I can't believe what I just watched. Baez was so unprepared that the defense team had to jump in to remind him which officers hadn't been deposed.

Then he requested to have a motion heard that the HHJP had not even seen, and didn't even have a copy of it. The Defense had to give HHJP a copy!

Meanwhile, Cheney awoke from his coma once to say it was Amy's responsibility to come at their beck and call, her job be damned. She was never deposed for the 1 1/2 years that she was readily available, and never even deposed before the check fraud charges were filed.

HHJP said "WHAT?" in complete shock as Baez said he wanted Miss Murderess Casey herself to be able to attend the depositions.

Cheney Mason needs to do something. Maybe he feels like his job right now is just to coach Baez, then throw him in the water and let him learn to swim? Perhaps he plans to save his expertise for trial time?

I was absolutely shocked. This is no dream team, at least not pre-trial for sure.

I really don't think they are going to find anything. Not after being under water for so long.

As to Casey wanting to be there for the depositions, I'm assuming it is only the depo of the former prison guard, is that right? She wouldn't have any right to be at the ones for Maya or Robin as she knows what they look like after the hair braiding etc. Thus Casey and Baez would be forcing the former prison guard to return to a place she is no longer employed at - can't imagine she would be happy about that. I think and hope she gets or has legal representation. I don't know if JPerry would play along with this game anyway. I'm thinking he wouldn't but he does seem to give them some latitude.

If I didn't know better, I would say the defense is ill-prepared on purpose. Baez keeps everyone waiting while he shuffles through his papers trying to find the answer for the Judge. The only thing he spends time on is getting dressed in the morning and making sure his hankerchief is correctly folder in his suit pocket. There is a reason this man could not practice law for so long.

Okay - I got it now...The defense angle, what the team is going for...They are going to check for the "touch" DNA (with the dutch folks) - Looking for Kronk's and then say he kidnapped/molested/killed her.

Did he "touch" the laundry bag?????

Yup I say they are trying to find DNA of George, Lee or Roy Kronk on the bag so they can say one of them molested and killed Caylee. It wouldnt work for me if I were on the jury because George and Lee were both in the home and Roy Kronk found the bag which could have transferred his DNA so nope they would have to have DNA of a total stranger before I even listened for a second.

As far as ICA being in the depositions, it is for intimidation purposes. They feel if ICA is there that the guards wont talk as much and so that ICA can scribble notes on paper to whatever they are testifying to. Besides, showing her a picture and having her idenitfy them that way is sufficent for identification purposes. I have been a paralegal for 8 years and we have never had a Defendant attend the deposition, no way it will happen IMHO.

Well, if it was the DNA of a total stranger/unknown, I'd just roll my eyes and say, "The shorts and bag were tossed about in flood waters from a major hurricane and dragged through the mud and muck by critters and varmints. What did you expect?"

I don't think Judge Perry will allow much more delay...he has made it very clear he wants the lawyers to stick to deadlines(even though he has shown patience and given extentions) that this case will go to trial in May and the that the lawyers should expect to work long days on weekends..

It seems Perry has to micromanage this case to make sure all parties (IMO specifically the Defense-Baez) are doing the work they should be doing..preparing for trial and finish by the deadline dates he has given in order for this trial to start in May 2011.
