Baez Wants Casey Present at Depositions of Jail Inmates and Personnel

  • #61
Dear JB,
It is called a camera. Take a pic. Take it to ICA. Show her! Issue solved, she doesn't need to be there. Added bonus: leave ICA with the pics and names printed under each to study like flash cards. She must be bored stiff.
Best,
Junkie
PS: ICA does know how to operate camera's if you need help!

LOL - maybe this is going to be supporting evidence of ICA poor name recollection, thus proof that that is why she got ZFG name wrong.

And make certain you insert the pet names, such as Muffin, Cookie, Snickerdoodle. This may be where the confusion is coming into play. I for one would love to see that in a motion, if one does indeed need to be filed after that look from Judge Perry.
Motion to Allow Defendant's Presence at Depositions of Jail BFF's

"Here comes Casey Anthony, hopping down the bunny trail, hoping the court will allow her to place each witness to their real name, as she has only known them as Muffin, Cookie, and Big Bertha."

They are playing a Poor ICA defense who cannot get a fair trial because she is 'special', a celebrity.
Yeah, but celebrities often get much lighter punishment than if they were an ordinary person- just look at OJ, Michael Jackson, Robert Blake, and now Paris Hilton and Lindsey Lohan!!!:furious:

I agree. Photographs are the obvious solution.

I don't think this defense request stands a chance. I predict it is shot down in flames pretty darn quickly. Anyone notice how incredulous HHJP looked when Baez informally made this motion? Judge Perry schooled him on the Rules. When JB gave the lame excuse that Casey couldn't reconcile the names & faces, HHJP did not look impressed....at all. Quite the stretch he was trying to make.

I liked it when Judge P said that also, and this time it was to reinforce something the Defense must do, and not just something that the Judge was giving the Defense lenience on.
Judge P. told the Defense that death is different and they MUST take the extra step of having Inmate Anthony sign the STIPULATIONS which Ashton prepared (or will prepare), in order to send the State's evidence of entomology, hair, and the laundry bag and shorts to Defense experts out of the State of Florida.
JB seemed to be resisting having Inmate Anthony sign those STIPULATIONS (not sure why the resistance?).

I loved that moment. I'll have to go back and listen to see if Judge Perry's response was "You want what?" or "Say what?"

Swear to god, Lancelot, whatever he said in that moment, I think you just captioned his facial expressions for most of the hearing.

Me too. :)

HHJP quickly regains his composure and followed that up with, "What does the Rule say about that Mr. Baez?" Beleive me, Judge Perry could have quoted that Rule verbatim. He just wanted to make the point that it was a ridiculous request so don't argue or act surprised when I shoot it down.

This is basic, simple procedural law. Silly request.

I agree. I felt as if I were watching little Jose present his arguments in a classroom. And HHJP more than once sounded to me as if he were addressing "Mr. Baez" as if her were saying, "What was your name again?"
"Why are you here?"

I also got that impression when they were talking about the "late filed witnesses" (after May 24th) and LDBurdick said the Judge had given them a depo deadline of December 31st for those witnesses.

The Judge said he wanted a list of those witnesses, that both sides agree on .... and the "LEAD COUNSEL" signs off on. I got the impression Judge P was saying that he was not currently speaking to the "lead counsel" (Baez) on the case, and wanted to make sure JB understood that CMason must sign off on that list.

AZLawyer has told us that CM is the "lead attorney" because he is DP qualified, even though JB stands up and does most of the talking at Hearings and media events. I wish Judge P. would make CM step up and physically take the lead role.

Haitian woman wrongly convicted gets exonerated

Spaziano recanted his trial testimony in a sworn statement and during an interview with the Orlando Sentinel, acknowledging that he likely misidentified the woman in court because it had been three years since he had last seen her and no one ever made Joseph stand up at trial to show him her height.

Joseph, originally from Haiti and the mother of two young girls, spent three months in the Orange County Jail on the felony criminal mischief charge, insisting all along that she had nothing to do with the crime.

Some 'creative thinking' has been injected since CM joined the team, either from CM or via his 'old boy network' he taps into as an extended defense.

It is likely that JB/CM want real-time feedback from ICA on reaction and where to probe further, etc. They may want ICA to help them open a door to the 'funky' stuff so that they can malign the jail staff as well as SA, LE, FBI, Oak Ridge, etc.

The Defense are going to respond to every witness by attacking background, credibility, experience, methods and procedures, etc. IMO. They are playing a Poor ICA defense who cannot get a fair trial because she is 'special', a celebrity.

I think so until each time Mason opens his mouth and out comes absolutely nothing. If it was a cartoon - the talking space would be filled with nothing but the odd fly.
Did you read/see his comments about the duct tape after Dr. G.'s depo? Duh, the duct tape wasn't found attached to the face so it doesn't mean a homicide. Caylee found completely skeletonized and Mason expects duct tape that was placed across the mouth and nose to still be there after six months under water in a swamp and being defiled by animals for months.

Hope you repeat that idiocy at trial Mason, so everyone can really see it in context.

Thanks, agreed. That's why I qualified it with his 'old boys network'. The same way RH likes to share his expert opinion I am certain that CM has a wealth of defense attorney's sharing advice and ideas with him.

To me that's the true value of CM to JB; 1., that he allows JB to play as "lead"; 2., that he is DP-qualified and; 3., that he brings a pool of experts he can tap into or use.

I don't think JB would want CM around if it wasn't for the 3 points above, TL was a better match but TL was too assertive and knowledgeable ... JB needs someone who is quasi-retired and is just along for the ride so JB can play and take the credit (to JB's mind).

After all ... JB is a legend in his own mind and is continually self-humored, by his smirk with how clever he thinks he is and the strategy. This case is light years away compared to his track record of chasing perps in jail for business. He is conducting a DP case via OJT.

I have a strong feeling he doesnt want to do anything. He brought in CM.to do that.I honestly sometimes feel he knows this is beyond him,he is scared! He is stuck now.I liked it when he said to the effect that people on the team havent always got along (words to that effect). At that point I felt he knows he has overstepped. He is not Attorney material and never will be.

...My cousin is an attaorney in N.M.,this one couldnt hold a candle to him even in a normal conversation.IMO..

Agreed.

Since 2008 JB has gone from a 2-bit attorney chasing small-time business in the jails to running a high-profile murder case as attorney to needing to be a general running a dream team of attorney's and experts. He lacks the experience on murder cases never mind running a team with tons more experience.

JB wants to play the figurehead, he wants to lead but does not want to do the work ... can anyone say out of his depth? He wants the notoriety and to be present at the 'trial of the century' but dislikes the slog to get there......

My attorney cousins in Miami are laughing their collective butts off. They wouldn't touch ica's case with a million foot pole.

I think that JB originally thought the case a quick cake walk towards fame and fortune ... but then they discovered Caylee's remains and it became a DP case. Rut-roh!

JB obviously had a short-term game plan that was based on the ~$200K but this spun out of control and now ICA is theoretically indigent and JB is locked into a long drawn out and involved case.

Maybe ICA is going to do the Depos so JB can focus on other work that will make him money. ICA will earn her keep.
