I wonder if there are any legal ramifications regarding SWM's estate for her unborn grandchild. I think Gitana is just the person we need to answer the questions surrounding VF's inclusion in the case so I hope she has a chance to come in here and help us out with that.

MOO

I honestly think that is the only reason the US lawyers are staying involved but I could be totally wrong. Elkin could still be paid out of Sheila's estate and the rest might end up being left to Heather's baby? I think that side of things is going to be a bit complicated to be honest...

Someone mentioned this other case in Aruba. If anyone gets a chance and wants to watch the latest interview with this guy, turn on your tv now.

Robyn Gardner missing in Aruba case is on Dr. Phil now, 3:10 PDT.

Gary Giordano is being interviewed on the show to "set the records straight".

I missed it. Was he believable?

No. He's polished his lying though. Shameless liar and most likely a murderer. Oh, I thought he looked like a deer in the headlights when her sister said Robyn would never ever go diving with weaves in her hair.

Granted, I only half listened while multi-tasking. I hate to be lied to. :cow:

Isn't SM's brother executor of her estate? Isn't he the go-to-guy for dispersal of funds to lawyers representing HM?

Perhaps HM has her own money & can afford an American lawyer racking up the bills in Bali - probably all for naught.

Wonder if the lawyers can force SM's estate to pay for HM's futile defense.

I sincerely hope that Sheila's Trust/estate money is being used to bring Sheila's murderers to their deserved Justice and not paying for them to get off or get a reduced sentence or a deal of some kind.

I hope that regardless if HM is a beneficiary of her mothers money, that she doesn't see one cent of it - and hopefully that becomes public knowledge - so that she's not conning some person in Bali with tall stories of how rich she is so she can pay them off, when she isn't.

Without HM having access to money, she cant bribe her way out of this, so she's lacking leverage - hopefully that makes for a fairer trial.

I find it hard to believe that HM will have access to any of it - since she is the accused - and hopefully soon to be charged with Sheila's murder.

Thanks for the article Quester!

Few interesting bits in there ... sounds as if they are ready with the murder charges, and just waiting to get them into court now.

"Mack and Schaefer are not expected to appear in court for several weeks, when, police say, they will be formally charged with murder.
Under Indonesia’s legal system, they have already been 'designated' - meaning that murder charges have been drawn up against them and will become 'active' when they go to court."

And, it is interesting that they took Schaefer to the clinic as well .. accompanied by a group of prosecutorial lawyers and senior police officers, of course. Maybe getting DNA to test the baby's paternity?

Ditto thanks for the link Quester :)

Things seems to be moving along now - and that article answered my questions about what happens to baby.

New mothers being detained in Bali’s notorious Kerobokan Prison, where Heather Mack will spend many years if she is convicted of murder and spared execution, are allowed to keep their babies with them until they are two-years-old.
Then they are either handed over to relatives or placed in care with local families or charity groups.

Maybe things are now sinking in for HM & TS about what they both did.
There will be no going back to the US.

However, it is understood the two U.S lawyers will have no standing in any local court and their presence is to aid Nasution and his team.
Indonesian prosecutors and senior police have made it clear that despite reports that attempts will be made to move Mack and Schaefer to the U.S. to face unrelated charges there, they will face judges in Denpasar.

~rsbm~

Do we know if this is a current photo? If so, shouldn't Heather be quitting the smokes since she is pregnant??

That photo was published right after the arrest, a month ago, when she was a couple of months pregnant. Definitely saw it at that time.

I think this is the first photo from when they were arrested. Even so Heather knew she was pregnant and smoked anyway. I don't know if her plan was actually to keep the baby but who knows? Maybe she worked out that if she had a baby and her mother had decided not to leave her any money because of her horror behaviour, then this might have been a means to get access as the granddaughter might have become the automatic beneficiary.

Lawyers do honestly make me sick sometimes though - gleefully rubbing their hands together to secure the assets for the baby. Then they will most likely empty the fund via legal fees to manage it...MOO

  • #612
After reading through the article it looks like Vanessa is there to possibly manage the future adoption or care arrangement for the infant? I am assuming that means the baby will end up back in the US eventually. I hope they don't let Heather have her baby at all in prison to be honest...

Fig Tree, I agree with your hopes about Sheila's trust/estate...but I wonder if HM has money of her own through a trust or something, because IIRC she and her mother and the boyfriend were seen (and filmed) arguing over who would pay the hotel bill. Surely Sheila wouldn't have argued for that if HM didn't have money of her own. Does anyone know if she does? (I'm sort of behind on these kinds of finer points for this case.)

WhitegateGirl :0 - I had not thought of it that way - you maybe right!

funny how I read it ...
I thought that the argument between HM & Sheila related to TS - and that Sheila was not going to pay for TS, when TS should be the one paying for his own way.
Seeing that HM had already pulled this stunt before with a free for all in another Hotel, I was under the impression that Sheila had no idea that TS would turn up in Bali, and I think Sheila would have been livid that he was there and very P'd off that she was expected to pay for his accommodation - and probably other things as well.
And Sheila was right to do so - horribly, she paid with her life :(

Heather and Tommy are to be questioned today (Friday), according to the online edition of The Malaysian Insider. The article claims that this will be only the second time the police have attempted to question them. We know that the first time they said next to nothing, except for that wildly unbelievable business about the armed gang.

Bali police spokesman Hery Wiyanto is said to have reported that Heather underwent more psychological tests this week.

The article also notes that the new Indonesian lawyer represents a replacement for the police-appointed legal counsel Heather rejected, but there’s no mention of her or Tommy’s American attorneys.

The same story appears on another site (both got it from Reuters, so it will probably appear in many more places in the coming hours), and I post that URL for people who follow comments, as the two articles are bound to have different readers and comments (although neither has any comments posted yet):

Good grief, Michael Sneed is now covering this case! She (in spite of the name, this writer is a woman) is a gossip columnist for the Chicago Sun-Times.

The only new information in her column in today's Sun-Times is the following:

1. Vanessa Favia (the lawyer tasked with protecting the interests of Heather’s unborn child) has no definite arrival time back in Chicago, although she originally planned to return this weekend. This according to her husband.

2. Michael Elkin is described as “Mack’s family attorney.”

3. The newest Daily Mail photo (reproduced in Sneed’s column) shows Heather in a Chicago Cubs hat.

To this I say:

1. I wonder if those American attorneys are worried about today’s police questioning of Heather and have extended their trip because of this. In their shoes, I would be worried. Very worried.

2. I suspect this is not true. We've seen other claims as to how Heather knows Elkin.

3. All us Cubs fans knew that already.

Thanks Orange Tabby! You are right, exact same article popping up everywhere now.

Well, I think this may be their last questioning before charges are formally laid in court in a few weeks .. and I wonder if the new Indonesian lawyer will have HM approach this differently now. Show some contrition, be polite and respectful, pretend to show shame. Whereas TS may be floundering about what to do .. no US lawyer behind the scenes, same police-appointed Indonesian lawyer as always.

Yes, possibly TS's family do not have the funds right now to get him represented - which is a dangerous position (IMHO) to be in with the likes of HM having US council available to her
Look out TS :underbus:

It is 8:30pm on Friday in Bali now ... I wonder if anything significant happened ... and if we will find out prior to charges being laid? :waitasec:
