I don’t think Michael Elkin has helped Heather at all in Bali, I don’t think Heather or Tommy are now acting from a position of strength, and I don’t think the pubic at large believes any of their lovey-dovey nonsense.

I believe that in the many weeks since Michael Elkin first advanced his Racist Diet, Basic Instinct, and Needle People attacks, things have changed considerably. First, Elkin learned that in his own country, no one believed a word of his tripe. Worse, he found that people in the US despised Heather more because of these crude attacks. Imagine what Elkin must have concluded, after finally setting foot on Bali and talking to a local defense attorney. I believe he learned what those who cared about Schapelle Corby and other Australian defendants have learned: that you get absolutely nowhere with these kind of “Western Privilege” attacks. Moreover, that when it comes to trial, good character, a decent and modest approach to life, and a clear show of respect for authority is virtually the only way to go. Particularly when you have no other evidence on your behalf.

So what did we see in the past couple of days? Two Americans parading their religion in the most unsubtle and clumsy way possible: Tommy with his Bible and Heather with her crucifix. (They couldn’t very well advertise an Indonesian religion, that would be going too far.) These soon-to-be-defendants want people to know they are God fearing and therefore of moral character.

What else did we see? Two Americans who might otherwise be considered by Indonesian judges to be “fornicators” who actually consider themselves married. They announced their “moral marriage” through their rubber wedding rings. (I think of them as something like “rubber baby buggy bands.”) This is consistent with their concocted story that it was their fierce love for each other and Sheila’s hateful antagonism to that love which put them where they are now. They simply cannot fail to be love birds, and must seem oblivious to the world, because their whole defense relies upon it. (Although they were not actually oblivious to the world, but instead acting for it with the news photographers and reporters taking their show on the road.)

A lot has been made here in the past day or so in these pages of the fact that Heather looks good (while Tommy looks like warmed-over garbage), she has new clothes (while Tommy still huddles under the same ridiculous towel), she has a decent clutch (while Tommy has a crappy plastic bag), she has a new manicure (while Tommy still sports handcuffs), and so on. I am glad to see these things. If there is one thing which could have shifted public opinion around the globe in favor of these two murderers, it would have been if Heather looked physically frail or if her baby bump were too small for the baby’s gestation time or she was seen in clothes which any pregnant women would say would make everyday life difficult or uncomfortable and therefore potentially dangerous for the baby. I expect Bali authorities are coddling Heather to a certain extent. We should remember that this is in the interest of her innocent child. The fact that Heather benefits directly is a perverse side effect which cannot be avoided.

The smart manicure is an odd thing. There are various explanations which don’t include any fix in the works to aid the murdering duo. One possibility is this is the kind of thing her American lawyers are paying for. Another possibility is that it is a cheap way for Bali authorities to keep Heather’s spirits up, and that they consider this important for the unborn child. Related to this second possibility is that police authorities are in fact doing a lot for Heather specifically because it has served them well to this point. One thing we’ve learned in the past two days is that Heather’s own lawyer admits that Sheila wasn’t expecting to see Tommy in Bali, and therefore didn’t know that her credit card paid for his ticket. I believe this to be a very important admission, one which, were I Heather’s defense attorney, I would have fought against tooth and nail. It doesn’t seem to me a point easily proven without Heather’s admission, because even if the purchase could be linked directly to Heather and not to Sheila, Heather might have steadfastly maintained that her mother approved of the purchase. One possibility is that the authorities have “pampered” Heather in such a way as to squeeze such admissions out of her. If a regular manicure led to this kind of evidence, then I approve entirely.

I return to the idea that her lawyers might be paying for manicures, new clothes, and the like. It is possible (I believe likely) that Heather has no money of her own, but her lawyers are fronting the cost of various things, at prices we should remember that are a tiny fraction of American ones. If Heather beats the rap, the lawyers get paid. If Heather is convicted, there is yet another way they may still get paid.

What is this other way? Heather’s unborn child has an attorney (associated with Michael Elkin). Baby lawyer Vanessa Favia has an investment in this case. No matter what happens to Heather, the baby is innocent. Even if Heather is found guilty of the top crime on the indictment and given the top penalty, the child will inherit, and Vanessa Favia is in place to be paid as the baby’s lawyer. Favia could be the source of money going to Heather, expecting that her expenses will be recouped later, on the ground that a healthy baby requires a healthy mother. This is pure supposition, but it is hardly impossible.

In the end, Heather Mack is someone accustomed to getting her own way via deceit and cunning. She may appear comfortable and at ease because that is how she has always convinced people that she wasn’t actually responsible for her own misdeeds. Or she may be a person so convinced that she’s always in the right that she doesn’t feel any negative emotions connected to her nefarious actions. Remember how awfully damned calm she looked giving that cab driver instructions, even as her mother’s still-warm body lay contorted in the boot of the taxi? She’s one cold fish.

I believe the world at large sees this with the reports now coming out of Bali.
 
I worry more that authorities in Bali see HM as a cash cow if she is not charged and sentenced for her mother's murder. If they only charge him, she has made it clear that she plans to stay on in Bali, just as I suspected. And I'd imagine she would be willing to spread the wealth to all her new found friends in the local police department. But she will only see that wealth if they do not charge and convict her of her mother's murder.

But again, I can only hope that SWM's family will be tying up those funds for quite some time and that they are planning for a wrongful death civil suit against HM in the event that something like this happens.

Good question!

I'll try and find some info on that Kamille. I posted some things about the James Mack estate a while back, which I remember some people couldn't directly access. I'll repeat that process.

However, I don't think we'll find anything, because I'm sure Sheila's brother is doing everything he can to hold up Heather getting one red cent. Others can remind me, but in addition I seem to recall that Sheila had a trust [yes? no?], and those are generally shielded from public scrutiny.

To be fair, the documents I linked to concerning James Mack concerned the child support claim against him. I don't recall anyone ever posting estate documents.

Her child will not be considered Indonesian. I looked up the the requirements, and being born of foreign parents in Indonesia gives no claim to Indonesian citizenship. So, no way to stay using the baby as leverage.

I am doubtful that they would put her on parole in Bali and make her stay (as they did with Schapelle). She is a murderer … more likely that they would deport her. Schapelle got parole in Bali after many years in jail because they didn’t really want to release her (a drug smuggler) when they did, but were under immense pressure to do so due to Schapelle’s failing mental health, among other things.

All the felons that I have heard of there get kicked out and are not allowed to return.

I think Heather is full of it – and Tommy is going to suffer the consequences.

I wonder if they would be able to get the relevant consular letter(s) to allow that? Though I think HM would have been happy to announce her rubberband-marriage to the world when she announced that she is carrying a baby girl who she would call Stella, if they were already married.

I may be wrong, but if Heather has to go back to the States, isn't it possible she will face charges there?
Isn't there also some charges for her to answer for back in the States that were pending before she left.
I think she's delusional.
For the fact that she has already perceived that she will be let off with a light sentence and has also talked about her planned life when she gets off or is released is testament to her
belief that what coming up (a birth & the trial) seems to be thought of as already over - this is why I have my suspicions about what the hell is going on.
What if she get the Death Penalty - the illusion will be smashed, and maybe reality might sink in.

Sad that the entire emphasis of the story seems to be on the fate of two young lovers, stranded in a foreign jail, pregnant, no family or friends at home to help (ugh). Will they be re-united before the final commercial break? Seriously? SWM has almost disappeared from the story.

Re: living in Bali. I don't know where that's coming from. As SouthAussie points out, it's not as easy as she thinks. I suspect she's bonding with her jailers, probably partly because she got tired of hunger strikes and screaming fits. I imagine she and her lady jailer talked excitedly about HM being reunited with TS - painting her nails and deciding what she'd wear. Other than being confined, she's probably treated like a mini-celebrity by her jailers. She may be stupid enough to think that's what life in Bali would be like: being catered to by pleasant local people.

So is there some reason why a non charged or convicted murderer can not "immigrate" to Indonesia? Especially one who has a good chunk of change coming to her in an inheritance as long as she is not a convicted murderer?

ETA: I have read up a little and it appears, as SouthAussie has stated, that she would have to be on some kind of Visa to stay in the country. So does having your significant other/spouse (if they plan to marry) in the prison system there count as a reason for an extended Visa? She'd probably need a sponsor right? Maybe the same person who's offered to keep her baby for her if she does go to prison and bring it to visit her? I really think someone in that jail has been putting ideas into her head.

This is all I could get off that site. At least it gives us the case number. Do you know of anywhere else on there to look? It says 5 pages have been submitted. Don't know where to look to see if anything has been done with it yet.

Many assets do not need to go through probate, including:

Both Mack and Schaefer will be charged with several articles of the Criminal Code, including Article 340 on premeditated murder, which carries the death penalty; Article 338 on murder carrying a 15-year prison term; Article 170 subsection 2 on violence causing death, which has a maximum 12-year prison term; and Article 221 on hiding a criminal carrying a nine-month prison term.

Mack will also be charged with Article 44 subsection 3 of Law no. 23/2004 on domestic violence, which carries a 15-year prison term.

Prosecutor Eddy Arta Wijaya said, “the trial could start in January next year”.

Whoa ... if the Jakarta Post source is correct, these two are going down on a whole bunch of charges. And HM will have the additional charge of domestic violence, as well.

I take it they're covering all possible charges if the premeditated murder doesn't stick? So from there it starts going down until they are convicted of at least one or more? I don't like that "hiding a criminal" one. If that's all HM gets then she's been working deals IMO.
