Bill Cosby's lawyers urged a jury Tuesday to acquit the 80-year-old comedian of sexual assault charges they said were based on "flimsy, silly, ridiculous evidence," arguing he was falsely accused by a "pathological liar" scheming for a big payday.

The first big celebrity trial of the #MeToo era was nearly in the hands of a jury after the defense declared that Cosby himself was the victim of an elaborate frame-up.

See, I can't understand this BBM. If someone is subpoenaed aren't they forced to come to court ? Would 'not responding' be against the law and probably result in imprisonment? I thought a subpoena was enforceable?
Always difficult to compare different law in UK & USA, but be grateful if anyone could explain. How do the jury take into consideration this behaviour?

I think you have it right and its a really good question to ask that defense team.

I always thought a subpoena gets delivered in person by an official of the court and the receiving party has to sign the document. Its called getting "served". Similar to getting a divorce notice from someone who wants their lawyers to notify the other party. Always hand delivered and signed for by the person getting the subpoena. So it does not make sense what they are saying that she is not responding.

Either they found her and "served" her the subpoena or they didnt.

If she was served then she would be breaking the law by not showing up to court on requested days. If they could not find her to begin with then they should have used other wording besides what they said.

We need answers from defense team about this. Wonder if a news place could get answers for us. Its a great question.

Yes, the subpoena is served by a court appointed person. I signed for it as my son was a senior in high school. He was testifying for a national food chain and to prove to the school he was legally at the trial the lawyer said this was a lot better then him writing a note. We knew it was coming. If he did not show up, yes, he and I would have been in trouble. (The grocery chain won the case because my son was truthful and honest).

So either she was dead, did not answer the door and kept hiding with help, disappeared much like that guy who was to testify for felon arias....think he went to Austria or they decided not to serve her because she could do more harm then good. We may never know.

Here in Pennsylvania I once received a subpoena through the regular mails. As I recall, it was for jury duty. So I don't know that all subpoenas have to be hand delivered.

I do think that people who don't want to testify in court will attempt to avoid being served. One wonders how much effort the defense put into finding this person. Perhaps the defense team thought her deposition, had the judge allowed it in, was better for the defense than she would have been in court. perhaps she came into some money and took a long vacation. Who knows?

In any case, she did not appear as a witness and her deposition testimony was disallowed. End of story.

I hope this jury votes to convict.

So, I take it the jurors are still out deliberating.... well, from yesterday, and they went home (hotel) for the night!

I didn't realize they were sequestered!

I'm hoping for a Friday verdict, as well. If it goes longer, I'd fear a hung jury. Jurors are sequestered and will probably be anxious to get home for the weekend.

I'm hoping for a Friday verdict, as well. If it goes longer, I'd fear a hung jury. Jurors are sequestered and will probably be anxious to get home for the weekend.

I totally agree. If this starts to drag out more than a couple days then I think it will be heading for a hung jury again.

The jurors may have wanted a specific "legal" definition of consent that might differ from a dictionary definition of the term. Legal definition likely varies by state, as well.

Thanks. The legal process is fascinating to me and some days I wish I would have taken a law degree path. It really is interesting to follow the trials and learn a little bit each time how things are done.

This is a smart jury to want to read the actual legal definition for consent in Pennsylvania, which is available at the above link. It does not bode well for Cosby.

I am too nervous to even follow this this time - each time I think a jury will convict, the man walks again. Hoping, hoping, hoping AND praying he will finally be convicted and won't get away with what he has done. (Too many women, too many consistent stories.)
