by Adam Carter 10:22 AM

Villata says he didn't have a bank account for Villata homes.

Millard was the owner of Villata homes while Villata was the foreman and Villata says would not share the profits from the sales

molly hayes ‏@mollyhayes 24s25 seconds ago
No understanding that Villada would profit from sale of homes. Villada agrees but says $ was to go into purchasing more properties. #Bosma

Susan Clairmont ‏@susanclairmont 24s25 seconds ago
Verbal agreement that money made from flipping houses would go back into business.

Susan Clairmont ‏@susanclairmont 23s24 seconds ago
He did not sign documents or open bank account for Villada Homes.

molly hayes ‏@mollyhayes 28s29 seconds ago
Villada did not have a 'Villada homes' bank account. You didn't sign any banking docs for biz, as owner, Sachak says. He agrees. #Bosma

molly hayes ‏@mollyhayes 42s42 seconds ago
Villada didn't have 'Villada Homes' cheques. He couldn't issue cheques to employees. Only Millard could sign the cheques. #Bosma

  • #24
Villata also says he didn't have a chequebook for Villata Homes.
by Adam Carter 10:24 AM

He couldn't pay employees. "Only Mr. Dellen Millard could do that -- sign those cheques." Villata says yes.
by Adam Carter 10:25 AM

"Your job was to do the physical work -- the labour," Sachak says. "Yes, that was the agreement," Villata responds.
by Adam Carter 10:26 AM

Sachak says the arrangement was that Millard would reimburse him for supplies. "Yes sir -- and I still have a lot of receipts," Villata says.
by Adam Carter 10:27 AM

Sachak is doing everything he can to illustrate that Millard had total financial control over the company.

I'm curious to see where this is going, how is this relevant to the case?

Susan Clairmont ‏@susanclairmont 1m1 minute ago
His job was to do the labour for Villada Homes at an hourly rate.

molly hayes ‏@mollyhayes 49s49 seconds ago
Villada was to get paid hourly. And reimbursed for any supplies he bought for the company--says he still has a lot of receipts #Bosma

Lisa Hepfner ‏@HefCHCHNews 40s41 seconds ago
Villada would do physical labour in renos, paid hourly and #Millard would buy properties for fixing. Villada says he's still owed expenses

molly hayes ‏@mollyhayes 8s9 seconds ago
Sachak says that's bc you think biz owner should pay you for that. Yes. S: You didn't have a line of credit to pay for supplies. No. #Bosma

That is what I would love to know and I'll bet TB's family is sitting there thinking the same.

Strange that MB would send a bonus cheque to LW_2, but not settle the outstanding invoices for Villata homes. After all, she was managing DM's business affairs after his arrest.

Susan Clairmont ‏@susanclairmont 23s23 seconds ago
Sachak questioning truth of Villada's claim he was on hook for unpaid Villada Homes taxes. #Bosma

Colin Butler ‏@ColinButlerCBC 31s31 seconds ago
Villata owes back taxes, but says Millard wrote a cheque for $3,000 but never sent it

molly hayes ‏@mollyhayes 26s26 seconds ago
Re: taxes, Sachak says whatever taxes were owed were for JV personally not the biz Villada Homes. #Bosma

Susan Clairmont ‏@susanclairmont 24s24 seconds ago
Sachak says it was Javier Villada owing personal income tax money.

molly hayes ‏@mollyhayes 12s12 seconds ago
In 2010, he went to HR Block. Dellen took him, Sachak says. But Villada doesn't remember that. #Bosma

As Millard was the owner -- "The Canadian government would not send you a document to say you, Javier Villata owes taxes for the company called Villata homes," Sachak says.
by Adam Carter 10:29 AM

"The government sent you a document saying you, Javier Villata, owe taxes for the person Javier Villata," Sachak says.
by Adam Carter 10:30 AM

"You owed the Canadian government money, not Mr. Dellen Millard," Sachak says. Villata agrees.
by Adam Carter 10:31 AM

Sachak asking Villata if he remembers Millard paying $2,009 to HR Block in 2010 with Villata for him. Villata says he doesn't remember that.
by Adam Carter 10:33 AM

Villata was put on the MillardAir payroll in 2012.

Maybe JV owed personal income tax to the government? But thought it was DM's responsibility to clear that up?

very good point!

Susan Clairmont ‏@susanclairmont 46s46 seconds ago
In 2010 Villada taken by Millard to accountant, says Sachak. Says Millard paid $2900 for Villada. Villada says he doesn't remember.

molly hayes ‏@mollyhayes 42s42 seconds ago
S: do you remember DM paying $2,900 for your taxes/fees? Villada doesn't remember. #Bosma

Lisa Hepfner ‏@HefCHCHNews 33s33 seconds ago
Sachak asks if Villada remembers #Millard taking him to H&R Block & paying to have Villada's taxes done. He doesn't remember that. #Bosma

Susan Clairmont ‏@susanclairmont 32s32 seconds ago

I am surprised DM 's lawyer is so intent on showing us all what a prck Millard was in business with someone whom he could take advantage of. Saw a lot of these "deals" done in Mexico----it is always worked for the guy with the money and the little schmuck got screwed and half the time did not even know it.

I'm assuming he's trying to rack up some brownie points for DM.

But failing in my eyes.

This outstanding citizen , helped a man go home to see family, sent him on trips to retrieve stuff for him. Allowed him to pay him for a piece of garbage apartment, pay for the use of vehicles where he could have just gone the route most people do and buy/lease a better vehicle for much much less from a reputable source. Gave him the assurance of a thriving business, didn't pay him on time (and what would that matter when it seems like 95% of that pay would be going right back to DM)... etc, etc.

  • #37
Regular tax deductions came out of those cheques, Sachak says.
by Adam Carter 10:34 AM

He got a MillardAir T4 in 2013 for the previous year.
by Adam Carter 10:36 AM

Before then, he wasn't on the payroll. Sachak says there was a discussion where Millard said he'd put him on the payroll so his taxes and CPP would be addressed.

In 2013 he got a T4 from Millardair. #bosma

Lisa Hepfner ‏@HefCHCHNews 26s26 seconds ago
Sachak, known for verbosity, says he's searching for words. "I have a brain cramp." #Bosma

molly hayes ‏@mollyhayes 29s30 seconds ago
Villada can't remember. S suggests he and DM had a convo re: being put on payroll so that his taxes/CPP etc would be addressed. #Bosma

molly hayes ‏@mollyhayes 28s29 seconds ago
Villada agrees DM was helping him solve that problem. #Bosma

So sometimes DM paid JV with cheques through MillardAir that were being put on the books under JV's SIN and other times he was paid cash. There was confusion about submitting receipts and he never received a T4. So because of this odd business arrangement, DM had to bail him out regarding taxes on the claims that DM was putting through MillardAir, as a contractor likely.

In 2012 he was finally put on the payroll after 4 years of this other "arrangement". Did he receive a T4 for 2012? I know he said he received one for 2013. Just a mess.
