Do we know if the Defense is calling any experts or witnesses? Not necessarily DM or MS. The Crown witnesses are almost done but that doesn't necessarily mean that they will go directly to closing arguments.

I'm sure they will. I'd be shocked if MB doesn't take the stand. Probably some bank or financial people to say that Millard was wealth. Character witnesses for both. I don't anticipate either defence being lengthly though.

In the past I've seen people referring to the "defense getting their turn", but when I've asked exactly what that means, haven't gotten an answer. Closing arguments? Anyone know?

Hard for me to believe it would be over that soon. May is next week.

The defense can call witnesses of their own. Witness of Character, their own ferensic experts etc.
I was also told that the defense can tell their clients story without the client being in the witness box. It gets out their clients version/story out, without getting grilled by the prosecution. My friend wasn't speaking of the closing arguments. Maybe someone with proper knowledge can confirm this?

My question isn't needed but I want to know:

Why was MS wearing a RED hoodie on the test drive when otherwise he was always wearing the same (or several different) GREY hoodie?

A couple of things with wearing red or orange, almost ALL night time video cameras are black and white or green in colour. So if someone calls police and reports a suspect they can only report grey/black/green. If the suspects are seen walking with real eyesight the red/orange is so different that it often leads the viewer to ignore it. ie cant be that guy in the red we are looking for grey/black/green. As well there was talk of a show or movie that these guys may have liked or followed where the suspects always wore red/orange to do their crimes. JMO

Pretty sure the crown has shut down the financial excuse completely with hard evidence. DM texted that he was in the hole, and that they were just taking things from now on. I can't think of a single witness that could get DM out of a first degree.

That doesn't mean there won't be any, but I think DM's D will build on their only strategy left, that DM was not hiding anything about the theft beforehand, and that he was always trying to help out his minions. Maybe a witness that shows MS to have been violent in the past. But there is not much left with that strategy.

MS on the other hand does have a sliver of hope getting off first degree. It will depend on which answers from the "Hole in the Hanger" gang the jury chooese to believe. He will definetly not walk away without a serious conviction.

Don't think these guys were that bright. I think he kew he was going to burn it at the end of the night so he grabbed something he wouldn't normally wear.

I think it will be interesting to see MB take the stand in DMs defence. She has to right? Why else would she not show up in court? Unless she finally figured out she was played and wants nothing to do with him?

Or maybe she just did not want to deal with the media scrutiny.

I feel bad for the moms. Of course my deepest sympathy is for Tim's mom, that just goes without saying.

I feel for MS mom, sounds like she is a wonderful lady, as MM said, and that she was trying to steer her son and MM in the right direction. Even sounds like MS really loves his family, monsterous as he may be. But for his mom to beat Breast Cancer twice, such a joyous battle.....then have to deal with all this, have to deal with looking at her daughter's wedding pictures and see MS smiling, knowing what he did only days prior.

The defence would have known long ago what the prosecution was going to present. They are not going to change their strategy mid trial. Millard's defence is he's rich, that MS was the one that needed a vehicle, that MS was the violent hothead, and that MS acted without his knowledge. Maybe Smich wanted the red Caddy and was going to trade a RAM for it?

It will be interesting to hear CN's excuses for her involvement.

Let's see:
a) MS did it all and they were just helping him with clean up because he was DM's bff;
b) she was abused by, and deathly afraid of DM;
c) she thought they were performing general farm duties; or
d) she couldn't accept that DM was not the Prince Charming she wanted him to be, and didn't want to know.
Any other suggestions?

Well, this day should be interesting, I cannot possibly even begin to guess whether CN will be a hostile or a helpful witness. I feel just bang on in the middle on this and it could go either way. Part of me wants to believe that because she is the Crown's last witness, she is going to have "bombshells" and be very helpful to the prosecution. Then another part of me says nothing is surprising here, and she may just well have been pining and missing and loving DM all along. And she is going to be hostile and say she didn't really know what was going on. How she can look at pictures of Tim and his baby girl and wife and still be loyal to DM.....I cannot fathom it but the human mind and the way it works sometimes never ceases to amaze and baffle me.

Hoping for the best and that CN's testimony just puts the final nails in for GUILTY of all charges X 2.

Does anyone else start to panic when the day's thread hasn't been created yet and the clock is ticking? :scared: I like to prepare WAY ahead of time, so maybe it's just me.... (PS Thanks to the mods for all their hard work!)

Who knows but it is safe to say that she will be more polished and prepared by her legal counsel than MM was. I wonder if TD could ask if her legal defence is being funded by MB or if she has received any compensation from MB?

Change it? They have dropped pushing the financial angle some time ago. They are still pushing that he was not hiding anything, and that he was always trying to help out his minions. They are also still trying to show that MS was the angry unpredictable one.

Their faint hope is that
1) DM was not hiding the theft, therefore he was planning only a theft
2) He had compassion, and helped his friends with advice
3) MS was an unpredictable angry punk.

During MM's testimony, DM's defense acknowledged DM was planning on stealing a vehicle. So what would their reason be at this point to show he had financial resources, other than to prove he didn't need to steal the truck?

Can you point me to a recent exchange by his defense that shows financial resources are still be part of their strategy?
