I had the same exact thought. DM really picked a winner with this defense counsel.
Shhhhh. We're not allowed to point out what counsel is like. As other posters asked me when I said the same thing... What questions do you propose he ask? Lol I'm not serious. Just stating everyone has an opinion and I agree. So far I'm behind and these questions are ridiculous

Smich says the bike was a bmx stunt bike.
by Adam Carter 11:25 AM

DM's defence will have several things to catch MS on. For example doing this while drunk in the dark on a BMX bike with a bum shoulder.

"Under the circumstances and everything I was feeling at the time, I made the decision," Smich says. A conscious decision under stress

Shannon Martin ‏@ShannonMartinTV 18m18 minutes ago Toronto, Ontario
Millard lawyer: You made a conscious decision to find a tool to bury the gun. Smich: Under the circumstance, yes... #Bosma #HamOnt #Smich

molly hayes ‏@mollyhayes 18m18 minutes ago
"I knew I was going to go out and bury the gun. But I was under an unbelievable about of shock, stress and paranoia at that time," he says.

Susan Clairmont ‏@susanclairmont 18m18 minutes ago
"I was under an unbelievable amount of shock, stress and paranoia at that time," Smich repeats yet again.

Shannon Martin ‏@ShannonMartinTV 18m18 minutes ago Toronto, Ontario
But he was stressed. Shocked. Paranoid. #Bosma #HamOnt #Smich

Lisa Hepfner ‏@HefCHCHNews 18m18 minutes ago
How far was the spade from the washing machine? Smich doesn't know. #Bosma

Why would you think that? No doubt DM had already wiped it before wrapping it in cloth and putting it in the toolbox so no one would expect his fingerprints to be on it. He also washed the satchel that MS claims he put it in. Why would he have done that? MS may have played around with and touched the gun, including he trigger, when he got it, but apparently Arthur was there to vouch for him about his surprise when he first saw it. I suppose if it was necessary, putting Arthur on the stand was an option?

I think he's lying about the gun because he was under surveillance that week. How did the LE officers in charge of his surveillance miss him leaving Speers and heading over to his mother's place? And how did his mother or sister miss the fact that he was out in the garage wrapping up a gun in a shopping bag?

His sister told him to get "everything" out of the house. Did she also assist him in getting everything out of the house? Is he covering for someone he loves very much here?

There is no other reason why he shouldn't have helped LE locate that gun if he could have. No one would expect the shooter's prints or victim's DNA to still be on it after all it went through IMO.

MOO

Surveillance didn't start until the 14th. MS had a window 3-4 days to get rid of that gun before LE was ever watching him.

I thought he was saying the gun was putting in a shopping bag then tape wrapped around it. Some statements sound like he wrapped the gun in tape, then put it in a shopping bag.

Tape around the gun would make it near impossible to collect any evidence from it, especially fingerprints. He knew exactly what he was doing... MOO

Smich says all the stuff would've been located in and around the house. #Bosma

"Sir that gun, according to you, was used by Mr. Millard to kill a human being." Sachak says

molly hayes ‏@mollyhayes 18m18 minutes ago
Sachak says "that gun according to you was used by Millard to shoot an innocent man." Smich agrees. #Bosma

molly hayes ‏@mollyhayes 18m18 minutes ago
"And you just happen to be burying that gun," Sachak says. Smich again agrees. #Bosma

Susan Clairmont ‏@susanclairmont 18m18 minutes ago
Smich cannot/will not say how long the spade was or where he got it from.

Alex Pierson ‏@AlexpiersonAMP 18m18 minutes ago
Sachak hammering MS on basic details about the gun. Where it is. What he used to do it. How he did it. "I was under huge shock" @AM900CHML

Many of the early questions will be used to show inconsistencies later. Too early to judge questions.

Seems like Sachak is trying to do his best Dungey imitation and he is failing miserably.

  • #129
"So the jury gets the full picture, and the whole truth you have not the slightest recollection which forest you went to?" Sachak says. Smich says he doesn't recall.
by Adam Carter 11:33 AM

Smich also says he doesn't know how long he biked or in what direction.
by Adam Carter 11:33 AM

Sachak asks him to name one landmark he cycled past. Smich says he doesn't recall.
by Adam Carter 11:34 AM

Now taking the morning recess. Back in 20 mins.

He has a reason to hide that gun. Sorry, but if he rode into the woods, he knows what path he took and can give a general idea. Like oh I turned off this road and road my bike for about 5 mins before I buried it. Or I entered the woods through the park. Heck, I could tell you where I entered a wooded escarpment for a hike 3 years ago. Plus he's from Oakville, and he obviously entered the woods close to home. This is all imo.

Agreed. He's not a good liar, but I think he's just keeping answers short and to the point. The more he says, the more ehe will have to answer. He's obviously been taking notes from CN.

"You just happened to be burying that gun?" Yes. But doesn't know where spade was, or the tape. #Bosma

molly hayes ‏@mollyhayes 18m18 minutes ago
Sachak suggests he can't tell him where the spade was. He said it was somewhere outside. Tape would've been around same area. #Bosma

Susan Clairmont ‏@susanclairmont 18m18 minutes ago
Sachak says Smich told court in exam in chief that the gun was used to kill #Bosma.

Susan Clairmont ‏@susanclairmont 20m20 minutes ago
Smich said it might have been in garage or back yard. #Bosma

molly hayes ‏@mollyhayes 20m20 minutes ago
"It could've been in the garage, the backyard," Smich says. #Bosma

Lisa Hepfner ‏@HefCHCHNews 20m20 minutes ago
"Coulda been the garage, could have been the back yard," Smich says. Can't say why he took the gun. #Bosma

"Like I said I can't tell you where," Smich tells Sachak as he repeatedly asks about details of where and how he buried the gun. #Bosma

Millard seemingly enjoying the cross examination of Smich. Small smile on his face. Watching his co-accused. #Bosma @CTVNews

molly hayes ‏@mollyhayes 21m21 minutes ago
Sachak asks where he put the gun when he took it out of the washing machine. He says into a plastic bag, a shopping bag. Then taped. #Bosma

Susan Clairmont ‏@susanclairmont 21m21 minutes ago
Once he took gun out of washing machine, Smich says he taped it and put it in a plastic shopping bag. "That day is not very clear to me."

Lisa Hepfner ‏@HefCHCHNews 21m21 minutes ago
Smich says he put the gun in a plastic shopping bag. He would have had to carry the spade. He's not sure how. "That day is not clear to me"

Sachak asks where he put the spade. Smich says that day "isn't clear" to him. #Bosma

molly hayes ‏@mollyhayes 21m21 minutes ago
Sachak asks how the spade got to the forest. Smich says he had it with him. Sachak asks how. #Bosma

Lisa Hepfner ‏@HefCHCHNews 21m21 minutes ago
How did the spade get to the forest? It didn't have it's own bicycle, Sachak establishes. Did you tape it to your head? I don't know sir

molly hayes ‏@mollyhayes 21m21 minutes ago
He says he doesn't know if he carried it, had it in a bag. #Bosma

Susan Clairmont ‏@susanclairmont 21m21 minutes ago
Took spade to forest. Did you carry it in your hand?

Peter Akman ‏@PeterAkmanCTV 21m21 minutes ago
"The spade didn't have its own bicycle to ride to forest?" Smich answers "That's impossible." #Bosma trial @CTVNews

Surveillance didn't start until the 14th. MS had a window 3-4 days to get rid of that gun before LE was ever watching him.

What day did the media show up? What day did BD try to sell the gun to "Bleach"? :waitasec:

Okay we know it wasn't the night of the 11th or the 14th because he was under surveillance then.

So it had to be the night of the 12th or 13th?

Millard's lawyer attempts humour, gets a few laughs from the public gallery. Smich remains straight faced. #Bosma #HamOnt

"I don't recall exactly what happened that night," Smich says. #Bosma

Smich says he doesn't recall how many hands he used to cycle to the forest to bury the gun. #TimBosma

Susan Clairmont ‏@susanclairmont 21m21 minutes ago
"I don't recall exactly what happened that night," Smich tells the court. Asked if he put spade in knapsack? Doesn't remember.

molly hayes ‏@mollyhayes 21m21 minutes ago
Sachak asks if he taped the spade to his head. Smich says "well that's highly unlikely...but like I said I do not remember." #Bosma

Lisa Hepfner ‏@HefCHCHNews 21m21 minutes ago
Highly unlikely he taped it to his head, he says. "Sir, like I said, I do not remember." #TimBosma

  • #138
Which is why it's so odd that MS won't give up the location. Anything on it is easily explained away. And why I personally don't think it's buried in the forest somewhere.

Actually, he would have been better off just giving them a general location where he went in. LE could search for years and never find it. But that doesn't prove he lied about where he went in to the forest to bury it. ;)

MOO

If he tells them he gave it back to Iisho he will be in solitary for 25 years.

  • #139
I'm sure Sachak is a very good lawyer- it's just I have a hard time hearing him go off on these tangents. It wasn't taped to your head- where you going to tape it up on your wall- etc etc. I don't quite understand why he goes off on this more ridicule style of examination. Personally I don't find it all that necessary for him to get his point across. At this speed, it'll be Sachak all week. MOO

Sachak throwing out crazy possibilities: spade taped to Smich's head while he cycled to forest? Smich doesn't remember.

molly hayes ‏@mollyhayes 21m21 minutes ago
Sachak provides more ridiculous scenarios. Smich insists he does not remember. #Bosma

Shannon Martin ‏@ShannonMartinTV 21m21 minutes ago Toronto, Ontario
'I do not remember' Smich repeats this over and over again on the stand about his trip to the forest, to bury the gun #Bosma #HamOnt #Smich

Peter Akman ‏@PeterAkmanCTV 21m21 minutes ago
"I do not remember... I do not remember... I do not remember..." Smich to a strange line of questions about spade, gun. #Bosma @CTVNews

molly hayes ‏@mollyhayes 21m21 minutes ago
Sachak suggests his eyes were open while riding his bike, and legs were peddling. Smich says yes that makes sense. #Bosma

Lisa Hepfner ‏@HefCHCHNews 20m20 minutes ago
When you were cycling your eyes were open. Yes. You used your legs. Yes. Presumably you've got a bag with a gun in your hands
