"There is an absence of any proven motive," Goodman says, pointing out Millard could have easily afforded or stolen the truck.

Really wish that the Crown could have gotten DM'S bank statements to back this up.

Someone asked what happens next

We sit around the courthouse working/talking/watching movies from 10 a.m. to 8:30 p.m. until there is a verdict.

Goodman tells the jury to consider the fact that Millard didn't hide the truck, or his plans to steal one.

"What about bringing a dog to a planned and deliberate murder?" Goodman says.
by Adam Carter 12:01 PM

Goodman asks the jury to consider the fact that Bosma was shot in the very truck Millard wanted. Dungey says it didn't matter.

Goodman tells the jury they can consider Marlena Meneses' testimony that Millard and Smich were "celebrating" the morning after Bosma's death. Points out she also lied under oath.
by Adam Carter 11:55 AM

And since BD testified that MS blew by him when he was waiting, and that time also seems to be the morning of the 7th. Which one is telling the truth? MM and celebration, or BD with MS was troubled and MM told him he better leave?

MOO

I think that is where BD actually told the truth. IMO, MM lied about a celebratory mood. The testimony from all 3 lawyers prove her lie.

Hard to say, Abro felt BD was a credible witness, and MM changed her "celebrating" testimony. I don't think either have a reason to lie about this so it's possible both occurred IMO

Meterclicks - are your tweets slowing? SC isn't posting much of anything

"The only direct evidence as to what occurred on the night in question comes from Smich," Goodman says.
by Adam Carter 12:05 PM

"The issue as to whether there was, or was not a plan, is for you to decide."
by Adam Carter 12:05 PM

Goodman says it "bears repeating" that the Crown relies on "circumstantial evidence" to prove planning and deliberation.

Adam is still going. It's a lot of repeats so maybe they gave up saying the same things lol

"This isn't just a choice between two possible plans -- theft of a truck versus theft of a truck and murder."
by Adam Carter 12:07 PM

If the jury doesn't believe Bosma's murder was planned or deliberate, they have to be found not guilty of first-degree murder, Goodman says.
by Adam Carter 12:09 PM

Goodman now going to decision tree two -- aider and abettors.

I am looking forward to reading the articles about "what the jury didn't see".......

SC (for one) tweeted that she will be publishing something once the jury is sequestered.....

Could shine some light on the TRUTH (not to be confused with JUSTICE).....

all MOO

I thought there was still going to be a publication ban on a lot of stuff pending other trials.

So from what I take from this.... If the jury feels DM/MS did not plan to kill TB then it cannot be considered M1. Right? DM could have planned to kill SOMEONE but unless he directly planned to kill TB, it is not M1. Or am I way off? lol

The first question in this tree is asking if the Crown had proven Millard/Smich did something to help/aid the other to kill Bosma.
by Adam Carter 12:12 PM

If the jury says no to that question, the accused is not guilty.
by Adam Carter 12:14 PM

The second question is if they did help the other, did they know that the other person intended to kill or cause bodily harm and was reckless. If no, the next question is did the accused intend to help or encourage the commission of an unlawful act that was objectively dangerous. If the answer to that is yes, they're guilty of manslaughter.

At the rate this is going with Goodman just finishing 1 of 4 decision trees, I feel like he may not finish today.

As #Bosma jury prepares to deliberate. CLAIRMONT: After the verdict what happens to traumatized jurors? http://www.thespec.com/news-story/6...-verdict-what-happens-to-traumatized-jurors-/ … via @thespec

I took a moment to read this article, and again it's from a juror who expressed how they become a "family", and they only have each other for support.
How scared they were, and they banned together to come to their decision.
And also, how they still get together after the trial was over, because there is no support for people who serve as jurors.

I'm not sure why people think that you'd be hated, and ridiculed or berated, during deliberations for having a different opinion.
This is the second article I've read now that says otherwise.

"Intention and motive are not synonymous with planning and deliberation," Goodman tells jurors.

Justice Goodman has finished with Decision Tree 1. Has told jury he will break for lunch soon and their lunch is being supplied.

A tweet to SC - Will you be publishing what the jury didn't hear once they retire to make their decision?

her answer - Yes

I'm sure there will be some discussions/evidence/names still under the publication ban, but obviously some things can be reported.....MOO

Can anyone remind me how Marlena lied under oath please? I don't recall this but the judge mentioned it?

  • #120
The judge has allowed some material to be published and has upheld the ban on other stuff as per DM's request.

BBM - as per DM? do you have a link for that?
