David Medina is a criminal attorney according to his website.

Apparently AH knew of a criminal atty in spite of the phone call he made to Fontelle's atty...the one where he said he wanted the name of a criminal attorney. :waitasec:

Now I am just as confused as Oriah.


I always thought that was a very strange thing to do. Just a quick search tells me there doesn't seem to be any shortage of criminal attorneys in CA. In AH's position I would have thought straight away there were strong reasons why FH's attorney wouldn't be able to represent/assist us both.
It has crossed my mind it may have been something of a fishing expedition too?
If that's the case, I bet he didn't catch even a tiddler......

Anyway, moving on- I am still interested in the complaints re: the trash. Does anyone know if the trash company that services that neighborhood has an automatic system for reporting violations? Or would it require a call in? I'm not certain how it works in Southern CA- we have both systems in place here, depends on the service one is using.
I kind of want to know because it seems like someone was paying attention to the Windflower trash, and I wonder if that person was also paying attention to the trash at Carnation Dr?

I'd like to know that also, believe. Or even ADT-type security systems that have remote access and/or are based on GPS?

When I was pondering the trash situation yesterday, I got to thinking about a property we own that has a private trash pickup service. The company has very strict rules about what you can and cannot dispose of, certain things on certain days, the bin handle has to face the road or they won't accept it- etc. If you violate a rule, they leave a note taped to the bin with a check next to the applicable violation and do not accept the trash. Next trash day, if you correct your violation, they resume collecting your trash.

But to actually be brought to court seems like a disgruntled neighbor to me. :waitasec:

I am trying to reconcile disturbing the peace and trash pick up/dumping issues. Definitely a disgruntled neighbor who was picking on the AH's or the other way round.

That's one of the things that caught my attention also. Considering the trash issues were dismissed, but the disturbing the peace charge was pled guilty.

Idk. Given the location, and, err, interesting family history going on here.... what was going down on that date, kwim? Seems worth looking into.

FWIW, I am on the zoning board in my community. As far as the 'trash' issues go, usually, if the trash issue is taken care of by the court date, the charges are dismissed. Trash is a Zoning or Health Department issue - not criminal. Disturbing the Peace would be a criminal issue.

I am so glad you weighed in-what kind of scenario can you envision where the AH's were dinged 7 times almost in a row for the improper dumping of their trash...or unlawful dumping or whatever it is? When I looked at the case on the OC Superior Website, each charge was a misdemeanor.

Yes, thanks mikkismom. It looked to me like there was a $100 fine for each infraction, and perhaps those were paid off and that's why they were dismissed?
The disturbing the peace issue coincides with the first trash complaint. Do you know if they would have fined all owners of the residence? Or how that works? TIA if you know.

I'd say it sounds like there was a 'heated exchange' over someone putting the trash out too early, with maybe animals getting into it. Those sort of minor neighbourly disputes can really escalate - I remember seeing one of our WSers' stories about her brother and his wife being shot dead in a dispute over - now I can't think of the name; one of those ditches in the earth to channel floods. The word was there and now it's gone. Sorry about that.

Yes, that just sounds like someone with no respect for authority and/or the neighbours. Unless the garden was filled with junk or something?

ETA: Maybe like a fine for each week the junk was left there?

I wanted to get back to this-of course Mrs Harrod's attorney couldnt represent AH as a criminal attorney because he isnt. It appears to me that AH had already been represented by a criminal attorney-perhaps he didnt like the representation he received. David Medina seems pretty learned. At least, he doesnt have any bar violations unlike AH's current civil atty.
