Oh brother. The def wants this thrown out because pros didn't tell them in enough time before the grand jury that there was a latent fingerprint that could indicate a third party.

The only problem is, from above link: Packer's DNA was found on the visor of a motorcycle helmet found under Brock Husted's body and under Brock's fingernails, according to court documents. Prosecutors claim the motive was robbery.


IF the def' motion is granted, the pros would have to start all over again from the beginning.

Delay tactic. Silly really. The dna evidence is enough to get him convicted.:banghead:

The state's highest court reversed a decision by the appeals court in Ventura, ordering it to hear a motion to dismiss the indictment against Joshua Graham who is accused of killing a Ventura couple and their unborn child.
In a unanimous decision filed last week, six Supreme Court
justices ordered the Court of Appeal, Second Appellate District, Division 6 to have the Ventura County Superior Court show why the dismissal of Packer's indictment should not be granted.

On Father's Day, he was involved in an altercation with deputies in the jail.

(Packer) barricaded himself in his cell Sunday afternoon after not being allowed to phone his dad on Father's Day, sheriff's Capt. Mike Aranda said. Aranda said Packer had lost his phone privileges because of previous behavior.

Packer is accused of killing Brock and Davina Husted and her fetus at the couple's Faria Beach home in 2009. Prosecutors are seeking the death penalty in that case.

Deputies had to remove the 21-year-old suspect from his cell Sunday because they could not see what was going on inside, and he became combative to the point that medical staff had to sedate him, Aranda said. Packer suffered some self-inflicted injuries while thrashing around, Aranda said.

The medicine did not take full effect, however, and Packer started fighting with deputies while being transferred to another cell, Aranda said.

He suffered some facial injuries including a black eye, and several deputies suffered injuries including abrasions, Aranda said, adding that Packer probably will be charged with assaulting the deputies.

Its been some time since I posted and I have had major computer problems. I am back to say that I know very little about the Di Rodio murder but I am a dear friend of Wendy Di Rodio. We had been internet friends for over 9 years and had met two times even though she was in California and I was all the way on the east coast. She did not have a secret life and when the Husted's were killed she NEVER mentioned it, so I feel that she did not know them at all. She was a vibrant, bubbly, wonderful person. I do feel that she knew who murdered her. She would never have opened the door to a stranger. And too I believe her two dogs would have barked and tried to protect her in any way they could. The only thing I know at this time is, the case is continuing to move foward. Thats all I have been told. So its good to even have that tidbit. To know that they are still working on it and its not a cold case. Pray that this does not happen. Thank you for giving her case time and helping to keep it in the news, for whatever thats worth. Sure is too too quiet.

Sadly, it looks like it may have become a cold case.

The letter writer sought justice for a Ventura woman stabbed to death in her bedroom just over two years ago.

"I want to know why nothing has been said in your newspaper since the very first articles about her slaying? Doesn't she deserve justice as anyone else does?" Rita Holifield wrote.

Almost 2,100 miles separate Holifield's central Alabama home and the Ventura Keys house where Wendy Di Rodio was found dead by her mother on June 3, 2009. Di Rodio's beloved dogs were with her. Neither reportedly barked at the assailant, although both survived the attack.

No one has been arrested in the slaying of the 61-year-old licensed therapist and author, and little has been written about it, just as Holifield claims.

one thing I am concerned about is the victims son may have to testify, and the defence will arrack his testimony as he identified a black man as the perpetrator when in fact the defendant is white,

it is very easy for children to be confused and for a trial to be a horrifying and traumatic event adding further pain and trauma to a child who has already suffered through the murder of his parents

I watched the Jessie Dotson trial and saw two little boys who had suffered unimaginable violence at the hands of there uncle brought to court to testify, both boys are still traumatised, both boys have told different versions of what happened the night Jessie Dotson went on his murderous rampage in there home - trying to sort out in there young minds what happened and why,

it was so sad to see those two boys in court - I felt that they should never have been called, and I hope that this little boy need never be called, but if called he needs to be prepared carefully and told that he may testify to what he saw without pressure to get it right,

Packer found guilty in hospital assault case

A jury Monday found Joshua Graham Packer guilty of assault with force likely to produce great bodily injury in connection with a 2009 incident involving a female security guard at Ventura County Medical Center, said prosecutor Anthony Sabo.

The judge set sentencing on the felony assault for Nov. 22.

In June, another jury convicted Packer of misdemeanor battery involving a male security guard during the incident. Jurors deadlocked on the felony assault charge involving the female guard at that time. That led to a retrial.

Packer was in the hospital for a brief stay after a motorcycle accident, Sabo said.

Packer, 22, is awaiting trial on a more serious and unrelated charge, the killings of Brock and Davina Husted and her unborn child at their Faria Beach home. The district attorney is seeking the death penalty.

Appeal rejected:

A court this week rejected an appeal from Joshua Graham Packer, who is accused of killing a Faria Beach couple in 2009, according to prosecutors.

Packer's lawyers argued his indictment was tainted because of grand juror bias, denying him due process. One of the 17 grand jurors was an employee of the Ventura County Sheriff's Department, which conducted the investigation of Packer.

Searching Ventura County court records on the case, his lawyers apparently filed for another continuance yesterday. We'll see what happens on Monday, when the next hearing is scheduled. There is still a jury trial scheduled for next Wednesday, April 18.

There are 1,372 separate entries on the Court Docket for this case. Motions, hearings, etc.
Taxpayers are footing an expensive bill in the effort to send him to Death Row, and this is only the beginning of a decades-long process.

In California, it takes what seems like forever for justice to be done.

A Ventura County grand jury has indicted Joshua Graham Packer on charges of forcible oral copulation in connection with the Faria Beach killings of a couple and their fetus in 2009, according to the District Attorney's Office.

The district attorney issued a news release Monday saying a grand jury last week indicted Packer, of Ventura, of using a knife and forcing Davina Husted to have oral sex with him the night she was killed, according to the recent indictment.

Packer, 22, is charged with a new special circumstance that the killing of Husted was committed while Packer was engaged in the commission of forced oral copulation.

Thanks for the update BiS. That was the first time I had heard of the sexual charge in this case.

I hope the Husted children are doing well.
