GUILTY CA - Classic (Orson West, 3) & Cincere (Orrin West, 4), still missing, Calif. City, *Mistrial on counts 4 & 5)* 21 Dec 2020 #8

Afternoon Testimony, Part 5
DAY NINE - April 17, 2023
https://twitter.com/KGETnews

Detective Paul Hernandez has been called to the stand. He's in the BPD's robbery/homicide division. #WestsTrial

He reviewed multiple videos taken from surveillance footage, looking for any movement at the West home, seeing when people left or arrived, Hernandez said. #WestsTrial

This was from a 24-hour period he reviewed, from midnight on Dec. 21, 2020 to midnight of the next day. #WestsTrial

A motion-activated light turned on but nothing could be seen, then a front porch light later on. At 2:48 a.m. on Dec. 21 the porch light was again activated. There was no movement, Hernandez said. #WestsTrial

At 3:48 a.m. the front porch light again went and turned off a minute later. At 4:05 a.m. a vehicle drives by the residence. Hernandez said he tried to detect movement at the residence or in the yard. #WestsTrial

At 10 a.m. someone walks out the front door of the residence and appears to place items in the trash receptacle, Hernandez said. He does it again a short time later, and again a short time later at 10:06 a.m. #WestsTrial

At 12:21 p.m. someone leaves by the side door of the home and stays on the east portion of the residence for 3-4 minutes, Hernandez said. At 4:12 p.m. someone walks into the rear yard then bends over and stands up multiple times before walking into the home. #WestsTrial

The person entered the home at 4:20 p.m., Hernandez said. The van left the home at 4:33 p.m. At 4:39 p.m. it returned home and someone left the van. #WestsTrial

At 4:51 p.m. there are two people near the van. Shortly afterward law enforcement arrives. They start searching the area. The van leaves again and returns. #WestsTrial

The van returns at 5:05 p.m. The lights are turned off at 5:10 p.m. More officers arrive on scene and canvas the area, Hernandez said. #WestsTrial

Smith has requested to play 3 videos. #WestsTrial

Smith paused a video and Hernandez is pointing out the locations where he saw people or items. #WestsTrial

The video is playing. #WestsTrial
3:49 PM · Apr 17, 2023

Smith is now playing the 2nd video. #WestsTrial
4:05 PM · Apr 17, 2023

The 2nd video has finished and Smith has begun playing the 3rd and last video. All 3 videos are from a surveillance camera on a home west of the West residence, and the videos were from the day the Wests reported Orrin and Orson missing. #WestsTrial

From my memories of these videos, what we do not see on camera is neither Wests running around outside looking and yelling for the boys. Nor frantically knocking on neighbors doors for help.
TW just seems to go straight to his van and take a drive around the neighborhood and return.

Yes, a very short drive. And, I don't think Jacqueline even searched outside at all, IIRC.

Are you still listening, cuffem? Did they mention how long this video is?

ETA: Oops, never mind. They just started playing the second one.

Afternoon Testimony, Part 6
DAY NINE - April 17, 2023

The third video won't be shown in its entirety today. In the videos so far, lights have gone on and off, a couple vehicles are spotted and the Wests' white van drives away. #WestsTrial

The van returns and someone gets out. #WestsTrial

Smith has paused the video and court is in recess for the day. The trial will resume at 9 a.m. tomorrow. #WestsTrial

With TW quietly going straight to the van without looking around or yelling and JW staying inside, it almost like they did not want to attract attention from the neighbors until the police came.
I know if it were my children I would be screaming and running around, knocking on doors. If I drove around I would be honking my horn and yelling out the window to get everyones attention.
Those videos I remember showed no urgency. JMO.

She is trying to poke holes in anything she can to get just one juror to have reasonable doubt. She seems to be working on a shoddy investigation defense for the past week, from questioning to collecting evidence.

Not working for me, I think that LEO did a fantastic job collecting evidence. Especially the video from across the street.

The defense is trying to poke holes at the investigation. The real problem, is that Grandpa Trezell, has so far, been the best witness for the prosecution. He had real tears for O&O.

I found them, thank you.I did delete them just in case they are not allowed in this thread.

I can't think of any reason that precludes them being shown. They are still in MSM and apparently being discussed at trial, so unless there is a pub ban for some reason, they are fine.

Stallings will have a hard time disproving the security footage. From what I have seen this alone will sink them both.
No children seen in backyard prior or after TW is out there. He never looks in the back side empty lot for the boys. You see no persons or vehicle traffic.
He stands on the porch doing nothing for several minutes. No looking around outside, no running anywhere. He gets in the van on the opposite side and drives down the street for 6 minutes before returning and waiting for the police. Just standing there no looking around, knocking on doors. No JW seen looking outside front or back.

Thank you Sillybilly! I will wait to post the video in case there is a ban for the media during the trial.

I remember seeing the video briefly on the news, he got in the car. I thought it was strange, because looking for little kids who leave the yard, I would walk around the neighborhood, calling their names, knocking on doors. And why wasn't Mom out there too?

It seems to me that the defense is trying to push the theory that 1) JW and TW carried Orrin and Orson to the van, 2) left them in the van when they dropped the other boys off at the West's (TW's father has already testified that TW & JW would often leave the kids in the van due to Covid), and the four of them - JW, TW, and O&O - returned home.

But what happens when the children testify? Are they just going to accuse them of lying?

Ryan further testified he has previously worked on one or two missing children cases while serving in the patrol unit at BPD. He currently works as a BPD liaison for the FBI.

Previously, Ryan testified he examined surveillance video from a house close to the Wests’ residence in California City. He testified the footage showed there were only four children who walked into a van with Jacqueline and Trezell, which to him suggested Orrin and Orson weren’t with the kids.

[...]

Ryan also testified Monday he couldn’t distinguish in the footage each of the four children’s clothing, ages or facial descriptions. He acknowledged he couldn’t tell whether any of the individuals walking to and from the Wests’ house was carrying a child.

Det. McNabb on the stand with security video from Superior Grocery and Gasko, taken Dec 19, 2020 at 2:35pm.

Still images shows JW buying something and TW at the counter.

Another image shows JW leaving the store.

One image shows TW in line for the cashier and another shows JW in line.

Trazell enters the store, goes out of frame, goes to counter and leaves the store.

Smith is showing the video from Superior Grocery.

15 minute break.
They seem to have a lot of technical issues with showing video in this trial.

Playing video of Superior Grocery parking lot. The West's white van parks. TW gets out and walks behind van and into the store.

TW puts cart away and enters driver side of van leaving in van.Goes East on California Ave and South on Union Ave.

Attempted to review McDonalds interior video with no success.

When asked if he had seen Orson and Orrin on video, he says he did not.

Smith ends questioning and cross exam from Nasser begins.

McNabb discusses the process of getting the video.

McNabb states there was no exterior video from Gas.

They were unable to get interior video from Superior Grocery because of unanswered calls from Manager.

McNabb is excused.
