#Bracamontes lived off rice and beans and squash prepared in an outdoor kitchen made of cardboard, Dawson says. “How poor were these people? In a poor village, a poor ejido, they known as ‘the frogs’” because they caught frogs to sell to restaurants for $.

Dawson needs to ladle the sympathy on as thick as he can. Prosecution doesn’t get to come back and rebut the defense arguments, so this is the last chance for #Bracamontes.

Dawson notes the farms used DDT and damaging toxins throughout the area, with planes and trucks spraying the poison throughout to kill mosquitoes, part of the effort to show #Bracamontes may have been damaged.

Some of the poisons were sprayed by trucks driving down the dirt roads. “I’m not gonna tell you that Mr. #Bracamontes was sprayed with these toxins and so he committed these terrible acts,” Dawson says, but adds that there may be some risk factor from it that came up later.

Fun fact: I chased those toxin-spraying trucks myself as a boy while growing up on an AFB. My wife remembers doing the same thing in small-town Nebraska.

Dawson shows a family wedding picture with #Bracamontes’ father on the left and mother on far right. Father was a “raging alcoholic” and showed up at the wedding - as he did everywhere - drunk, Dawson says.

“His friends knew him as the town drunk, and he was dangerous,” Dawson says of #Bracamontes’ father.

Dawson says he’s not making excuses for #Bracamontes, he’s just trying to explain what happened to him as a young boy growing up in a violent household.

“This is the man who raised Luis #Bracamontes, if you want to call it that,” Dawson says, pointing at a picture of his dead father, who once took the family’s washing machine and gave it to a girlfriend.

Public defender Jeffrey Barbour now up to complete the #Bracamontes closing, telling jurors he did not expect to have to do so without his client present.

#Bracamontes has angered the jurors, Barbour concedes, but says it is because he is “profoundly, deeply mentally ill.”

A life sentence means “Mr. Bracamontes dies in prison,” Barbour says, an “overwhelmingly punitive sentence and well-deserved.”

Barbour tells jurors that #Bracamontes suffers from bipolar disorder with psychotic features, an illness he kept in check through regimented work schedule and heavy marijuana use. Then, it all fell apart when they lost their house in a swindle and he started to use meth.

“What we are seeeing at this point is the mental illness, not the meth,” Barbour says of #Bracamontes’ behavior. In prison, he could be helped with medication, he says.

“This is not a case where a death penalty is just,” Barbour says, noting that #Bracamontes had no history of violence before 2014. “It’s not justice to give this individual the death penalty.”

#Bracamontes’ threats to jail guards shouldn’t count against him, Barbour says, calling them the “taunts of a mentally ill man.”

Barbour disputes that #Bracamontes intentionally ran over Danny Oliver’s body as he made his getaway, sparking signs of disgust and shaking heads from the Oliver family members.

#Bracamontes is “not the worst of the worst,” Barbour argues, noting that until his rampage he had no history of even a childhood fight and only one criminal conviction.

“We’ve never put him on a pedestal, never said he was perfect, but we said we wanted to show the humanity he has,” Barbour says of #Bracamontes.

Barbour chokes up as he asks jurors to “keep your hearts and minds open,” telling them #Bracamontes is profoundly mentally ill and untreated. Asks them to impose life, not death.
“Know he should not die at the hands of an executioner.”

And that’s all she wrote for this portion of the #Bracamontes trial. Judge Steve White now preparing to read the jury instructions, and the jury likely will begin real deliberations on Tuesday morning.

Bracamontes jury started Deliberations on 2/9/18 and reached a verdict of GUILTY on the same day.
Janelle Marquez Monroy (41) wife charged with assisting her husband. No DP, faces life in prison. Monroy Jury on 2/15 found her guilty of murder & 9 other charges; On 3/23/18 sentenced to 24 years, 10 months plus 25 years to life.
Prosecutors wrapped up their case (3 days on 3/7). Bracamontes' public defenders began presenting witnesses Monday, 3/12 and ended on Thursday, 3/22. Closing Arguments on 3/26, jurors will then deliberate. Fridays are dark.

Verdict coming in cop killer Bracamontes death penalty case.

Sacramento Superior Court Judge Steve White has Justis sentenced a killer of three - a young mother and her two children - to life in prison, and shortly will read the death penalty verdict in cop killer #Bracamontes case.

#Bracamontes jury was out only about four hours, leading to inescapable conclusion that they will be coming back with a death penalty verdict against him.

Sac Sheriff Scott Jone and Placer Sheriff Devon Bell are here, as is Sac DA Anne Marie Schubert to see the penalty imposed against cop killer Luis #Bracamontes in slayings of Sac Deputy Danny Oliver and Placer Detective Michael Davis Jr.

Family members of both slain officers are in court and look pleased but drained after a three and a half year saga. #Bracamontes is not here yet but is expected to be brought in in chains.

Luis Bracamontes got the sentence Tuesday that he has claimed he wanted all along: the death penalty for the 2014 slayings of Sacramento sheriff's Deputy Danny Oliver and Placer sheriff's Detective Michael Davis Jr.

Bracamontes grinned and silently clapped his hands after the verdict was delivered, while public defenders Norm Dawson and Jeffrey Barbour sat grim faced on either side of him in the courtroom. Later he shook hands with his lawyers as deputies prepared to lead him out of the room.

Bracamontes is due to return to court April 25 for a formal sentencing by White at a hearing during which family members of the slain deputies are expected to address the court and Bracamontes.

Convicted cop killer Luis Bracamontes has just entered court for what is expected to be a formal death sentence by Sacramento Superior Court Judge Steve White. Go to SacBee Facebook for live coverage.

Judge Steve White says cop killer Luis Bracamontes committed “cold, vicious murders” that were premeditated and willful.

Judge White says death instead of life without parole is merited. But first he will recess briefly before formal sentencing.

The victims of cop killer Luis Bracamontes are expected to start with victim pact statements soon. First up is Sacramento Deputy Scott Brown, partner of slain deputy Danny Oliver. Many expect Bracamontes to erupt when Brown begins.

Judge Steve White carefully going through probation report before declaring formal sentence of death for cop killer Luis Bracamontes. He already has indicated Bracamontes is not going to get life without parole, as his lawyers have asked.

About eight family members and friends of slain Sacramento Deputy Danny Oliver and Placer Detective Michael Davis Jr. are about to make statements.

Deputy Scott Brown blaming himself for not killing Bracamontes in that parking lot, saying he could have saved others the pain Bracamontes caused during his rampage.

“I had to tell my 6-year-old why Daddy was sad,” Deputy Brown says. His son wanted to know how soon he would retire to know how long he would have to fear losing his dad.

I’ve watched cop killer Luis Bracamontes for 3 1/2 years now, and I have to say, his behavior is an act. He frequently can’t make eye contact with reporters and others.

Landscaper Jose Salas, who had his truck carjacked by Bracamontes, says, “I’m happy to be alive.”

Danny Oliver’s mom, Joyce, wearing a t-shirt honoring her son now begins to read her statement about Bracamontes, who is smiling at her like it’s a joke of some sort.

Her husband, Danny Oliver’s dad, died waiting for this day to come.

Cop killer Luis Bracamontes swinging back and forth in his swivel chair smiling as Danny Oliver’s mom talks about seeing her dead son’s body at the coroner’s office.

Joyce Oliver talks about the taunting andd verbal abuse by Bracamontes. Then, she interrupts her statement, looks at him, “Smile, sucker.” Then asks for his life to be miserable while he waits for death.

Joyce Oliver has no fear of Luis Bracamontes. She has been waiting for this day.

Danny Oliver’s sister, Penny Miller, now up to speak. Bracamontes appears to sometimes force himself to grin, part of what has got to be an act. During trial, he never could face his own family members when they testified.

Phyllis Silva, sister of Danny Oliver, now speaking. “Every time I drive by a law enforcement officer who has pulled someone over I have a panic attack,” she says.

“Your honor, Danny wass killed by a coward and we will never get to see him again,” Phyllis Silva says.

Danny Oliver’s widow, Susan, now speaking calmly, thanking the jurors and the judge. “I feel for everyone,” she says. “My husband is a hero, and he lives forever, the chains that are on you, that is my husband,” she tells a laughing Bracamontes.

“I ain’t dead yet,” Bracamontes tells Susan Oliver after her graceful statement to him. “Be quiet, Mr. Bracamontes,” judge says.

Former Placer Deputy Chuck Bardo, calls him a monster and a coward and Bracamontes goes off. White has him removed ass he shouts obscenities.

“And in the true fashion of aa coward, he retreats,” Bardo says, as Bracamontes continues to shout from the basement as he’s led away. “Your mama,” victim Anthony Holmes shouts from the courtroom to Bracamontes.

“”He came out crying like a baby, surrendered like a coward,” Bardo says of Bracamontes’ surrender. “I apologize to the taxpayers of California that I didn’t’t kill this man when I had the chance,” Bardo says. “Please, please see that justice is done, your honor.”

Detective Jeff Davis, wounded in Placer County by Bracamontes, now at the stand talking about the dead eputies. “They never had a chance because he never gave them one,” Davis says.

“It was plainly evident i was going to be murdderedd,” Jeff Davis says, recounting seeing the bullets strike the ground around him as Bracamontes fired at him.

I traded fire with this cowardly murderer until he ran away,” Davis says. “After he ran away I discovered I had been shot.”

This sentencing for cop killer Luis Brraccamontes should go much faster with the defendant out of the courtroom, but unclear whether judge has to order his return to pronounce death sentence.

Jeff Davis says bullet fragments still come out of his wounded arm, including this morning. Hard to imagine the pain he has suffered.

“It’s entirely Mr. Bracamontes’ fault,” Jeff Davis said, noting that Bracamontes ran while law officers faced him and tried to stop him. “You are simply a cowardly, fearful man who ran away from consequences.”

Samantha Davis, daughter of slain Detective Michael Davis Jr., now tearfully reading a statement. “The defendant took away my best friend and hero, my dad,” she says.

“My entire life is gone to the point where i have nothing to live for,” Samantha Davis says, adding that she waits for death to see her dad again in afterlife. Cop killer Luis Bracamontes isn’t here to hear it.

The sheer toll of cop killer Luis Bracamontes’ crimes flooding into courtroom as family members of the men he killed speak of their loss and weep. One of the four courtroom deputies looks like he is about to cry himself.

Sgt. Jason Davis, brother of slain Detective Michael Davis, says he wanted Luis in the courtroom “so I could look him in the eye as I tell him these things.”

Jason Davis says he spent years praying about what he would say to Luis Bracamontes, says he abandoned God after brother slain, but since has renewed his faith.

Jason Davis says he prays for Luis Bracamontes and his wife and co-defendant every day.

Debbie McMahon, mother of Det. Michael Davis Jr., now speaking about the loss of her son and the life events he will miss, the weddings, grandchildren, etc.

Now Debbie McMahon recalls holding her dying son at the hospital. “I know I’ll never get over it,” she says.

“No one is giving Mr. Bracamontes his sentence, he earned it all himself,” Debbie McMahon says.

Judge White again calls Luis Bracamontes’ crimes vicious, then sentences him to death. Bracamontes isn’t in court because of his outbursts.
