1/21/22 Update: Hearing on 1/24/22 & sentencing/disposition & firearms compliance review hearings on 2/28/22 @ 10am. 1/24/22 Update: Haobsh appeared in Santa Barbara Superior Court Monday afternoon as the court discussed whether Haobsh would be appointed new counsel. Haobsh has requested to make a motion for a new trial on the basis of ineffective assistance of counsel & public defenders Christine Voss & Michael Hanley said that they intend to declare a conflict, stating that they “cannot fairly & objectively assess (their) own trial performance.” With this conflict, the public defenders said they believe they should be relieved from the case. Voss has represented Haobsh since he was charged in 2016 & Hanley joined the case later. Judge Brian Hill presided over a bench trial, without a jury & found Haobsh guilty of all charges in November, including three counts of murder for killing Dr. Weidong “Henry” Han, 57, founder of Santa Barbara Herb Clinic; his wife, Huijie “Jennie” Yu, 29 & their 5-year-old daughter. Haobsh’s sentencing was originally scheduled for Monday, but was postponed until it is determined if a new defense attorney needs to be appointed for the rest of the case. According to Supervising Deputy District Attorney Benjamin Ladinig, Haobsh’s reasoning for the claim of ineffective assistance of counsel is the public defenders’ “failure to call two FBI agents to witness,” although Ladinig said that the agents would not have added anything to the case. No decision was made in court on Monday & Judge Hill continued the hearing at 2:30pm on 2/3/22, during which he will hear evidence & rule on whether to dismiss Voss & Hanley. Sentencing was rescheduled for 2/28/22, however, Hill said the date may need to be postponed again.

SANTA BARBARA COUNTY, Calif. -- A Santa Barbara County Superior Court Judge denied Pierre Haobsh's – the 31-year-old man who was convicted for a triple murder in November 2021 – request to replace his trial counsel prior to sentencing, the District Attorney's Office announced on Friday.

Judge Brian Hill denied Haobsh's request to replace his trial counsel prior to sentencing on Thursday.

He will be sentenced in Department 2 of the Santa Barbara Superior Court on Feb. 28 at 10 a.m.

Sentencing has one again been postponed for a Santa Barbara man convicted of killing a Goleta family of three.

Haobsh was originally scheduled to be sentenced on January 24 but that was postponed after he requested his trial counsel be replaced.

The request was denied and sentencing set for February 28 but the Santa Barbara County District Attorney’s Office on Monday says Haobsh is now due back in court March 8 for a hearing on whether the defendant can represent himself.

Sentencing is now scheduled for March 28 at 1:30 p.m. If it does in fact take place that day, it is expected he will be sentenced to a maximum of three consecutive life sentences without the possibility of parole.

A Faretta motion is a petition that criminal defendants file with the court seeking permission to represent themselves, that is act as their own attorney, in a criminal proceeding. This is commonly referred to as going “pro per.” The name of the motion comes from a Supreme Court case, Faretta v. California.

^^^ BBM Just want to say, he has been allowed to delay and stall way beyond my patience level. It's a little late to try to defend himself. The reality is he senselessly killed three innocent human beings and has been found guilty of it. I'm waiting for the final LWOP sentence.

Pierre Haobsh petitions court to represent himself ahead of sentencing | News Channel 3-12

SANTA BARBARA COUNTY, Calif. - Pierre Haobsh, the man convicted in November of murdering the Han family inside their hillside home near Goleta, is seeking to represent himself at the sentencing phase of his trial in Santa Barbara Superior Court.

"Not advisable to represent yourself, even at this stage," said Judge Brian Hill to the defendant. "It really is advisable that you be advised by counsel."

Judge Hill encouraged Haobsh and his Public Defender, Christine Voss, "to talk."

The so-called Faretta motion will be discussed March 8. At that time, Judge Hill will go through files from both sides and determine which questions to ask of Haobsh before making his final decision.

During Monday's hearing, both Haobsh and Voss raised concerns about the defendant's jailhouse diet and personal safety.

Haobsh revealed that he's been involved in "lots of fights" with cellmates and the only way to be safely housed in Santa Barbara County's Main Jail is through the judge.

Judge Hill responded that he would not tolerate a pattern of fights involving Haobsh and recommended his defense team contact County Counsel.

Sentencing is set for March 28 at 1:30 p.m.

Prosecutor Benjamin Ladinig told Judge Hill he wants sentencing to take place before the six year anniversary of the Han family murders.

Convicted killer Pierre Haobsh — who was found guilty in November of the triple homicide of Santa Barbara herbalist Henry Han; Han’s wife, Jennie Yu; and their 5-year-old daughter, Emily Han — was granted a request to represent himself after applying to drop his legal counsel in February.

Haobsh was transported from Santa Barbara’s Main Jail to appear in Judge Brian Hill’s Department 2 courtroom Tuesday, shackled and in a county-issue orange jumpsuit, four months after being found guilty of the three murders.

“You’re not going to get any special treatment from the court,” Hill said. The only courtesy Hill provided Haobsh was one final continuance for sentencing. Haobsh was scheduled to appear on March 28, but with the new developments, Hill granted him an extra four weeks to file any motions he needed to. “We’re not gonna continue it again — I’ll make that clear,” Hill said.

Haobsh spoke only a few times, seeming to have plans to reintroduce new evidence. Like his fanciful testimony, he said that there was “discovery evidence” of text messages that would show involvement with “government agents” and clear his name.

Hill said Haobsh would have to provide an account of what the evidence would show, but sentencing would likely proceed as planned. Haobsh faces three life sentences at his next court date on April 15.

Pierre Haobsh Sentenced to Life in Prison for Murders of Goleta-Area Family

More than six years after Santa Barbara Herb Clinic founder Dr. Weidong “Henry” Han and his family were killed in 2016, Pierre Haobsh — who was convicted of the triple murders last November — was sentenced Friday to three consecutive counts of life in prison without the possibility of parole, followed by 75 years to life in prison.

Haobsh, 32, appeared in Santa Barbara County Superior Court, representing himself for sentencing.

It was delayed multiple times as Haobsh requested new attorneys after the guilty trial verdict and, when he was denied, decided to represent himself.

Judge Brian Hill sentenced Haobsh to life in prison without parole for each murder, as well as 25 years to life in prison for special allegations that the killings were willful, premeditated, and deliberate; committed by means of lying in wait; and committed for financial gain.

The court also ordered Haobsh to pay $22,500 to the California Victim Compensation Board, along with other fines and fees.

In addition to the sentencing, Hill addressed motions that Haobsh had filed seeking a new trial, and a petition for writ of habeas corpus.

Haobsh said part of his reasoning for wanting a new trial, as well as his decision to represent himself, was due to “ineffective assistance of counsel.”

During the trial, Haobsh was represented by deputy public defenders Christine Voss and Michael Hanley.

Hill ultimately denied both the motions, although Haobsh can re-file the motions in appellate court.

SANTA BARBARA, Calif. – Pierre Haobsh, the man found guilty of murdering the Han family in 2016, was sentenced in Santa Barbara Superior Court on Friday to three consecutive life sentences without the possibility of parole, followed by 75 years to life in state prison, according to the Santa Barbara County District Attorney's Office.

"He has no possibility of ever being released," Supervising Deputy District Attorney Ben Ladinig told News Channel 3-12. "He will literally die in prison."

Ladinig explained that the three life sentences are for each of the murders that Haobsh, 32, committed in 2016 when he killed Dr. Henry Han, his wife, Jennie, and their 5-year-old daughter, Emily, in their Goleta Valley home, wrapping them in plastic and leaving them dead inside of the garage.

The 75 years to life in state prison that will follow the three life sentences were for gun use causing death, Ladinig said. Haobsh was also sentenced for the special circumstance of committing murder for financial gain, he added.

Haobsh requested a new trial base on ineffective counsel but Judge Hill declined.
