This is our testimony before the Oregon Senate Judiciary Committee while we, Crime Victims United, and the AG were lobbying for a new Victims Protection law which pertains to Post Conviction Relief in 2007. Every child sat with me and my husband as I testified and then my son stepped forward (under the glare of the TV cameras) and spoke. Scroll down to the very bottom and you can listen to the audio of his short speech.

This son is not the one who is now 24. This son was 17 at the time of the testimony and has survived horrific PTSD and a suicide attempt. When I waiver, I think of his strength and keep going. By the way, he was adopted from San Mateo County too, in 1991. There wasn't a dry eye in the room when he sat down. Our bill got a pass that day and is now a law.

Not that I'm overly proud, but this young man is pulling a C+ average in his Criminal Justice classes at a Community College and is a state ranked soccer player. All this with being born at 32 weeks and addicted to crack cocaine, having tremendous learning challenges, being blind in one eye, and enduring horrific sexual abuse and the ten years of trials and appeals.

The human spirit can be be stronger than anyone can imagine. This young man is the most gentle soul I've ever met. His abuse hurt him to the core but he's digging out and finding his way. I'm so proud to be his Momma.

That's what a mother of a victim told us.

Ayres is like that mobster who would show up for trial in a bathrobe and pretend not to understand anything that was going on.

In the first trial, he kept saying he had a bad memory but then remembered every last office he's ever held for the last 50 years.

Bradley would cop the insanity plea, while Ayres's lawyer will say he's mentally incompetent and can't understand the proceedings.

Meanwhile, Ayres has been seen at the opera - walking without the walker that he used for a prop every day at the first trial.

But, but, but, Ayres' lawyer just told the Boston Globe Ayres was "anxious to clear his name."
How can that be, if he's mentally incompetent to stand trial?

Globe excerpt:

you cant say he's not competent to stand trial but desperate to clear his name at the same timee........its an oxymoron

Just be overly proud.

I'm reasonably intelligent, and I D'd and F'd my way through some pretty big chunks of college the first time round. Hard to do well while you're trying hard to NOT focus on anything.

C+ and doing well at a sport sounds dedicated and mentally healthy, focused on reality. That will get you a lot farther in REAL life than a few more points on a test ever will.

About the newly breaking next ayres defense.

I knew it was likely to be delayed again. I just thought we'd have been delayed by now. Frankly the potential for delay has really hit me a lot harder than expected.

you know we know these pedophiles cant be changed, and wont stop. but that doesnt make them crazy or incompetent to stand trial.
they know right from wrong, which is the issue. and they arent loony tunes drooling all over themsselves and talking in tounges either

Well, pedophilia is a "paraphilia" which is considered by the DSM to be a psychological disorder.

So, if Ayres is willing to conceed that he has this paraphilia during or before his trial ;), I suppose a judge could take it into consideration while determining his sentence. Provided he cops to the lot....the thing is, Ayres is out of chances. He knows it, his attorney knows it....the whole thing is coming down. I suspect that the active search for victims in New England has them very, very nervous.

Oh, no, Ayres would never admit that he was a pedophile or a paraphilia. According to him , he is a "physician first, and a psychiatrist second." Even though the place where he received child psychiatry training forbade psychiatrsts from touching children in therapy, he insists to this day that he has every right to, as he is a medical doctor.

In November, a child psychiatrist named Miguel Frontera in Baltimore had his license suspended for molesting boys. Unlike Ayres, when confronted by law enforcement he admitted that there was "no medical reason" for him to have touched the boys.

Dr Ayres and cohorts need to be bumped to the front page...I want to keep abreast of whether or not he actually tries an incompetency defense.

Thanks On-I took the time to read the blogpost and comments from 3/7/10 as well. I think it is very very important for the victims heading into the trial in April to do their best to recollect the number of physical exams Ayres gave them when they were in treatment with him.

At the end of the day, this is what will sink his ship.....

One of the most frustrating things about this case is that even when I'm talking about it, the wording that I use talks about "physical examinations" and regardless of the count, and without going into specifics, I can say that even though that's the justification ayres is using, these were CLEARLY not within the realm of physical examinations, and were CLEARLY sexual in nature, and the victims are all pretty consistent in talking about the unusual nature of the "exams."

Unfortunately, the jury is presented with having to decide who is more believable, prosecution witness or defense witnesses. Both the NUMBER and CONTENT of the "examinations" are in contention, and there is no real agreement about any of it between the two sides. During the last trial, even the defense was pretty clear that the medical records that ayres kept were not really all that complete, and several times the excuse was given that no other doctors ever really asked for copies of his medical notes, hence, his notes were mostly for his own reference.

There is even contention within his OWN testimony about dates in one case, where the dates in the record show two different DATES for two "bladder volume measurement tests," but during his testimony, he talked about two tests on the SAME date (Once at the beginning, and once at the end of ONE session,) and in the notes, the exams are listed sequentially (but with different dates) and in the same pen, with intermediate dated notes following AFTER both dates.

You guys--Read through Ayres' transcribed testimony. I did and I about lost my breakfast.

Did you see this:

"ayres: No, not to every patient. The ones that I would examine are children in wheelchairs […] and I think if I had a child who had diabetes […] or something that they’re really struggling with, some kind of developmental disease like diabetes."

My son has diabetes and saw Ayres in 1991, less than a year after he was diagnosed and hospitalized with Type 1 Diabetes at age 5 1/2. His mother, 3 siblings and 5 uncles all died of the disease before age 26. He has a particularly "brittle" type (no amount of control can manage it). He was also in and out of a wheelchair at that time due to extreme neuropathy in his feet.

How could Ayres rationalize examining the genitals of a boy with diabetes? Is he going to write it off to checking for erectile dysfunction in diabetic males? Our pediatrician simply talked to our son about that, at around age 13 or 14. He never closely examined him. It's a dysfunction caused by the disease, not a structural problem. Possibly Ayres is referring to older boys with diabetes. Possibly. I don't want him to have touched my son.

Does anyone know, even anecdotally, how young the youngest victims were in San Mateo County? And what exactly was Ayres doing in 1991? Sadly, our son's long time caseworker passed away three years ago. She was a rare worker in that she was our son's worker from the day of intake and stayed in touch with him for years after adoption. I so badly wish I could call her.

I'm going to go way out on a limb here and just put this question out on the table. Was Ayres ever accused of inserting anything into a boy's penis?

It is my personal belief that ayres target range is 12 - 15ish. If you read any of the analysis of pedophiles, you'll find that they typically have target age ranges. Pedophiles that like boys are USUALLY after slightly older boys. Specifically, they're interested in developmental age ranges, not AGES, per se.

That's one of the reasons that it's so creepy when ayres talks about "Tanner Stages" He has clinical understanding of the criteria for his preferred age range.

I THINK I recall hearing that there was one 9 year old, but also that they were an early developer, which would fit with all of the above.

Just speculation at this, and I'm a bit mushy on the age details. Some stuff about the case I manage to keep in my head, other things, I deliberately let go of pretty quickly. This seems to be one of them.

OH... in 1991 he was still in "practice" private patients, still doing court eval, he was also working on the board of San Mateo's Children and Families First, at that time, I believe.

Not that I'm aware of. (Not in any of the testimony, and it never happened to me.)
