Mercyneal--Have you ever visited at Napa? I used to volunteer there (from 1987-1990), teaching quilting and fiber arts to some of the residents. It's not a very pleasant place--at least the places I saw. If I were placed there, I'd do everything in my power to "regain competency" just to get out.

I will be very interested to see how Ayres deteriorates or improves in six months. IMO, he's sort of backed into a corner at this point. Let's hope that he doesn't get special perks.


The following photo (which just happens to show recently convicted pedophile director, Claude Foulk) is taken in one of the units. The activity/day rooms were at the end of halls like this. Napa is a bit brighter and cleaner than the Oregon State Hospital but still pretty bleak and depressing.

Although some in the San Mateo DA's office say that they want Ayres to go to Napa, there is evidence that they have been allowing Ayres' lawyer to look for cushier rest homes for him since July.
We don't believe for a minute that Ayres will act incompetent enough to go to Napa. And if he's competent, then he needs to stand trial.

It's the DA who's letting him off the hook at this point.. Both Ayres and the DA are now backed into a corner.

We say, let's have Attorney General Kamala Harris and Governor Jerry Brown investigate the conflicting stories and false statements coming out of the San Mateo DA's office on the Ayres matter.

Let's get someone from outside San Mateo County to evaluate Ayres... And let's get the AG to take a gander at the investigator's findings on Ayres, and his perfectly lucid conversation about his past business ventures; the Iowa straw polls and his future.

On June 16, 2011, the prosecutor told a jury that Ayres was fit to stand trial.

One week later on June 24, 2011 the prosecutor was suddenly telling parents that Ayres was NOT competent to stand trial. She didn't take into account that she did a crappy job on the mental competency trial - doing no prep as usual.

She should be removed from the Ayres case; fired and disbarred.

And let's get this case into the hands of the Attorney General, where it rightfully belongs!

The judge says that Ayres is going to Napa but no one believes him... especially as the prosecutor on the case has been telling reporters and families of victims since June 24 that Ayres is not going to Napa.... We strongly believe that there has been a deal in place by DA Wagstaffe; Ayres' lawyer ( who worked in the San Mateo DA's office for over a decade) and Judge John Grandsaert who worked in the San Mateo DA's office for almost a decade- to put Ayres in a rest home and then set him free after a few months.

The families vow to seek justice against Ayres. They have petitioned California’s attorney general and governor for a change of venue in the case.

“This is not the last chapter,” Balfour said.

Balfour said many of Ayres' victims have suffered from depression, alcoholism and drug addiction. On Aug. 7, a 48-year-old victim committed suicide by running into oncoming traffic in Southern California, she said. In February, a 44-year-old victim died of alcoholism, she said. Others have ended up in state prison, while others have filed civil suits against Ayres, she said.

"He needs to be retried," Balfour said. "What the parents want now is a change of venue."

Another perv child psychiatrist arrested in Pennsylvania:

KINGSTON - Child psychiatrist Dr. John Francis Theroux, 53, of Kingston, was arrested Wednesday morning on charges he downloaded images of children engaged in lewd sex acts.

John Francis Theroux, left, arrives with his attorney, Frank Nocito, at District Judge Paul Roberts office in Kingston Wednesday morning. Theroux, a child psychiatrist, was charged with possession of child .

Theroux was arraigned by District Judge Paul Roberts on 66 counts of possession of child and one count of criminal use of communication facility. He had worked at Children's Service Center in Wilkes-Barre until his recent resignation.

Freed sex offender returning to Utah
September 27, 2011

"A sex offender who was freed in April despite facing 20 new child sex abuse counts is coming back to Utah for a psychological evaluation. The evaluation could lead to a trial for Lonnie Hyrum Johnson, 39. Johnson returned to the state Tuesday from Oregon, where he was living with his sister, a Utah County prosecutor said. Johnson returned without a law enforcement escort.

"...After multiple evaluations, the judge had found Lonnie Johnson incompetent to stand trial and, based on a doctor’s report, unlikely to ever be able to do so. Prosecutors, however, believe Lonnie Johnson could be restored to competency, based on new information from the defendant’s one-time physician at the Utah State Hospital.

An affidavit from psychiatrist Peter Heinbecker reports "inconsistencies" between the defendant’s "behavioral and cognitive functioning." The report cites examples of Lonnie Johnson being able to meet goals, interact with others and teach himself to learn new techniques by reading manuals...."

We could have predicted this: Ayres' lawyer has scheduled some status meeting for Monday, October 3. Ayres was supposed to go to Napa State Hospital on October 6 but no one believes he will. What excuse willl he have now? It's probably something that the DA and his lawyer cooked up together.

A former child psychiatrist facing molestation charges has had his admission to a state mental hospital delayed by three weeks because of missing paperwork.

Although District Attorney Steve Wagstaffe has for years sent out what is supposed to be an all inclusive daily press release of cases of interest in the Redwood City courthouse for reporters, he mystifyingly neglected to alert the reporters about this hearing.

It's even more mystifying when you consider that Ayres was scheduled to go to Napa on October 6. Wagstaffe knew that the public was very interested in this, as are reporters. Yet he didn't tell anyone that Ayres wasn't going to Napa on the 6th and he didn't tell reporters about the hearing that occurred on October 4.

On September 28, a mother of a victim happened to call the court clerk to check on the October 6 hearing. She was told there would be no hearing on that date, but that there would be one on October 3. The Ayres blog posted on this.

But the reporters for the San Mateo County Times were left in the dark. When the reporter called Wagstaffe the day after the October 3 hearing, Wagstaffe according to the reporter" acted like he didn't know it had happened."


Wagstaffe pretends to be so open and transparent with reporters but the fact is he is also known for hiding cases that make his office or San Mateo County look bad. Wagstaffe hid a case from the press and the public that involved Cardell Brown, a counselor at a County group home who was raping boys. He left the entire case off his daily press list. The only reason we found out about it was that the lawyer for the boys contacted us and asked why there had been no press on it. By that point Brown had already gone to prison.. Wagstaffe feared more lawsuits against the County.

One can't help wonder if Wagstaffe dragged his feet on the Ayres case and is now punting because his office hired Ayres as did the juvenile courts and Children's Services for years. Think of all the lawsuits against the County.

Wagstaffe we believe was the one who got the time changed on the key August 22 hearing to determine if they were going to retry Ayres. Wagstaffe didn't tell the press or the public and we believe Wagstaffe did this because he knew there would be outrage for their decision not to retry him.

If a mother of a victim knew about the hearing change last week, it's laughable to think that DA Wagstaffe - a self described micromanager who reads everything that comes into his office- had no idea about the latest hearing in Ayres case- a national case that has been written about in the New York Times

His office has violated Marsy's Law in the Ayres case over and over and over in the last few years. They never alert victims about hearings. And now he's hiding crucial hearings and pretending not to know about them. Wagstaffe is a sneak all right.

The question is: WHY IS HE ATTEMPTING TO KEEP THE AYRES HEARINGS A SECRET?
