EH will likely need a college degree when she gets out of prison. Sayonara to anywhere elite, like she considers her peeps: fraud and conspiracy don't go over well in those circles. Not a whole lot of circles, really.
Of maybe she'll dig in her heels and continue the charade about not getting a college degree because she's above it.

Wow, this judge is not having any loosey goosey. So, she's getting treated already as a convicted felon. Pretrial services are there to follow through on convictions, correct? Ready to go! That's why Downey says they "oughta wait"? But wait, does "pretrial services" also handle the sentencing and bond stuff?

Elizabeth Holmes' trial is almost over, here's what the future could hold for the founder accused of fooling the world

Jurors are now in their third week of deliberations in the Holmes trial, and after nearly four months of testimony, 32 witness accounts, and three full days of jury deliberation, Holmes’s fate remains uncertain.

But it is likely that the 37-year-old mother will face jail time, Justin Paperny, founder of federal prison consultancy White Collar Advice, told Fortune.

“I suspect she may get five to seven years in prison,” said Paperny.

So what will that look like? Paperny, who himself served an 18-month sentence for a single count of conspiracy to commit securities fraud, and who now works with people in similar situations, walked us through the process.

The sentencing
It’s very likely that Holmes will end up serving jail time, said Paperny. She already agreed to a large settlement with the Securities and Exchange Commission in 2018, in which she will return millions of shares to Theranos, pay a $500,000 fine, and abstain from serving as an officer or director of a public company for 10 years. That shows she has admitted some guilt and could sway a jury against her, said Paperny, who added that most defendants lose at trial (fewer than 1% go to trial and win their cases).

As a federal prisoner, Holmes would be eligible for a 15% reduction in her sentence for good behavior, but other than that, early release options in the federal system are very limited. “There is no real mechanism to really aggressively advance your release date in federal prison,” said Paperny.

But that doesn’t mean that Holmes will be going to prison soon, either. If Holmes loses her case, she’ll likely appeal to a higher court and could remain free while that appeal is pending. Paperny says that could take as long as 18 months. If that appeal goes south, she’ll be asked to turn herself in.

The prison
Holmes will likely be sent to a low-security prison, often referred to as Club Fed, because her alleged crimes were nonviolent and white collar. Paperny predicted that she could end up in Alderson, W.Va., where Martha Stewart served her five-month term for lying about a stock sale. That would mean no fences plus a swimming pool, volleyball, softball, tennis, racquetball, and even roller skating. Another option is a prison camp in Dublin, Calif. The prison, which is in the Bay Area, is where Felicity Huffman spent time for her role in the college admissions scandal. Amenities include a sundeck and tennis courts. They also have craft activities like crochet, watercolor painting, and origami.

Oh God no! We don't want her here in Dublin. I'm glad that they found her guilty of something, but upset that it was not guilty that she defrauded patients. Lives are more important than money. She needs to be locked up right away, and not in some Club Fed. See what happens when I leave to go to Home Depot???

She gives me the creeps.
Earlier today I watched a 5 minute video where she spoke in that bizarre low tone (can't remember where), and her eyes were exaggeratingly wide and staring ....gah, really weirded me out. Why does she do that?
She thinks it's sexy. It did work to mesmerize some of these guys.

Holmes' counsel Lance Wade is back in the courtroom for a brief moment. He picked a book up off the defense's counsel table and flipped through it before landing on a page and walking back into the side room (where Holmes is) while reading intently. He looks tired.

The clerk comes back, and tells the attorneys that the jurors are open to talking with them about the verdict, but jurors want to speak in chambers and not in the main courtroom.

The clerk just led the prosecution's trial team and some defense attorneys to chambers to talk to some of the jurors who have agreed to talk. "Those that wanted to stay have stayed," she says. Holmes' counsel Lance Wade and Kevin Downey decided not to join them.

Elizabeth Holmes is back in the courtroom. Judge Ed Davila is on the bench. "Counsel, any thoughts about next steps?" Prosecutor Jeff Schenk asks the judge to set a status hearing next week on the 3 counts that were not unanimous.
Oh good! Maybe he'll retry her on those charges.

IMO it was the nature of Duggar's crime that got him instantly remanded. Plus, he has a history of child sexual assault, plus he can't control himself, plus he was convicted of viewing the most heinously graphic sexual assaults on children that you could possibly imagine... He was an immediate danger to others, and he hangs around children ALOT.
Maybe EH will have to wear an ankle bracelet? She'll get her passport confiscated. Why would she risk her appeal by fleeing? No one will want to fly her anywhere: they'd get charged for obstruction or something, surely. And how great will it look to an appeal jury if she dumps her kid to flee?
I wonder if her husband will divorce her and sue for custody...
I wonder if she could get state charges on behalf of other patients?

EH having to submit to strip searches every time she has a visit....

I personally think that the child was planned for the trial. Too bad the trial was delayed. That baby is probably far better off away from her. INMO.

I'm glad you said that, because that's exactly what I think.

She is manipulative and calculating enough to think that having a young child would engender enough sympathy so that she would escape or lessen a conviction.

I truly believe she is a con artist enough to do that.

OMG I am sooooooo HAPPY!!!! I was certain this psychopath was going to walk free. This is an amazing week- Ghislane and now Elizabeth Holmes!!!

Any prediction on how much she'll spend in prison?

Tuesday, January 3rd:
*Trial continues (Day 46)-VERDICT REACHED! (@ 8:30am PT) - CA – for *Elizabeth A. Holmes (34/now 37) (CEO of Theranos) charged (March, 2018) & indicted (6/14/18) & arraigned (6/15/18) with 9 counts of wire fraud & 2 counts of conspiracy to commit wire fraud and charged & indicted (4/11/20) with fraud relating to a patient's blood test. Another count of wire fraud was added in 2020, bringing the total number of felony charges to 12. Plead not guilty. $500K unsecured bond. Out on bond. Faces a maximum sentence of 20 years in prison & up to $2.75 million in fines, plus restitution, & $250K for each individual count of wire fraud & conspiracy.
Defrauding investors out of $700 million in funding for their blood-testing startup Theranos.
Trial began on 8/31/21 with jury selection & completed on 9/1/21. 12 jurors of 7 men & 5 women (6 Caucasians, 4 Hispanics & 2 Asians) with five alternates (3 men & 2 women). Juror #7 excused & replaced with alternate #1. Now jurors are 8 men & 4 women. Alternates 2 men & 2 women. 10/6/21: Juror #4 excused & replace with alternate #2. Now jurors are 8 men & 4 women. Alternates 2 men & 1 woman. 10/22/21: The judge excused Juror #5, moving up the third alternate to replace the juror. Both are women. No word on why the juror was excused. Now jurors are 8 men & 4 women. Alternates 2 men.
Trial began on 9/8/21 & ended with closing arguments on 12/17/21. Jury began deliberations on 12/17: ½ hour. 12/20: 6 ½ hours with 1 hour lunch. 12/21: ~7 ½ hours. 12/23: ~7 ½ hours. 12/27: ~7 ½ hours. 12/28: ~7 ½ hours. 12/29: ~7 ½ hours. 1/3/22: 6 hours 20 minutes. Total: ~51 hours. Deliberations ended on 1/3/22.
The Court trial days will be Tuesday, Wednesday & Friday, possibly other half days. The Court may modify the trial time & set either 8:30am-2pm or 9am-2pm & possibly 30-minute breaks in between. Judge Edward J. Davila presiding.

1/3/22 Monday, Trial Day 46/Day 8 of Verdict Watch: Jury continues deliberations. The jurors started deliberations at 8:30am. At 10am the jury has a note for the court. There will be a hearing at 10:45am to hear the contents of the note. This is the third note the jury has sent over 7 days of deliberations. Judge Davila reads note No. 3: “We are unable to come to a unanimous verdict on three of the counts.”

The judge just finished reading the instructions (Allen Charge) & the jury went back to deliberate some more.
Another note from jury. The judge will read the note at 3:10pm. Judge Davila reads the note from the jury that says "after considering all evidence & given the instructions we have concluded we cannot reach a unanimous verdict on three charges." Judge Davila says he wants the jury to return to the courtroom & poll the jurors, asking if they agree with the statement. If they do, then he'll have them return to the jury room to complete the verdict form.

Holmes is convicted of conspiracy & three counts of defrauding investors - the Devos family's firm, a hedge fund manager & an ex-BigLaw partner. But cleared her on charges she defrauded patients. A sentencing hearing hasn't yet been set.
The judge finds a mistrial on the three wire fraud counts related to investors Black Diamond exec Chris Lucas, Hall Group exec Bryan Tolbert & former money manager Alan Eisenman. Schenk says he'll tell the court next week about what the DOJ wants to do (i.e. retry those counts).
No sentencing hearing date has been set yet. For those unfamiliar with criminal procedure, it'll be at least a month or 2 before that hearing & the parties file all their briefs.

*Ramesh “Sunny” Balwani (53/now 56) (CFO & President of Theranos) – Status hearing on 1/12/22, pretrial conference hearing (Motion in Limine) on 1/14/22 & status conference hearing on 1/25/22. Trial was set to begin on 1/11/22 with jury selection & trial on 1/18/22 have been cancelled.

I also believed the child was for the sake of the trial. It’s kinda funsies that strategy didn’t work out.

Most of her jury was men? It must come as a shock to her that men convicted her.

maybe the mom thing worked in her favor for the counts where blood was drawn? As in, “a mom would never not care for helpless beings that she would seriously compromise their health?”

Fascinating. The woman is frightening and monstrous, even to those panelists. "She gets on my last nerve", one said one in the beginning. Narcissist with psychopathic traits.
I wouldn't be able to spend one minute with her before shivering and needing to get away. She's false, wears a mask, manipulative, a total con artist.

She conned some powerful men like Kissinger for example!!

While I am glad she was at least found guilty on some counts, IMO this jury let us all down. I sadly believe she will get a slap on the wrist and move on to her next con. She has learned nothing from this. As always though, I hope I am wrong.

While I am glad she was at least found guilty on some counts, IMO this jury let us all down. I sadly believe she will get a slap on the wrist and move on to her next con. She has learned nothing from this. As always though, I hope I am wrong.
IMO there’ll be another trial on more (and the remaining) charges. EH’s best bet would be to plead guilty on those charges instead of going to trial? Otherwise, she runs a huge risk of getting her sentence increased without being able to have a say in the length. She no longer has a “get out of jail free” card : she can plead for a potentially shorter sentence or risk getting the book thrown at her after another trial.

IMO she’ll go down the path of insisting she’s not guilty. Now that she’s been found not guilty on some charges, she’ll take courage in that. The lawyers will extend their gravy train.

Does anyone know if the prosecution can simply find 5 more damaged patients and file new charges? They have a pool of, like, a million, and the original charges are attached to specific individuals, not a global charge.

I agree.

The real, key issues here are also about how she deceived and devised to defraud and manipulate the US Government's regulatory agencies, CMS in coming up with schemes to avoid compliance with laboratory practice laws, medical device laws, and Medicare fraud in pushing her employees to promote and misguide a fraud scheme.

Her massive deflection of her own guilt onto her laboratory medical directors and medical scientists is a huge crime that will not likely get the punishment it so clearly deserves.

Could they do federal charges with other victims? They associated one count with one victim the first time around. They could potentially just get a whole 'nother batch?

This has been a long chapter of my life. I am happy that justice has been served and that this saga is finally in my rearview mirror. Proud of the impact that Erika and I had. Hope to inspire other young professionals to hold their leaders accountable.
