Knowing what I do about her- I would not put it past her to 'disappear' during a swim and leave everyone and everything behind to escape serving her time. (And I do not mean unaliving herself- I mean absconding.)

This is interesting.

Elizabeth Daoust, Holmes’s aunt, who invested in Theranos, suggested that too many fraudsters were spared jail. “Penalties for white-collar crime seem too often to be slaps on the wrist,” Daoust wrote. “People/companies perpetuating financial fraud often get light, if any, sentences in a minimum security prison and keep most of the stolen money.”

Would he be on the hook for that?
She isn't married to Billy Evans, and no Evans folks were involved with Theranos, so I wouldn't think so. In addition, the Evans family lawyers would certainly have made sure the Evans money is shielded from any possible exposure.

I stand corrected! So much that is written refers to Billy Evans as her partner, I assumed they weren't. But yes, they've been married since 2019.

It was “secret”, though, so I’m leaving my mind open for the possibility that she’s not in fact married.

Agreed. Plus, there is a difference between having a wedding ceremony and being legally married.

MOO: I have a feeling they may have held the secret wedding ceremony for their own peace of mind while passing on the legal marriage license/certificate for his family’s peace of mind.

I recently read how in Asia, if you appeal your sentence, the appellate court has the power to increase or reduce it and doesn't hesitate to do so. Here, they can only uphold or throw out the sentence. IMO, giving the appellate courts the power to increase sentences would cut down on frivolous appeals such as this.

Weren't there people who design the machines that currently test blood and laboratory professionals not affiliated with Theranos who knew that the Edison concept was a physical impossibility? Were their voices drowned out by Holmes' celebrity status? Or threats of legal action by Theranos?

Just thought of this: Did Tyler Shultz get his job at Theranos because his grandfather was on the board?

I need to read the Bad Blood book by John Carryou again!

But yes, I do think that Elizabeth Holmes and her children will flee the US to a non extradition country before she steps foot in prison or pays one penny of the fines assessed against her.

Everyone was threatened with legal action (at least per non-compete clause), and EH was vigorous on getting her attorneys aggressively going after former employees. How EH got Boies to go after Schultz's nephew (including ambushing him in his grandfather's house) was just typical. Carryrou goes into the cloak and dagger sneaking around it took to get info from whistleblowers. It seems, everyone was terrified.
One of the lab professionals involved committed suicide. She stole his patents, too. Yep, the Bad Blood book will describe all of it.

Theranos founder Elizabeth Holmes has appealed her felony-fraud conviction — claiming up to 10 reasons she should be granted a new trial — and is asking the court to grant her freedom until her appeal is done.
Holmes’ filing cited purported errors by [the judge] as grounds for appeal, including his allowing the jury to hear about regulatory action against Theranos, and about the company’s voiding of all test results from its “Edison” machines. Holmes’ filing argues that those events took place after she made any “relevant” statements to investors.

To your point, yes, Theranos was brutally effective at silencing dissenting voices within the company.

However, there were entities making immense investments, like CVS and others, who utterly failed due diligence re: blood testing technology. Blood testing is a huge industry and its technology sector knew for a fact some tests can't be done with a drop of blood; it isn't viable then, now and not in the future.

Worth a read from WebMD: Moving Past Theranos: What is Possible with Blood Analysis (2021)

"What came as a shock for Silicon Valley and the investment world was no surprise to those in the blood testing industry."

This article notes that there are numerous small devices that can deliver accurate results for various tests in a matter of minutes. But no device can do all 200 tests (as claimed by Theranos) with one drop of blood.

"About half of blood is made up of red and white blood cells, while the other half is liquid. Most diagnostic tests use the liquid portion, meaning that only half of a standard sample is usually used for testing. You can also use blood from a finger prick, also known as a capillary sample, for testing, but it can be more difficult. These samples -- a few drops of blood -- are 30 to 100 times smaller than your standard blood draw. Unlike blood taken directly from a vein, capillary blood is mixed with liquid from tissues, which can contribute to an inaccurate result."

Federal prosecutors will fight Theranos founder Elizabeth Holmes’ bid to stay out of prison while she appeals her conviction for felony fraud.
Holmes, pregnant and the mother of a young son, was given a reprieve after being sentenced in November in U.S. District Court in San Jose to more than 11 years in prison. In handing down her sentence, Judge Edward Davila deferred the start of Holmes’ incarceration until April 27 in a decision legal experts believe was intended to allow her to give birth before she’s locked up.



Just looked on the court site & she is no longer has a court hearing on 1/23/23.... do not know "what" happened there!

I recall it was a misc motion hearing so no big deal. I'll try to take a peak at the docket unless it's sealed.
