Grandiosity, braggadocio, and flimsy promises are the hallmarks of many start up companies in Silicon Valley. And many of them fail, and there is no crime in that, her defense is correct. However, when you start out right lying to investors, doctoring reports, covering up negative lab results, and in danger in peoples lives with results that you know to be false, that's where this crosses the line into fraud and crime. I hope the prosecution will make this very clear. And also that she was clearly in charge. She sure was "girl boss" when it suited her, and now she's a shrinking violet in an abusive relationship? Give me a break.

Halloween costume ideas for 2021. I really want to do it.

Years ago, my friend and I dressed up like "Monica Lewinsky", blue dress- stain and all. Giant cigars. It was hilariously funny.

I think that if EH had a brain cell, she would dress in some outfit from Target, or stay super low key, white shirt, black pants. If she strolls into the courtroom each day, wearing $50,000 in clothes, shoes, jewelry...it won't go well for her.

Another keypoint that people like Phyllis Gardner have been making is that “fake it ‘til you make it” has little real world impact if in tech niches like gaming, but you don’t mess with people’s health. Lives are at stake. And Theranos was a medical company; that was its raison d’être.

If she goes on the stand, she’ll by mistake lose her act.

I hope she does! And I hope they have the opportunity to point her act out.

IIRC there’s a lot the prosecution can’t present as far as EH’s luxury expenditures (e.g. her armored car and body guards? Chartered flights?), but they raised money issues with the first witness. It’s going to look like EH’s expenses were way out of line with the company’s finances.

@brm1960 I neglected to mention the icing on the cake for your Halloween getup. You need a retinue (clatch? flock? battalion? Cadre?) of male body guards.

In Carreyrou’s new Bad Blood Podcast, Episode 3, he goes through the memos between Bulwani and Holmes. Bulwani kept trying to rein her in: she was clearly the one instigating the fraud in the most reckless ways.

In an emergency Zoom hearing late Thursday, U.S. District Court Judge Edward Davila told attorneys for Holmes and the government that he had received an email from juror #9 on Thursday indicating he may have been exposed over the holiday weekend but was not experiencing symptoms.

“It’s a little, I don’t want to say ominous, but it’s of concern that before we finish the first witness we have an issue,” Davila said. “For our sake, around the county there are still high numbers and we hope everybody continues to be safe.”

Trial is taking a break in US v. Elizabeth Holmes, but the judge set a last min hearing today. Judge Davila says Juror No 9 says he may have been exposed to COVID and is waiting for lab results. The judge is delaying trial "out of an abundance of caution."

Judge Davila canceled tomorrow's trial day and --assuming the juror's COVID-19 test comes back negative over the weekend -- we'll be back in court Tuesday morning.

Here's my story of the court's COVID situation. I've lost count of how many times this trial has been delayed due to the virus. Safe to say it's not the first time and probably won't be the last. IMO the judge is being very focused despite the COVID surprises.
