I don't like how this is going. Seems there is someone ornery on the jury.
#KellenWinslow - Reviewing what the jury has asked for: Note #3 - "The Jurors could benefit from an explanation as to what being under oath means. Additionally, how we should follow the law and not what we think the law should mean."
OH OH. That^^^ sounds like they have a hung jury. They have at least one juror that doesn't want to 'follow the law' and doesn't understand what 'under oath' means?
I agree and could say more but will leave it at that. jmoI agree with your conclusion. Yes, I invested several days in a jury room with several people who think sexual assault doesn't exist.
Jurors in the Kellen Winslow II rape trial had just finished having some previous testimony read back to them Friday afternoon when the foreperson slipped a hand-written note to the bailiff on the way out of the courtroom.
It contained two unusual requests that drew a seemingly incredulous reaction from Judge Blaine K. Bowman.
“The jurors could benefit from an explanation as to what being under oath means,” the first part of the note said. Underneath was a second request that read, “Additionally, how we should follow the law and not what we think the law means.”
Kellen Winslow II trial: Jury sends bizarre note to judge during deliberations
“The jurors could benefit from an explanation as to what being under oath means,” the first part of the note said. Underneath was a second request that read, “Additionally, how we should follow the law and not what we think the law means.”
It sounds to me like 11 of the jurors are in agreement. And one of them is following their own interpretation of the law, and it is frustrating the rest of them.
Three possible outcomes come to mind:
1. Miraculously, they convince the outlier to come onboard. [ unlikely, imo]
2. They come to the judge and say they cannot come to agreement, and a mistrial is called. [ I hope not]
3. My hope is that the judge talks to the lone juror, and if the judge decides that this juror is being irrational, uncooperative, and out of order, he can replace the juror and they can start deliberations over.
Aren't those counts all misdemeanors.... oh nooo!Cathy Russon @cathyrusson
#KellenWinslow - The only Jane Doe that has four charges is Jane Doe #5 - The 77-year-old woman that says Winslow masturbated next to her in a jacuzzi at a gym. Could that be the 4 out of the 12?
