You know, the fact that they have admitted to guilt is in itself a form of justice for little Gabriel. Add to that the agreement to waive any form of appeal, they will be locked up a very long time. There will be many supporters present for Gabriel in the courtroom for sentencing on 10/30/14 from what I am hearing. There has also been a letter writing campaign to the court as well on Gabriel's behalf. Life in prison without the possibility of parole, in general population. I hope the rest of Gabriel's family are at peace with it all. Prayers for his siblings, this has been so hard on them. They testified in front of the grand jury from what I've heard and I'm glad they won't have to get up in court in front of these two monsters and testify there as well. RIP brave little man. May you rest in the arms of angels.

A man accused in the beating and torture death of 8-year-old Gabriel Fernandez has decided not to take a plea deal to murder charges, according to sources close to the case.

Isauro Aguirre has not agreed to the deal that calls for life in prison without the possibility of parole and no appeals, the sources told NBC4 Thursday. The plan was for Aguirre and his ex-girlfriend, Pearl Fernandez, Gabriel's mother, to plead guilty to first degree murder and torture charges with special circumstances, sources close to the case said last week.

The defendants have until a Dec. 3 court hearing to accept the deal or not and go to trial on murder charges. The plea deal was officially submitted in court on Thursday.

Despite earlier reports by KNBC that Isauro Aguirre and his ex-girlfriend Pearl Fernandez would accept the plea deal to avoid the death penalty, if found guilty, KNBC now reports that at least Aguirre may not take the deal. A public information officer from the Los Angeles County District Attorney's office, which has not confirmed the reports, told The

Advocate that Fernandez and Aguirre were scheduled to appear in court October 30, but their "court appearance was continued to December 3."

Each must decide whether to take the deal by the December 3 court hearing to avoid a trial on murder charges in the case of Fernandez's son Gabriel. If Aguirre and Fernandez take the deal, they would face life in prison without the possibility of parole or appeals.

Still no resolution in the case. Trial continued until February 11th. I'll post when I get the details. There will be justice Gabriel!

LOS ANGELES (KABC) -- A possible plea deal for a Palmdale couple who allegedly tortured and beat the woman's 8-year-old son has been delayed again

Fernandez shouted at Aguirre, seemingly upset that her former boyfriend agreed to continue with the court case instead of agreeing to a plea deal with prosecutors.

The two are charged with the capital murder of Fernandez's son, Gabriel Fernandez. If convicted, they could face the death penalty.

Gabriel's cousin Emily Carranza attended Wednesday's hearing and called the situation "frustrating."
"This should be honestly an open and shut case. All the evidence is there," Carranza said.

Aguirre's public defenders want more time to prepare for the case. When Fernandez was asked if she agreed to a continuance in the case, she did not reply.

Despite her silence, the case was continued until Feb. 11.

I agree. It's been such a horrendous wait! I can't even begin to imagine what this is like for the family members.

Pearl Sinthia Fernandez and her former boyfriend Isauro Aguirre are accused of torturing and abusing Gabriel for months before his death in May 2013 while under the supervision of the Los Angeles County child welfare system.

The Judge said both Pearl Fernandez and Isauro Aguirre will be tried together and all evidence will be used against them The trial has been continued until February. It was hoped that they would enter a guilty plea so that Gabriel's siblings wouldn't have to go through the emotional trauma of testifying again and there's also concern that they could use the court appeals system to drag the case out.

The next court date for Gabriel's murderers is Wed. 2/11/15. The defendants have yet to enter a plea. I'm hoping that a plea will be entered on wed. and that we can move ahead to trial. It's been such a long wait for justice.

LaborDayRN, what do you think the pleas will be? I am with you, hoping they will be entered tomorrow. Can they each make separate pleas? one guilty and one innocent? This whole trying them together thing is not something I have seen happen in cases I have followed so I am curious how that all works.

I don't have any links to provide, but it is my understanding that Pearl and Isauro were set to accept a plea deal (life in prison instead of the DA seeking the death penalty) at the last hearing, but Isauro backed out at the last minute. Locally there has been ZERO updates regarding what to expect tomorrow. I'm trying to not to get my hopes up because I've been disappointed numerous times already. I do hope with all my heart that these two will accept life in prison and save the rest of the children (Gabriel's sibling) from testifying. There has already been so much heart ache for these young ones.

As for entering separate pleas, I'm not sure. I guess this is when we need Gitana! :) I imagine the defendants would prefer to be tried separately as I'm sure they would each LOVE to put all the blame on the other.

Again, no link. I'll find one and post but according to Gabriel's Justice facebook page, Isauro is still refusing to take a plea deal. New court date will be April 21st.
