GUILTY CA - Gabriel Fernandez, 8, tortured to death, Palmdale, 22 May 2013

I know it's a hard thread to read theirmommy, but I feel like I need to keep updating for Gabriel. The thought of his sweet face stays with me. Thanks for posting, it gets kind of lonely in here.

You're doing a wonderful job!!

After Caylee, I had a hard time coming back to these discussions.

Then I was actively involved in Trayvon's case... and again... it made it hard to come back. I always read though... always.

Not one of our little ones here on Websleuth's doesn't get read by me. It's hard. Really hard, but I read them all. It's just some cases are harder to process and that is why I am so happy we have this forum where, when one of us is down, someone else is here to pick up the pieces. For our little ones.

And for that, I thank you!

Such a sweet face. And the monster man in the house makes me sick (they both do). He is so big in stature and lil Gabriel was so small. Poor thing. One thing that brings a small amount of satisfaction is the egg donor looked like she enjoyed doing her hair and wearing make-up... trying to look cute. Well, she isn't so cute anymore.

Thanks LolaMoon. I can honestly understand people staying away from some of these horrible threads. I have to do it myself. Gabriel just stopped me in my tracks and I feel the need to post updates for him. Hopefully the new year will finally bring the trial and justice we've been waiting for.

Los Angeles County Superior Court Judge James Chalfant ordered the county to reinstate the compensation for Gregory Merritt as he awaits a hearing, scheduled for May, to decide whether he will permanently regain his $107,000 job, according to DCFS spokesman Armand Montiel. In the meantime, he will work from home with still-to-be-determined responsibilities.

Relative of Gabriel Fernandez Speaks Out Following Reinstatement of DCFS Supervisor

“It’s a slap in the face not only to us fighting for justice, it’s also a slap to the children that are currently in foster or abusive homes,” Carranza said. “If [Merritt] made a decision to close Gabriel’s case, without proper investigation into allegations of child abuse on Gabriel Fernandez, if he can close a case like that who’s to say that another child can be overlooked.

“Everything is ‘under the cover’ with the county,” she said “It’s a close-knit group and they will protect each other. Why do they have to put him back working with children? Why put people under him [if] he’s not even gonna read their notes or what kind of findings they find on allegations they go out to investigate?”

Supervisor Michael Antoniovich has instructed the Los Angeles County Counsel to determine if there are any additional options to continue fighting the ruling by the judge and the commission.

An LA County Department of Children and Family Services supervisor who was fired in the wake of the torture death of 8-year-old Gabriel Fernandez will be reinstated, a judge ruled Tuesday.
Gregory Merritt, a DCFS supervisor, decided to close the Fernandez case after he was reunited with his mother, along with social worker Patricia Clement. Four people involved in the handling of the little boy’s case were fired after his May 2013 death.

The outcome of a separate trial to reverse the commission's ruling could ultimately impact Merritt’s long-term employment position, but Judge James Chalfant ruled Tuesday that in the meantime, he should be reinstated.

Thank you, LaborDayRN, for keeping the thread updated for Gabriel :heartbeat:

You're welcome! Gabriel didn't get the the love and protection from his parents that he deserved in life, I'm hoping he can at least get justice now and rest peacefully.

There will be another pretrial hearing on Feb. 10th. It feels like this trial will never start...................

According to the Gabriel's Justice Facebook page, the prosecution say's there are no offers on the table. Court was delayed for an hour because Pearl refused to leave her cell. Court will reconvene on May 24th, 2015. That's 3 years since their arrest and still no trial. :(

Ironically, May 24th is the day Gabriel died in 2013 :rose:

Charges against the four social workers are detailed in an arrest warrant complaint filed March 28 against Stefanie Rodriguez, Patricia Clement, and their respective supervisors, Kevin Bom and Gregory Merritt. Each defendant is charged with one felony count of child abuse and one felony count of falsifying public records, according to a statement from the Los http://www.nbclosangeles.com/news/l...-Social-Workers-Charged-374903631.htmlAngeles County District Attorney's office.

"Social workers play a vital role in society," said District Attorney Jackie Lacey. "We entrust them to protect our children from harm. When their negligence is so great as to become criminal, young lives are put at risk."

The social workers displayed "willful disregard" for Gabriel's well-being, according to the district attorney's statement.

Rodriguez and Clement allegedly falsified reports that documented signs of the escalating physical abuse to the little boy, as well as the family’s lapsed participation in the department's efforts to help the family, according the release.

Bom and Merritt knew -- or they should have known -- that they approved falsified reports which conflicted with evidence of Gabriel’s deteriorating physical condition, as documented in the child’s case file, prosecutors said.

"We believe these social workers were criminally negligent and performed their legal duties with willful disregard for Gabriel's well-being," Lacey said. "They should be held responsible for their actions."

Rodriguez, Clement, Bom and Merritt are scheduled to be arraigned Thursday. Each faces up to 10 years in state prison if convicted on the charged.
