“It’s been three long years,” Gabriel’s cousin, Emily Carranza, said. “May 24th will be the third anniversary of Gabriel’s death. And I want these four social workers to be an example to all other social workers out there that are not taking their job seriously, saving the children and doing their job, that if they continue to neglect their work, that they also will be prosecuted as well.”

Amanda Nevarez, a family friend and co-founder of Gabriel’s Justice, said the social workers handling the case felt “they were above the law somehow and untouchable.” “You’re not above the law,” she said. “Just because you’re a county worker, just because you’re in a union doesn’t mean you can deliberately not do your job and cause harm, especially the kind of harm that was caused to Gabriel.”

The Department of Children and Family Services opened a case file on him on October 31, 2012, more than six months before he died. In bringing charges, District Attorney Jackie Lacey said it was the social workers' responsibility to protect him.
Instead, prosecutors say, Rodriguez and Clement falsified reports that should have documented signs that Gabriel was suffering from escalating physical abuse and that his family had stopped participating in efforts to keep the family together. They say Bom and Merritt, as supervisors, knew or should have known those reports were false.

Los Angeles County Superior Court Judge James Chalfant ordered the county to reinstate the compensation for Gregory Merritt as he awaits a hearing, scheduled for May, to decide whether he will permanently regain his $107,000 job, according to DCFS spokesman Armand Montiel. In the meantime, he will work from home with still-to-be-determined responsibilities.
