A Jan. 17 trial date was set Thursday for a Palmdale couple charged with capital murder in the beating death of the woman’s 8-year- old son.
Pearl Sinthia Fernandez, 32, and Isauro Aguirre, 36, were indicted in July 2014 on a murder charge with the special circumstance allegation of torture in the May 2013 death of her son, Gabriel Fernandez.
The prosecution announced last summer that the death penalty would be sought against Fernandez and Aguirre, who were initially charged in May 2013.
Los Angeles Superior Court Judge George G. Lomeli noted that Fernandez’s attorneys had asked that the trial be postponed to April, but said he was “not inclined” to grant a continuance.
“Three years is ample time to work on this,” Lomeli told the attorneys, noting that they will still have several more months to prepare for the trial.
Prosecutors from the Los Angeles County District Attorney’s Office asked a judge this month to order the Sheriff’s Department to turn over volumes of documents related to the investigation of a child abuse murder of a boy in Palmdale — after Sheriff’s officials ignored a subpoena and refused to provide the records, according to a filing in L.A. Superior Court obtained by KFI NEWS.
The D.A.’s office and the Sheriff’s Department most always cooperate in criminal investigations — and detectives from the Sheriff’s Homicide Bureau are in fact the very investigators who assembled the torture and murder case pending against the mother of 8-year-old Gabriel Fernandez and her boyfriend.
But Sheriff’s officials — citing California’s extraordinary privacy laws for police disciplinary records — have refused to provide them.
This sickens me to an extent I can't even communicate. Our world is lost. This child lived in hell. Literal hell.

I'm so torn up, I can't even comment on this case.
And THAT is the saddest part of this all... I read this and say to myself at least he's at peace now... In thinking this, I'm pretty much relieved that he's dead because humanity has failed him so miserably that death was his only saving grace....wtf... What kind of sick world are we in to be "relieved" to hear a child escaped this hell on earth through his death??!! Something in this picture doesn't fit. Relieved-child-death. I'm disgusted... This kid deserves more. This case should literally go down in history by making an example out of any and all knowledgeable parties that failed him. This could have and should have been stopped numerous times.I couldn't agree more howcome? Welcome to websleuths. We finally have a trial date set and while it won't bring Gabriel back, hopefully these murderers will pay for what they did and he can RIP.
And you are right. He should be remembered. These lights you speak of are blinding. There comes a time when ignorance I'd no longer an option and reality needs the spotlight.(((((mrsobrien)))))))) I try to keep the lights on in here. I know it's a difficult thread to read, but I feel Gabriel deserves to be remembered.

Unlike a buzzing bee or annoying kid at school, it's clear that ignoring this reality does NOT make it go away!
