I'm just in tears, after reading this thread. How can this happen? How???? Monsters walk among us. Everywhere.

I agree Renee. Such a tragedy and such a sweet little boy. I will never understand...........

Just a quick update:

Social Workers Arraignment court date: July 18th.

Court for Pearl & Isauro: July 28th. I'm not sure what matters will be on the table this day but hopefully we will get a trial date.

Finally! I hope this date sticks and doesn't get pushed back time and time again!

A Jan. 17 trial date was set Thursday for a Palmdale couple charged with capital murder in the beating death of the woman’s 8-year- old son.

Pearl Sinthia Fernandez, 32, and Isauro Aguirre, 36, were indicted in July 2014 on a murder charge with the special circumstance allegation of torture in the May 2013 death of her son, Gabriel Fernandez.

Prosecutors from the Los Angeles County District Attorney’s Office asked a judge this month to order the Sheriff’s Department to turn over volumes of documents related to the investigation of a child abuse murder of a boy in Palmdale — after Sheriff’s officials ignored a subpoena and refused to provide the records, according to a filing in L.A. Superior Court obtained by KFI NEWS.

The D.A.’s office and the Sheriff’s Department most always cooperate in criminal investigations — and detectives from the Sheriff’s Homicide Bureau are in fact the very investigators who assembled the torture and murder case pending against the mother of 8-year-old Gabriel Fernandez and her boyfriend.

But Sheriff’s officials — citing California’s extraordinary privacy laws for police disciplinary records — have refused to provide them.

Eventually Hatami obtained the IA file numbers, and in court documents, details several incidents that demonstrate the relevance and importance of the files — failures of authorities to act that may have allowed the boy to continue to be tortured and eventually murdered in 2013.

-- September, 2012 — two deputies sent to a custody dispute may have wrongfully given Fernandez’s mother custody of the boy, despite documents that said he should remain with his grandparents.

-- October, 2012 — no police report was taken after Fernandez’s first grade teacher reported to the Sheriff’s Department the boy had been hit by his mother with the metal part of a belt.

- February, 2013 — deputies waited until 2 a.m. to visit Fernandez’s home after teachers had discovered a suicide note and reported it to the Sheriff’s department in the afternoon. The deputies never demanded to see Fernandez or interview him, never filed a report, and took Fernandez’s mother’s word the boy was fine.

-- Weeks before murder, 2013 — a deputy assigned to Fernandez’s elementary school was asked to check on the boy after he’d been absent from school for several weeks. The deputy was told by Fernandez’s mother Gabriel had moved to Texas, but no investigation or follow up was done.

“This was a lie. Gabriel was actually in Palmdale, being beaten and tortured and being concealed in the “chubby.” A week later, Gabriel was murdered,” Hatami wrote, adding the contents of the Sheriff’s interview with this deputy would be a key element of the murder case.

-- April, 2013 — a security guard says he was yelled at by a Palmdale Station Sheriff’s deputy when he called 9-1-1 to report he saw Gabriel was, “bruised all over his body, had black eyes, numerous injuries, and had burns all over his body,” Hatami wrote. “The security guard was actually screamed at by Deputy Soukop of the Palmdale Sheriff’s Station on the “911” call because she [deputy] said that a child being burned was not an emergency.”

Sometimes the information in this case is so horrible, but at the same time so unbelievable, I can't believe it happened? How could SO MANY different people fail one little boy crying out for help?

I couldn't agree more howcome? Welcome to websleuths. We finally have a trial date set and while it won't bring Gabriel back, hopefully these murderers will pay for what they did and he can RIP.

(((((mrsobrien)))))))) I try to keep the lights on in here. I know it's a difficult thread to read, but I feel Gabriel deserves to be remembered.

And THAT is the saddest part of this all... I read this and say to myself at least he's at peace now... In thinking this, I'm pretty much relieved that he's dead because humanity has failed him so miserably that death was his only saving grace....wtf... What kind of sick world are we in to be "relieved" to hear a child escaped this hell on earth through his death??!! Something in this picture doesn't fit. Relieved-child-death. I'm disgusted... This kid deserves more. This case should literally go down in history by making an example out of any and all knowledgeable parties that failed him. This could have and should have been stopped numerous times.
If these agencies are sooo over worked, then they should treat it as a state of emergency and ask anyone and everyone to help! These children are our future for heaven's sake! If they are being abused at home, and live to adult hood it only continues this cycle of horrible parenting because they know no better!
We need to get a clue. Animals at the zoo are better parents than some of us will ever be! Sad, sad, sad.

And you are right. He should be remembered. These lights you speak of are blinding. There comes a time when ignorance I'd no longer an option and reality needs the spotlight.
Unlike a buzzing bee or annoying kid at school, it's clear that ignoring this reality does NOT make it go away!

So the trial has AGAIN been postponed. The date is now clock
Wednesday, March 15, 2017.

Pearl's defense trying to prove that she's intellectually challenged. In the many, many interviews and evaluations Pearl has had in the last 3 years, no one has once mentioned the possibility of her being mentally challenged before AFAIK. IMO just more stall tactics. When will Gabriel get his story told??? When will he get justice? SMH
