The audio of the cross examination of Susan isn't posted that I can find. But I know it was done. Found some info in an article related to part of the cross examination. For example:

snip

Maline repeatedly asked Blake if she knew it was Kavanaugh and not Merritt who received money from a major project.

McStay family murders: Mother of Joseph McStay testifies in Charles Merritt trial
I wonder if someone could ask cathy or addi about that in l&c chat? Or on Twitter.. ...I don't do Twitter

Yep, you got that right. And 4 people deserve justice.
"And 4 people deserve justice"
The only way they'll receive justice is if the person that actually committed the crimes is convicted. Tainted evidence only assures justice being denied.

And yet DK wasn’t the one cashing forged checks or ringing up Quick books trying to cover his tracks was he?

And Joey forgave DK ( which personally I don’t understand) but he did seemingly.
Did or did not DK threaten JM?

And Joey forgave DK ( which personally I don’t understand) but he did seemingly.

This whole angle of DK is such red herring! DK was a guy who fought with Joey over the website. It's such a common thing, this adversarial relationship between optimizer and client. DK seems to be rash at times, hence the "threat". However, I think even Joey didn't take it seriously -literally- since he "forgave" him. He just decided to get more control over his business and to buy DK out as a way of doing that.

The only things I can find that would have pointed to DK as a suspect were that "fight", and now there's a girlfriend who says he confessed. Yet, Joey still did work -for a long time- with him after the "fight", and there are girlfriends all over the place who have complaints about DK. Apparently, he wasn't very a very good boyfriend. In this context, the "confession" seems highly suspect.

CM is the only one for whom there is a long and connected narrative of history, relationship, disparaging comments, lies and changing of stories, omissions, pings, forged checks, DNA, bodies buried in his own stomping grounds, trucks on video looking an awful lot like his own, etc., etc., etc.

All of these things fit with Chase, not DK. Chase was known to have the physical fitness, the familiarity with the high desert, history of digging in the high desert, and with proven lack of major boundaries -a criminal. And, despite being a "very-involved father", apparently was terrible at supporting them, being there for them (how are you there for your family when in prison) etc. He smears his dead "best friend's" wife in public. An all around lousy guy.

The only thing I can say about DK is that he can be assured that, despite being the constant target of smears by the defense team, at least he doesn't have to worry about being convicted of murdering the McStay family.

Also Michael I think the McStays bought their fab new house around Nov 09, whilst CM’s income reduced, his bank account was in dire straights and eventually closed.

JM at this time was giving more work and money to MSM then sent CM that email saying he owed 42k. That surely could have been the catalyst for theft, fraud and then eventually murder? JMO.
Yes and IDIOT CM could've done the SAME EXACT thing, bought a foreclosure (or two) for pennies on the dollar, fixed it up, sold it, rented it out, etc. I still can't get over, someone making $173,000 a yr., couldn't even pay his RENT on time and had a ZERO balance in his checking acct. But then, if he followed what JM was doing, he couldn't be the KEWL guy at the casino's, in his stupid cowboy hat, with a handful of cards and all those pretty ladies making eyes at him, like he was such a big shot.

My comment was a reply to this comment "Agree. Some seem to support a Police State with no defense for the accused."
Are you directing your reply towards the correct comment? If so, then please explain what the particulars of this case have to do with a police state?

No, I was responding just to what you wrote.

What police state? The police enforce laws in every state as they are supposed to do.

They turnover what has been discovered during their investigation, and it's the prosecutor's responsibility to decide if the evidence supports an indictment.

So I'm not understanding what a police state has to do with the overwhelming amount of evidence the state has entered against this defendant?

Who believes the defendant is not afforded a defense??? Of course he is, that's why CM has a DT who is death penalty qualified representing him so that is totally contrary to what a police state represents.

Did or did not DK threaten JM?

All I know is Joey continued to work with DK months after the fact so whatever was said Joey didn’t hold a grudge and maintained a working relationship with him.

@Mica Susan was definitely cross examined. If you go to the first trial thread, it's linked in the very first post, reporters were there and tweeting. I haven't read all if them but there is mention of bounced cheques. It bounced from the Chase bank.....I was wondering who had an account there, the defense has subpoenaed those records I believe.

I've transcribed a few portions of the Judge's response to the defense's motion to dismiss:

RSBM

Tortoise you are THE BEST!! Thank you for doing this!

Thank you, missy, for checking it out! I know I heard about a bounced check but so far unable to find a video or testimony to support it!

I don't think Joey was the type of person to hold grudges against anyone.

If anyone held abnormal grudges it was CM.

If you followed the post you can see what is being discussed.

I thought I was following it. Sorry if I made the wrong inference.

The post was saying that Chase didn't have any way to buy supplies anymore because his account were closed and he had burned bridges with suppliers. So how is he going to get things needed to work on the projects?

I thought that was what the question was?

And the defense seems to be saying that Joey's answer to that dilemma was to give Chase 76 checks and tell him to sign Joey's name when necessary.

The police state comment was initiated by InspectorGadget, replying to smr. I was addressing the ideology and dissemination of a police state as exemplified by InspectorGadget. Perhaps I should have announced OT. Hopefully, this clarifies the confusion.

If Chase is being "framed" by the prosecution, heck, why don't they just fabricate witnesses that saw him doing all this? Maybe because they're using the circumstantial evidence that's there?

I'd really like to see anyone put DK (or his associates, what associates?) in Fallbrook, San Ysidro, the High Desert, and siphoning money between January 2010 and March of 2010. Show me some evidence.
His ex GF won't cut it, she has a habit of filing domestic abuse charges against BF's and was involved in prostitution (no doubt the pros will bring this up in cross). If I was a juror, I'd see it as her 5 minutes of fame and disregard her testimony. She's had plenty of time to acquire pertinent facts about this case. But some will believe witnesses that have a criminal past....
DK threatened JM about the website 1 year prior to the murders. In testimony, and CM's own words, JM had bought out DK and owed a couple thousand to him.
They were still doing business together. DK was roommates with JM for a time before Summer came into the picture. Dk was getting paid by JM to run the website. DK was the earliest person to say "where's JM"? and call PM. Yes, he's a cocky little dude, and his mouth shows little restraint, needless to say I've met many Web/IT people who think they're a bag of chips and all that.

But if you want to lay it in DK's lap.......SHOW ME THE PROOF.

It's interesting looking at the Saudi Arabia money.

Chase printed himself the following cheques for this job -

Feb 2nd - $2495 - memo line: deposit sa 1001
Feb 5th - $2350 - memo line: lighting install sa (1001)
Feb 8th - $6500 - memo line: saudi arabia final

So that totals $11,345

This job was listed on the email (not included in money payable to Chase yet).

It was also the job he was asking Susan Blake and Dan for money to complete and yet he had already advanced himself the above cheques and Susan testified he said he received $17,000 when it was completed.

JMO

I noticed the memo line kept changing on some of the checks CM was writing to himself. There was at least one that said copper. I'll have to go back and look for these. But did anyone else notice? TIA

MOO

I believe that was a cheque to MSM.

Anyone else see the irony in the defense pointing a finger at DK, who just happens to be the person CM said he would murder when asked by LE?

I don't think there is any other logical explanation for the checks other than CM knew the McStays were dead that fateful Thursday evening and he wasted no time helping himself to Joey's money. There is no way to get around it.
