#McStay- Judge says the state can show whatever records they want to show as an exhibit and highlight what they want to inside that exhibit. "The exhibit speaks for itself".

They are going through the autopsies, started with Joe Jr. and moving on to Gianni...

Not typing out details, sorry.

Minimum number of blows to Giannis head=6

  • #448
Taking lunch a bit early, prosecutor needs to get exhibits together. Recessed until 1:30.

I know it's only 11 minutes early, but geesh!!!!

Christ Gianna had a minimum of 6 blows to the skull.

This points to a lot of rage to do that to a 4 year old boy. It’s complete over kill and points to it being personal to me.

I hate the time that is wasted but I can understand why they have taken a break due to the subject matter. It’s really heavy going to hear that a 3 year and 4 year have been senselessly bludgeoned to death. It makes sense to give them a chance to regroup.

It’s absolutely sickening to hear anybody could do that too defenseless children who have no way of fighting back and in such a barbaric way.

I would be ok with that, but she said she needed to get exhibits together. IMO they should have been more prepared. They should be using every minute they can to get this trial moving. As a juror, I am not sure I would appreciate it, but again, JMO. Who needs an hour and 45 minutes for a lunch break???

#McStay - Jurors were shown bank records Dan Kavanaugh's account. It showed an overdrawn balance of $-40.14, a deposit of $6,250, a transfer of $700 to unknown party and $5000 to what prosecutors say was Charles Merritt. However, jurors just shown the records w/no testimony

Going back to the financials and Geis construction...

I am not sure what this shows? I think I know what the prosecution was trying to show, but not sure it worked.

What I was left with is, there is a $6250 payment that was made to someone, no one knows who, the defense implies it was DK because of the bottom of the invoice saying make payable to DK. What they did show was a wire transfer from the 19th, but this was the 1st 6250 payment, not the 2nd. Where is the 2nd payment?

All of this was after the McStay's were gone... I want to know more about before, I guess I want to know the motive, I want to see the numbers and want to see their proof that he was scamming Joey. Not that I really doubt it, but I want to see it! JMO

I did try to get a screenshot of CM's bank statement, but when zooming in it goes blurry :( Will have to wait until later when it's added to youtube.

Morning Break....

Okay, so what I got from that testimony is this...

on 2/2/10 an estimate was sent to Geis construction, requesting that 50% of the balance is to be paid first, which was $6250.

On 2/19/10 Geis Construction paid $6250 to EIP

Somewhere along the way, the balance was paid, $6250. No one can say where it was paid to? But the defense implies it was sent to DK.

In May...
$2000 payment made to CJ, as per CM's request
$1950 payment to Walker Sheetmetal as per CM's request

and later in May or June
$4000 payment to CM

The judge asks the witness about payments, this is what he says:

6250 deposit to EIP
2000 payment to CJ
4000 payment to CM
1950 payment to Walker sheetmetal

The defense then asks again if his understanding was that the full $12500 was paid before the cheques to CJ/CM/Walker. He says yes, doesn't know where that second $6250 went though.

Okie dokie then LOL
I found these two reports claiming CM, was ripping people off through his waterfall business way back in 2005 and 2006.

I know about his past. What I want to see is what he did before the family was murdered. And I guess the days immediately after, everything we have heard about for years now.

Showing this transaction with Geis Construction, did nothing for me, but it's JMO

Here is my breakdown of it. The McStay's go missing, Dan and Chase and I guess Mike and Susan are trying to run the business and get things done, in hopes that the family is coming back. So DK gets a 6250 payment from Geis. He wire transfers Chase $5000.

Later, CM requests more funds from Geis to get the fountain shipped, $2000 and then again for $4000, and I guess the $1950 for Walkers Sheetmetal. Geis says they had already paid for the fountains in full before the mentioned payments.

Where did that $6250 go? Who got it? or was it actually not paid? I cannot believe that the prosecution didn't show it went to Chase if it did indeed go to Chase.

ETA: Unless I missed something with the first witness????
