But not all felonies are strike offences. I think the confusion is because if someone had 2 strikes already, ANY felony was a 3rd strike (included things like shop lifting), that law has since been changed. But the first 2 strikes still had to be serious and violent. IMO his charges did not meet that criteria according to the Penal code.




From what I have read, first degree burglary and second degree burglary is different. Chase was charged with second degree burglary. He was also charged with grand theft, but only grand theft with a firearm is a strike offense.

In 2001, the Riverside County resident and father pleaded no contest to second-degree burglary and grand theft after authorities accused him of stealing from a San Gabriel Valley ironworks company.

I'm willing to change my mind and open to the possibility, but I need to see it lol I don't see it with what I have read so far...

That sounds like he pled out to lesser charges, not the actual charges. With his criminal record, he wouldn't chance taking that to trial. I found it pretty difficult trying to find original charges in the California justice system.

No it just says Merritt's truck underneath it.

I went back to Smith's testimony about the truck, when asking about how they determined if this was the same truck as Merritt's... he said they found a home video at the McStay residence with it in it.

Surely they verified the back of the truck was either the same or different than it was in 2010, right? lol If not, and it changed between Feb 2010 and 2014, and they are insisting that it is his truck because of the lights matching in the video, that may not be good... With those lights up so high how did it light up the taillight (the invisible one that I can't see haha)

When SB found it, the guy that had it in 2014, bought it from Ritchie Brothers Auction in 2011.

Could be Bernina, but what he was ultimately convicted of still wasn't a strike offense. Doing reading, lawyers suggest to fight any and all charges and try to get them reduced, especially because of the 3 strike law..... they probably don't mind getting paid to do that either LOL

So here's the 5 million dollar question:

What vehicle was JM driving to the Chick-fi-la? (sp? never been to one)

Summer's vehicle was the Dodge Ram, it would have had the car seats in them. Most people with children prefer driving a larger, albeit, safer vehicle. Several witnesses on the stand have said it was the vehicle she used. If she was running around buying stuff from Craigslist and/or Ross, wouldn't she have been driving it?

If JM was driving the Trooper, CM would have had to put the seats in the Trooper to make it look like the family had split together....................

Did CM kill JM some time around the restaurant date, stash JM's body (he did have several places to do that within a short distance), create a scenario where he shows up at the house "Joey's in trouble, we have to go" or just incapacitate the 3, stuff them in his service truck and grab car seats to put in the Trooper that was secreted in the general area of JM's body..............?

Maybe repossessed? So Ritchie Brothers had it in 2011 and Rising Sun Industries in 2014. Somebody other than CM could have modified the truck. This could be traced.

Nine years ago on this very day...

I clearly remember watching the news and seeing the smiling faces of The McStay Family - Missing the headline stated. Finally they were found. All four. Together. In the desert.

The time has come. The perpetrator MUST be held accountable.

Holding the McStay Family members UP. Sending positive thoughts their way.

This is why our justice system is flawed, and potentially dangerous criminals plead out to lesser sentences and get out and do far more damage. If CM had been convicted and done the entire length of his previous sentences, this wouldn't have happened to this family. How many times had he been violated and only got a slap on the wrist?
I believe we've seen this many times before in other cases.

Somebody was questioning a storage unit that Joey and Chase might have shared that LE could find no evidence of. The warrant was for Storage Etc. - Formally AMS Storage in Pomona.

This is a perfect example of the ineptitude of the prosecution. The storage unit might possibly be where Joey was killed...struck by Chase's truck causing the leg injury, then dragged into and bludgeoned in the unit. At least that's one possibility. By saying that they could find no evidence of it, after issuing a search warrant is absurd. The defense wouldn't correct that statement because they would prefer links to Chase to be non-existent.

41:57... there is objections, sustained... but he does say that they had some information from interviews about the storage shed, but not able to verify it. He says they didn't find a unit number or anything like that.

Missed that. That's what happens when I listen while doing something else lol. So if they didn't find this storage unit, where does this computer come from. Totally confused. And how is it they didn't keep records of past renters? Did they purge them when the new owners took over?

The computer tower was from the Storage company, the business, not property of Chase's or Joey's or anyone involved in the case, is what I understand Force Ten :)

Brake lights are lower, IMO. And it looks to me to be a different unit completely - much smaller rear opening. Do the prosecutors know this?

I don't know if definitively that can be concluded as Chase's truck (in the lower picture). I saw it and initially thought the same thing, that it was modified. With contractors - Chase worked around many - these trucks are very common. This particular truck could be one of the Sequieda's or another contractor. Too bad the license plate isn't clearer. This also seems be a bit smaller truck, maybe a 1500. This is the only picture of a utility truck in the videos. I've combed them all. But I will try and get a better pic of that truck.

Some companies will send off their records to places like Iron Mountain to be destroyed after so many years. My wife had a small business for 5 or so years and we still have 10-15 boxes of invoices and records, so I can imagine what a place like that would collect.

It was impounded for some reason. Maybe because of expired tags and he was driving under a suspended license? That's what he was pulled over for in VV in 2011.

It had a different license plate when they went looking for it in 2014, it that's what you mean? It was because it was licensed by a new owner, nothing suspicious about it. IMO I just heard that in Smith's testimony when listening to see if they checked to see if there were any modifications to the truck.

Yes, different number altogether. They had to ID it by the VIN.
