So this means he has no alibi for the grave pings.

How much more obvious does this need to be?

#McStay - Merritt: IF I went there it would be to my sister's. Investigator: It doesn't show you there. On Feb 4 it shows you were in Fallbrook and now Feb 6 at grave site. NOTE: Before the recording started the judge told the jury police can say untrue things in interviews

Because Joey was working out an arrangement whereby Chase would be able to write checks for himself and Metro. This would free Joey up, as their business was growing. Joey could always put a stop payment or challenge a check if Chase did write an unauthorized check.

It actually seems like a solution to the problem of Chase and Summer not getting along. And according to the defense Joey was changing over from an on-line program to desktop only, so I believe he was training Chase while the on-line program was still in effect.

I think the defense's version of this makes much more sense than the DA's. Especially given the amounts of the checks written.

Do you really believe this? That Joey actually told Summer about this? IMO, Summer didn't need this. She didn't like Chase. Got bad vibes about him, especially when he injected himself into their family life, like 24/7 in their final days. He skeeved her out.
Joseph, IMO, didn't need to free himself up. It was his business and it was on the verge of being grown. Not there yet. On the cusp of these huge orders hopefully happening.

It makes him look like he has a strong motive for murder. And the check created on the 4th, AT JOEY"S HOME makes Chase look like the killer, in my opinion. I think the jury might think so too.
When you’re a person of interest in a murder case like DK was and then to lie about your whereabouts is about as suspicious as it gets.

#McStay - Investigators asking Merritt where he was on Feb 6, 2010. This is the date prosecutors say Merritt was near the burial site. Phone records show pings from cell tower near site.

#McStay - Investigator: Where would your phone show you were on Feb 6?
Merritt keeps saying he doesn't know.
Investigator: Why would your phone records show you were at the grave site on Feb 6? Merritt denies being near there that day.

#McStay - They tell Merritt his vehicle is seen at the McStay house the evening of the 4th. And now his phone shows he was at the burial site on the 6th. Merritt continues to deny.

Just like prosecutors can say untrue things in open statements.

#McStay - Raja Maline cross examining Det. Bachman about the interview. When asked if it was factual what was said to Merritt that the GPS records show he was at the grave location site, Bachman says yes. Maline brings up previous testimony that it's not true.

#McStay - Maline: You believe that gave the location of the cell phone?
Bachman: Yes
Maline: The phone and not the tower?
Bachman: I'm not an expert.

#McStay - Maline: On Feb 4 you believe that Merritt turned off his phone so he wouldn't be located killing the family?
Bachman: Yes
Maline: But on Feb 6 he leaves his phone on while he's burying the bodies?

Cathy Russon‏ @cathyrusson 6m6 minutes ago
#McStay - Maline: You told him that he was in Fallbrook on the 4th, didn't you? Objection Maline: At least a dozen time you told him he was in Fallbrook on the 4th Bachman: Based on our investigation we believed he was there on the 4th

Cathy Russon‏ @cathyrusson 5m5 minutes ago
#McStay - Maline: No matter how much pressure you put on him Mr. Merritt was steadfast that he wasn't there.
Objection. Overruled

#McStay - Bachman: I wouldn't say he was steadfast but he said he wasn't there. Maline: And no matter how much pressure you put on him saying that he was at the grave sites on Feb 6, Mr. Merritt was steadfast he wasn't there
Bachman: He said he wasn't there.

Ocean, interesting how different things are in different places! I can't believe the jurors were allowed to take their notes home with them. In my experience, jurors were allowed to take notes during deliberation, but the notepads and pencils were provided by the court and these were confiscated each time we left the room, even for lunch. At the end of the trial, they were again confiscated, and we were told they would be destroyed. (Not that I believe that! I have no reason not to, but no reason to believe it, either.)

I'm also amazed that some states allow photos of the victims. NY doesn't allow any photo of the victim except those submitted as evidence, and then only in an evidence capacity. In my case, we never saw his face, or presented in any humane way -simply the backside of him, lying dead, covered in vomit. It's so biased. There the defendant sits, day after day, dressed in his best, "humanizing himself" before the jury, while the victim is a faceless, body-less entity. Often a mere concept.

Yes, I agree, it's certainly interesting how it varies state by state.

Here a photo of the victim alive, and vibrant is usually the first thing the jury sees during the prosecutor's OS, and the last thing they see in their closing.

Of course we had to leave our notebooks locked up each day we left. It was only after it was over with we were allowed to take them home.

I had no problem listening intently to all of the testimony, and taking detail notes. I always had to multitask during my career anyway.

Iirc, it was either OJs trial or maybe Scott Peterson's trial where some of the jurors used their notes to write books afterwards.

So I guess this jury will also be allowed to keep theirs since it's also in CA.

I still have all of my notebooks stored away somewhere in a storage container. Our kids use to like to read them.Lol

Imo

I saw him quite often...

I wasn't even in my right mind when I was talking to the officer...

Does the prosecution even talk to their witnesses before they put them on the stand? LOL
