As I recall, McGyver originally had said that he saw Susan cleaning the paint tray and was surprised that there was no foil lining the paint tray as he had previously advised Summer to do so for easier cleanup. The discrepancy could be attributed to erroneous recording, or misunderstanding re: Susan cleaning and his noticing the paint tray. But what is weird to me is that originally the whole point was that there was no foil lining in the paint tray, alluding to the possibility that someone other than Summer had used the paint tray. Now we hear that he actually saw the paint tray and it WAS lined with foil, with dried paint inside it. Which I don't see as alarming at all, she had two small kids and could have been distracted and forgot to clean up the foil. So I don't know what to make of this. Would Chase have bothered to line the tray with foil?

No, I don't think Chase would have bothered to line it with foil. I also don't think he would leave the tray and roller there. He couldn't do everything with gloves on and I think he would have just taken and disposed of the tray. JMO

I think that is where the pro's were going with that as well... that he painted. I don't think this testimony worked out as well as they planned in regards to the paint tray. BUT McGyver is a good witness, he's likeable :)

Another note about the paint tray... Summer said she hated cleaning up after... I also hate cleaning up after painting... if my husband heard this testimony, he would laugh and say it doesn't mean anything because I always leave my paint trays and rollers out to dry up haha He refuses to spend a lot of money on rollers/brushes now for me... and we use plastic liners in the paint trays for easy clean up ;-)

Well, if Dan's Hawaii alibi is solid, then Dan and the prosecution have nothing to worry about. Which leads me to believe that it isn't, because why would the defense be beating this drum so hard, only to be proven wrong with a solid alibi and end up looking like complete fools?

Depends on the paint, depends on whether windows are open or not. In this case, even if they did smell paint, Summer was literally painting up until the day they disappeared, so I'm not sure it would help. I don't recall anyone saying they could smell fresh paint though?

I was really expecting them to say that Merritt painted after, but now I'm not so sure they can prove that or can even imply it. McGyver didn't seem to note anything off in regards to the paint in the house, the color, or paint missing, etc. So, if CM didn't paint afterwards, where were they killed? I just can't imagine no blood spatter anywhere. JMO

They didn't specifically ask him that (not that I heard anyway), but he is still on cross.

We are still on break... all these breaks, and we wonder why it's going to be so long :(

You need to prove murder , theft doesn’t automatically = murder unfortunately.

The prosecution actually needs only to prove the identity of the killer in this case, as it is not seriously contested that the family of 4 were murdered

Given no one knew they had been murdered on the 4th and weeks and months that followed, circumstantial evidence that

1. Suggests CM had foreknowledge that J. McStay had disappeared
2. Places him at their house on the day of their disappearance

= strong evidence of guilt

We all have. This is the only cam too as far as I know, so we are stuck with it.

My notes from the prosecutor's opening speech, of the times when CM's phone was not connected to any towers.

4th Feb 5:48 pm to 9:32 pm (3.75 hours)
4th Feb reconnects at 9:32 pm then goes off again until 5th Feb 7:30 am (10 hours)
5th Feb 3:54 pm to 9:17 pm (5.5 hours)
8th Feb 7:26 am to 1:31 pm (6 hours)
I'm not clear on the times but his phone also went dark from 3ish on the afternoon of the 6th until about 10:30 the following morning. Approximately 20 hours, per prelim testimony. More than enough time to be under the radar cleaning and painting in Fallbrook.
