SAN DIEGO — The second week of the preliminary hearing for Larry Millete, who is accused of murdering his wife May “Maya” Millete, is underway Tuesday.

Larry is accused of murdering Maya, who was last seen on Jan. 7, 2021 near her home in the 2400 block of Paseo Los Gatos in Chula Vista. Two days later, her sister reported Maya as missing.

The hearing began last Wednesday at the downtown San Diego courthouse and is expected to last several weeks, with over 20 witnesses expected to testify.

Courts were closed Monday in observance of Martin Luther King Jr. Day.

Several people gave testimony last week, including Maya’s siblings Maricris Drouaillet and Jay-R Tabalanza.

Tabalanza, Maya’s younger brother, also testified Larry had told him the same thing.

Tabalanza said he was one of the first people to go to Maya’s home in search of her. He said on Jan. 8, one day after Maya was last seen, he could not get ahold of his sister, so he went to their home in Chula Vista and found Larry upstairs and his nieces and nephews at the home.

The preliminary hearing is not a jury trial, but works as a mini-trial, without a jury, where counsel can call witnesses, display evidence and cross-examine witnesses.

At the end of the preliminary hearing, the judge can rule that there is enough evidence to believe Larry committed a crime and a trial will be scheduled, or, on the other hand, the judge can rule the evidence does not establish probable cause Larry committed a crime and the judge has the ability to dismiss charges.

In my own words-- This man, Blaine Hinckley, a plumber, is on the stand telling about the Jeep Meet Ups where he met Maya and her Family. The first meetup was on 12/12/20 where Maya first attended with her daughters. Then, another meetup on 12/26/20 where Maya and Larry attended with the children. He says Maya was enthusiastic about learning more about off-roading with the jeep. Said she showed love and wanting to share in fun with her daughters. Second meet up Larry didn't go in the Mud Caves and stayed in jeep with son. Mr. Hinckley is still on the stand, but finishing up.

All my own words here-- On the stand now is one of the first officers to go out to the home for the report of a missing person. Maya's sister was there and stressed her concern that the trip to Big Bear Mt. for daughter's birthday had not been cancelled, and Maya was missing. House looked in disarray and there were those suitcases by the stairs. However, no odor of cleaning products noticed he said. Testimony continues.

Dear Larry,

You are right. I am not myself anymore. I've turned into this bitter, angry person who is careless with her words. But that's what our marriage has turned me into, and I hate it. I hate that you get me so angry all the time and you speak so righteous while I speak so bitterly.

You want to keep trying too, but each time I'm outside the house and not within your view, we are fighting. It is unhealthy. It's toxic. We need to change, but with the kids in mind, I want to be happy, and happy is not with you. We cannot be doing the same thing expecting the same results.

I've been gone mentally and emotionally for a very long time, which you failed to notice until I found the strength to initiate physically leaving.

I read this and I thought maybe you consider it.

I wanted to add the rest of the article. It's not known if Maya ever gave the note to Larry, but... MOO, he was so up in her business that nothing got past him, so he probably did see the note.


The document in this case is a handwritten note from May to Larry, possibly never delivered, since it was found inside a notebook in the couple's master bedroom.

In retrospect, the "letter" offers a glimpse of what a sister of May's, Maricris Drouaillet, testified during the pretrial hearing was an increasingly rocky relationship, conjuring up an image of what could be interpreted as a controlling spouse.
It seems clear that by the time of its writing, May, who at one point quotes author Marianne Williamson, has moved on from the marriage, at least mentally. BBM

Taking notes in my own words-- Larry's attorney managed to ask a question to emphasize that Maya's sister initially thought maybe Maya went on a long hike because she did that sometimes and would get out of the house and be gone taking time for herself for a whole day. (MOO, his attorney likes to point out things so similar to what Larry would use to cast guilt on Maya. Just saying.)

Larry's attorney also asked about a statement to Officer Ryan Culver from Maya's sister about an affair six months ago that caused trouble.

Moo, I like the Judge curtailing Larry's Defense Attorney from overdoing it on the tedious, and sometimes silly, questions of witnesses.

Larry would call her and it sounds as though he expected a report. He'd ask if Maya got home, if she was wearing her wedding ring, etc.,

Once, Maya was out of town for important work Audits, and Larry called her so often she couldn't get any rest for the coming stringent work audits.

Interesting details and facts are coming out in this Hearing. MOO, I feel confident that the Hearing will establish substantial Probable Cause and will result in the Judge concluding Larry is to go on trial for the murder of his wife Maya. What does Everyone here think so far?

I really, really hope so. To me there is a lot of circumstantial evidence that he is responsible for her death. I don’t see any way that the judge won’t see that he was extremely controlling and abusive towards Maya.

I feel like Larry will stand trial but Im not sure from there, the evidence looks on the weaker side. No blood, no body, no confession, no murder weapon, no witness of a physical struggle, no forensic evidence of a struggle. I think the case strength is about Barry Morphew, Donthe Lucas level, I think if Larry has the right lawyers they can pose problems for the prosecution. I think Donthe Lucas lawyers were a lot worse than Barry Morphew, Barry's attorney Iris Eyton fought the case like a barracuda and got key peices of the case thrown out. Donthe Lucas public defenders didnt really put up much arguments other than to say the case was weak, which it was. I think the case is definitely a step towards more aggressively prosecuting no body cases, I dont think this case would have been charged 20-40 years ago.

LIVE BLOG - PART 2, PM

4:30 p.m.: The judge dismissed Tabalanza for the evening. Court will resume at 9 a.m. Wednesday, Jan. 18.

4:15 p.m.: Tabalanza said her communication with Larry increased during that time and Larry expressed to her that he was suspecting that Maya was having an affair. She said he never asked her if Maya was having an affair and he told her he was afraid that Maya was going to leave him.

The prosecutor presented a text message between Larry and Tabalanza where Larry asked her to help him with Maya and their marriage.

4:00 p.m.: Genesis Nicholas-Tabalanza from the Department of Defense U.S. Navy was called to the stand. Tabalanza said she works at the home of the San Diego Naval Information Warfare Center.

Tabalanza said she met Maya in 2004 and they were really good friends and Maya practically became a big sister to her. Tabalanza said even though they had a close relationship, Maya liked to keep things professional. Tabalanza temporarily lived with Maya and Larry for about three months in 2016.

Tabalanza said she first learned Maya and Larry were having issues in their marriage when Maya asked Tabalanza if she could live with them. Tabalanza said the word "separate" surprised her in regards to her and Larry. Maya then stayed with Tabalanza and her husband in February 2020 and left in June 2020.


3:54 p.m.: The prosecutor presented the bodycam transcript between Culver and Maya's sister, and Culver said Drouaillet indicated that she last spoke to her sister on Jan. 8.

Culver said from his understanding, the family was supposed to take a trip to Big Bear Mountain starting Jan. 8 and there was no indication of when they were coming back.

The defense rested and Culver was excused from the stand.


3:32 p.m.: Culver said Wilkening told him that it had been days since Maya spoke with them in their group chat. Wilkening also said another friend of theirs offered Maya a place to stay but no one had heard from her since.

When asked if he noticed any repairs in Maya and Larry's bedroom, Culver said he was not aware of any. Culver recalled speaking with Courtney Cobb, a friend of Maya's, who told him that Maya told the group that she and Larry had gotten into a big argument and she was planning to file for a divorce.

3:19 p.m.: Court resumes after a brief recess.

When the defense asked if Culver made a correction to the police report, Culver said the incorrect portion was that Maya never canceled the Big Bear trip.

Culver said he did not get a chance to see every single room of the house because his partner Officer Lopez and him divided the responsibility from the portions of the house that he did specifically observe. He was satisfied that there did not appear to be any sign of struggle or violence.

Culver said officers often have to ask for permission to enter homes but Larry was welcoming and invited them inside.


3 p.m.: The judge called for a 15-minute recess.


2:57 p.m.: Culver said he was made to believe the children in the home were sleeping so he did not speak with them.

Culver said Ms. Wilkening expressed concern for Maya's safety, specifically because she knew Maya and Larry had a number of marital difficulties over the years. Specifically, she told Culver that Maya and Larry had been in a number of altercations and that she was not sure if they ever got physically violent.

Culver said Wilkening specifically recounted an incident in that Maya was so fearful for her safety that she locked herself in a bathroom. But Larry allegedly punched through the drywall that was next to the bathroom door to unlock it from the inside so that he could approach Maya.


2:46 p.m.: Culver said while he and other officers checked the home, every makeup cabinet and all of the toiletries along with the clothing areas of the bedroom. All appear to be full and nothing looks like anyone grabbed any large quantities of clothing or supplies. He also said there were suitcases packed at the bottom of the stairs and the entire house was in a disarray.

Culver said Officer Walsh conveyed to him that Larry showed her his cell phone specifically to show that Maya did not reach out to him or contact him. But the entire history of their conversation only went back a day or two prior to that.


2:37 p.m.: Officer Ryan Culver with the Chula Vista Police Department was called to the stand. Culver said he is assigned to the traffic division as a DUI enforcement officer and collision investigator.

On Jan. 9 to 10, Culver said he was working as a patrol officer and he was assigned to the Chula Vista Police Department patrol division. Culver said assigned to assist one of the officers with a missing person investigation at a home in Paseo Los Gatos.

Culver said he arrived at the Milletes' home with two other officers and spoke with Larry, who invited them into the home. Culver said Larry was extremely cooperative with officers.


2:28 p.m.: In the cross-examination, Martinez asked Hinckley if there were requirements and if it offered insurance coverage, Hinckley said it is just a social group with jeeps and there's no insurance and it's not an organized official group.
Hinckley said the most he observed about Larry during the second trip was that Larry was not sitting in the front seat, and he did not enter the mud cave with them. As far as Maya and Larry's interaction that day, Hinckley said they both seem engaged.

The defense rested and Hinckley was excused from the stand.

2:20 p.m.: Hinckley said when they were in the mud caves, just excited as her kids were just engaged, playful, curious, adventurous, and laughing. He also said he hardly had any interaction with Larry aside from an introduction.

Hinckley said after the run on Dec. 26, Maya and the rest of the group made plans to do more explorations and camping in early 2021. Hinckley said when he mentioned visiting Laguna with his kids because it was snowing, Maya said she was envious of those who were able to go and she would not be able to because she had to work.


2:10 p.m.: On another trip to a Jeep run in Sin Nombre Canyon on Dec. 26, Hinckley recalled Maya bringing her entire family, including Larry and their son.

Hinckley said he orchestrated this trip and they all met at Golden Acorn Casino & Travel Center in Campo before going to mud caves. The prosecutor then showed Hinckley a group photo where he had to identify each individual.


2:05 p.m.: When shown exhibits by the prosecutor, Hinckley said he potentially recalled taking photos of Maya and one of her daughters. And when shown a string of private messages, Kevin, who was the leader of the run, made a joke by saying, "May (Maya), I think there's room for improvement on your technique."

Hinckley said he chimed in saying "oh but my you captured the best essence of life. Unfiltered fun and love. Your daughters are having pure fun with you."


2 p.m.: Hinckley said he met Maya at the run with her two daughters and she was excited because of her new Jeep Rubicon. He said she was a ball of energy and so were her daughters. The mother and her daughters appeared to be having fun and plenty of pictures were taken.

Hinckley said Maya was considered a "beginner" during the run and she seem more interested in learning more about them.

1:50 p.m.: Tabalanza was excused from the stand and Blaine Hinckley, a plumber who met Maya through an off-roading group on Facebook, was called to the stand.

Hinckley said he first physically met Maya around December 12, 2020, during a "run" or trail in the desert, far east in the Ocotillo desert area. He explained this run involves Jeeps and they would just ride the trails for a period of time.

1:44 p.m.: When asked if he returned to Larry and Maya's home to ask if Larry was responsible for his daughter's disappearance, Tabalanza said he simply just asked him where his daughter was and they did not see each other anymore after that.


1:39 p.m.: After returning from recess, Tabalanza said Larry showed him a handgun with the nickname "Black." He said after seeing the gun, he didn't assume Larry would use the gun to hurt anyone—yet.

12 p.m.: Judge dismisses court for lunch break. Hearing to continue at 1:30 p.m., with Maya Millete's father resuming his testimony at 2 p.m.

Plead not guilty. Held without bond. Denied bail (11/4/21). Found mentally competent to stand trial (9/26/22).
*Larry Millete (39/now 41) regarding gun violence restraining order on possession of guns (1/7/21) <<temporary GVRO in place against Millete was dissolved 12/1/21. Plead not guilty.

Watching the hearing, and as I understand it, and MOO--

Larry's defense attorney is questioning Maya's sister-in-law Genesis (Nicolas-Tabalanza). Larry started relying heavily on her to give him marriage advice. (JMO, I believe he tried to use her to pump her for info on Maya. ) Larry was the one that told Genesis that in February 2020 about an investigation into Maya possibly having an affair with someone at work, but they did not know if true. MOO, Genesis seems uncomfortable with Larry's constant texting and putting her in this meddling position. Sister-in-law was in an awkward position between the two marriage partners, and urged Larry to talk to their Pastor. Attorney trying to make a issue out of them taking Maya in that May/June 2020. Genesis says Maya wasn't thinking of divorcing Larry then, but just needed to hold her head and think.

Judge says to Larry's attorney, "I want you to wrap it up." Attorney has been asking, IMO, these really nit-picky questions to the sister-in-law that keeps saying she didn't want to ask deep questions to Larry and Maya about their relationship. However, Larry's attorney is seemingly, again MOO, brow beating sister-in-law about the details of the private details of an intimate marriage. Attorney just won't quit though. At one point, Genesis tries again to explain she has her own problems in life, and that she would never recommend things for the couple but referred them to the Pastor of their church.

Eventually, Maya does decide and tell her sister-in-law she was going to file for a divorce. Tells Genesis to not answer Larry's phone calls anymore. Thanks to Attorney confirming and repeating that Maya told Genesis "If something happens to me it will be Larry."

Her sister in law just got choked up on the stand during cross and told the defense attorney "I feel like you're torturing me"

Questioning of Genesis continues even though Judge said he wanted the attorney to wrap it up. Larry's attorney is touching upon the the Spell Caster Larry was using and asking questions. Larry told his sister-in-law, Genesis, "it's only White Magic". Then, explained to her about the "subliminal White Noise". MOO, all this questioning from Larry's own defense attorney is putting emphasis on Larry's precarious mental state, and Maya's fear of what Larry might do if she tried to leave the marriage. :( Heartbreaking what Maya went through. Now on a short break.

Maya's former boss is answering the Prosecutor's questions. MOO, this testimony is about Maya's professional great job performance, and Larry's outrageously contacting her boss on several occasions. A woman had been calling around work and making accusations of an affair? What woman? Then, Larry starts asking men coworkers of Maya to be moved to another division.

I can't even take notes on this witness because the info shared about Larry's behavior is hard to report objectively.

It came out that Larry threatened to ruin May's career and reputation. She was so worried and afraid of this threat that she had to tell her boss of the threat. Oh no, here comes Larry's defense attorney with her questions.

2:53 p.m.: Eric Sopps is called to the stand. Sopps was Maya's supervisor at NASCI.

2:56 p.m.: Bowels asks Sopps if he had met Larry. Sopps said yes in February 2020.

Bowels asks Sopps what the circumstances of that meeting were. Sopps said Larry had come to pick up May (Maya) for lunch. They had had an incident of a woman calling around accusing May of having an affair with a subordinate because of those calls. They had a meeting in his office to clear it up.

Bowels asked if it did. Sopp said yes.

2:58 p.m.: Bowels asked if Sopps had received any emails from Larry and what did say. Sopps said yes, he had received an email from Larry a few weeks later asking any of the other supporting employees out of the division into another.

Bowels asked if that was unusual. Sopps said yes. He has never had an employee's significant other reach out for anything.

Bowels asked if there were more emails. Sopps said yes. Bowels asked Sopp to read the email in which Larry asked Sopp to move Eric Coogan to another division to help Maya refocus on their relationship.​
