It makes sense to me that they would want to try the case in California.

Melodee and her Mom and most of the witnesses are from Cali. Melodee was born, went to school and grew up in Cali. AB planned the murder while she was in Cali. Rented the car, probably acquired the gun, made the travel plans, while in Cali.

The investigators would need to base their investigation in Calki and not in Utah. IMO
I’m fine with a California investigation, but I sure would like to see an Utah punishment in this case.

While many community members are mourning, Garcia also shared that some are taking advantage of the national attention. Melodee’s aunt told him there have been numerous fake GoFundMe pages, none of which are run by the family.

“They are fraudulent GoFundMe accounts to try and capitalize on the child’s death, and that, to me, is just outlandish that anybody would do that,” he said.

The family told Garcia that, for now, they are only taking donations directly.

MOO since I’ve never worked on the government side, but jurisdiction is going to be a largely political decision. Who wants it, who has the money for it, who would be most efficient, etc. Assuming the threshold legal jurisdiction requirement is met, which it likely will be for California, Utah, and federal jurisdiction.

The most fascinating example of this I’ve seen was a robbery of a patron eating on the patio at a restaurant in Beverly Hills, during which a gun was discharged and another patron was hit by the bullet ricocheting (fortunately a relatively minor injury). At the time this happened, the Los Angeles DA was known for “catch and release” type policies for crimes, while Beverly Hills had/has a more tough on crime philosophy. The suspects ended up being charged federally!

As I recall, the use of a firearm provided a hook to fall under a federal law (or two) on the books so the Feds could assert federal charges, and it was no doubt a political decision to bypass the Los Angeles DA. So they were never actually charged with robbery (a state crime). I’m very curious as to the behind the scenes of how that was accomplished, but the reason for it was obvious — Beverly Hills wanted to make sure the suspects served jail time.

If you'd shown just a little bit of compassion, Melodee could have been spending Christmas with family members who clearly loved her. That's what she deserved.

Ugh, I'm usually pretty good at remaining impartial, but I'm finding the details in this case to be incredibly upsetting😭

Revenge is such a powerful emotional force.
I just think she hated other relatives so much, that her revenge took over her life, and took another life in the process.

According to the officials during the PC, they are going to put her on trial in Cali because she formed intent and premeditated the crime in California.
IMO she should be tried in Utah.
Emphasis mine.

I think under the definition of the law lying in wait could mean getting her daughter into a position of vulnerability where there was no escape (side of the road during a long multistate "fun" road trip for instance) concealing the true purpose of their being there and then ambushing said victim with fatal violence (the multiple gunshots)

In legal terms, "lying in wait" refers to a situation where an individual intentionally hides or waits for an opportunity to ambush their victim with the intention of causing death.

This premeditated action demonstrates a high level of malice and intent, which can significantly impact the severity of the charges and potential penalties in a murder case.

The term “concealment of purpose” is frequently used in lying in wait cases. As noted, prosecutors must prove different elements to convict someone of lying in wait murder.

One is that the defendant concealed their purpose, which can be proven by showing the perpetrator concealed their purpose of committing the murder and did so from the victim. Notably, a perpetrator can conceal their purpose even if the person killed was aware of their presence.

It may not have been intentional. Perhaps something rolled under the seat and she missed it when cleaning out the car after the rental.

A loaded round or empty case probably rolled away, perhaps ending up under the seat. At times, after firing a pistol, an empty case that has been ejected will end up caught in a fold of clothing or other surface, and end up being dropped or roll away. So, she probably left it in the car without realizing that it was there.
