That article posted in post #40 is kind of deceiptive - (sp?) - the trial is not postponed, but the pretrial hearing on 6/26 is moved to 8/16.

@Niner I just looked up the case. There is no trial date on the docket. The next hearing is a Preliminary Hearing on August 16, 2019 at 8:30 am in Department 9. Looks like this case has a long way to go before trial if they are still at the Preliminary Hearing stage.

*Preliminary Hearing (@ 8:30am PT) – CA – “NorCal Rapist” *Roy Charles Waller (58/31 @ time of first crime) arrested (9/20/18), charged & arraigned (9/24/18) on 12 counts of forcible sexual assault with enhancements (use of gun). Charges for the 10/13/06 assault on 2 women in North Natomas (Sacramento County). The new charges (1/7/19) include 9 counts encompassing a brutal attack against a Martinez woman in 1996. Total 45 counts filed. Plead not guilty to all counts. Held without bond.
Prosecutors allege Waller raped the woman four separate times during the attack in which he dressed in a skeleton mask to pretend to be a trick-or-treater. Waller is also charged with digitally penetrating the woman, 1 count of oral copulation & kidnapping her with the intent of robbery. The charges include enhancements, including the use of a firearm & binding the victim. (see below). Sacramento County Sup. Crt 18FE018342(02)
DNA entered into “genetic genealogy” GEDMatch. DNA from straw matched the rape of 2 women in North Natomas. 15 year spree since 1991 to 2006. Starting in Rohnert Park 1991, then to Sonoma, Davis (1997), Chico (July 1997, 21 yr old w/blood evidence), Woodland (1997), Martinez (Oct. 1996 Contra Costa DA filed charges under “John Doe” can be charged now), Vallejo & Sacramento. Six counties involved: Sonoma, Solano, Contra Costa, Yolo, Butte & Sacramento. All will probably consolidated & tried in Sacramento County. Faces life term in prison if convicted.

NorCal Rapist case delayed again over DNA evidence fight (with clip)

SEPTEMBER 12, 2019

"NorCal Rapist suspect Roy Charles Waller, who was scheduled to face a preliminary hearing next month over allegations that he assaulted nine women over a 15-year crime spree, has been postponed again.

Waller, 59, had been expected to face a preliminary hearing Oct. 2 in Sacramento Superior Court on 45 felony counts linked to the crime spree, which terrorized women from 1991 through 2006 in six Northern California counties: Sacramento, Butte, Contra Costa, Solano, Sonoma and Yolo.

But that hearing has been scrapped so that attorneys in the case can litigate over whether prosecutors have provided enough DNA evidence to the defense yet. That hearing is now set for Oct. 2.

“There are some issues with DNA material we have been seeking that haven’t been made available to us,” Waller attorney Joseph Farina said after a brief hearing Thursday. “It’s an issue of what we’re entitled to.”..."

Lawyers for accused serial rapist Roy Waller argued Wednesday in Sacramento Superior Court that they have received very little of the DNA evidence that led to the arrest of Waller last year, and that they have a right to know exactly how prosecutors pieced together the clues that led them to Waller....

Sacramento prosecutors added a new rape charge against the NorCal Rapist suspect Friday, bringing the total count of charges against him to 46, as a judge delayed a decision over whether defense lawyers should be able to obtain details of the secret DNA tracking process that led to his arrest a year ago.

The new charge stems from a 1997 attack on a Chico woman, a victim whose case already had been charged against Roy Charles Waller, who could face up to life in prison for a series of assaults on nine women from 1991 through 2006.

Much of Friday’s hearing before Sacramento Superior Court Judge Laurie Earl focused on a request from the defense that they be given access to details of the process investigators used to lead them to Waller.

Defense DNA counsel Erica Graves argued that Waller’s team needs to know how any genealogical sites used in the hunt handle their data, and that they need to know whose DNA was found in a site that was used to find Waller.

Prosecutors sharply objected to providing the information, saying the defense is entitled to the evidence that they used to arrest Waller: DNA they obtained from a soda straw while he was under surveillance, and DNA from a swab they took after his arrest that was matched to DNA left behind at crime scenes.
