Interesting. I wonder if the inmates have internet access or if emails are printed and given to them. I wonder if Potts has read this thread? Maybe I should email a link?
How embarrassing, that I know the answer to this question!
E-mails are printed, and then hand-delivered to the inmates. According to my friend, who I e-mailed (once!), inmates get these e-mails as soon as they are received (and carefully reviewed) by jail personnel. IIRC, I was allowed 140 characters (which number proved to be 130 more than I needed).
Inmates do not have internet access.

Hi all,
The time has finally come for this case to go to trial. We had a full day of motions for the Judge to rule on yesterday and it was exhausting to say the least. I did however leave at the end of the day knowing we have an incredibly strong case against Dennis. It was determined that Max could have his case severed so he will be tried after Dennis's trial is over. We were hoping for one trial but that is not to be so we will have to go through this process twice.

During the hearing yesterday the Judge did exclude some of the evidence per the defenses request but nothing that is of much significance to our case. We came out of there with some of our more important evidence allowed in for the jury to hear, which is good news for us.

Jury selection is to take place Monday August 17-18 and opening arguments should begin on
August 19th in Department 27 starting at 9 am Mon-Friday.
No one is allowed at the courthouse for jury selection but that is the only time we will be kept away from the process.

Seating is limited, no one can sit in the front row because that is reserved for the media. The second row will be taken up by my family for the most part which leaves 2 rows of 8 left for anyone else who wants to attend. Please keep in mind that for many of our witnesses their families will want to be in the courtroom to support their child and they will get first choice at remaining seats. People may not be able to stay the whole day so if some of you are in the hallway you will get your chance to come in as well. I don't think we will fill all the seats but this is just in case we do.

We are allowed to wear our buttons during the trial, and there will be ribbons handed out for those who don't have a button (this is for the jury to distinguish what side we are on in case we use up some of their side of the courtroom.)

Same rules apply now as they did during the preliminary hearing, such as NO talking in the courtroom, hallway, bathrooms about the case. Lets try not to use facial expressions (me mostly) and it is okay to cry but sobbing out loud will be frowned upon.

It was said over and over yesterday that this trial will be highly emotional for everyone in the courtroom and if it gets to be too much for any of you there is always the option to get up and leave the courtroom during that phase of the trial. It is EXTREMELY graphic.

As I am sure you all can understand I will not be emailing during the trial.

We would like to thank everyone for their continued support throughout this horrific time in our lives. If you pray; pray for justice for Tori and Dean.

Peace,
Dayna Herroz

I am praying for justice for Tori and Dean and strength for Dayna.

Does anyone know if this trial will be covered on the Internet or perhaps InSession?
I don't think it will Patty, at least Dayna didn't mention it to me this afternoon on the telephone.

Oh how I wish this trial would be on TV.
Do we know if any WS'rs will attend any or all of the trial?

I said a prayer this morning, and will each morning until this is over for strength for Dayna, family and friends, for justice, and that that 🤬🤬🤬 will be found guilty and bubba will take care of him in prison!

I'm glad the time is finally here. Feels like it has been forever of a wait. If I, a stranger, feel that way, I can only imagine how difficult this wait must have been for Dayna, family and friends.

Our prayers are with you today!

Prosecutor: Man killed son and baby’s mom to avoid child support

By Kelly Wheeler, City News Service

A Bonita man strangled the mother of his son and the 10-month-old baby to avoid paying child support, a prosecutor said today, but a defense attorney said the real killer was a hopeful suitor the woman rejected.

Dennis Potts, 25, surprised 22-year-old Tori Vienneau the night of July 26, 2006, knocking her unconscious between 6 and 6:45 p.m., then killed her after they had made plans to go out to dinner, prosecutor Per Hellstrom said in his opening statement.

A forensic examination of Potts' computer showed he had performed Internet searches on such topics as "getting out of child support," "paternity tests" and "getting away with murder" shortly before the killings.

SAN DIEGO COURTS —

A Bonita man rigged the result of a paternity test and performed Internet searches on how to get away with murder in the weeks before his baby and the baby's mother were found dead, a prosecutor said yesterday.

The attorney told a jury that this and other evidence will support the conclusion that Dennis Mickjale Potts committed murder in 2006.

Can we have part 1 moved two mods? Seems both threads should be in the same forum.

Defense attorney Kerry Armstrong, in his opening statement, said police focused on Potts from the beginning and ignored the real killer, a man named Daniel Moen.

<snip>

Four days before the murders, Moen and Vienneau had sex, but later Vienneau rejected him, Armstrong told the jury.

<snip>

BULL CHIT! I want to see 'proof' of this alleged sexual relationship between Tori and David, how convenient the 'defense' comes up with 4 days, a window that to my understanding would be out of the time range for dna evidence regarding this so called 'sexual' relationship. I don't buy it. I wonder if David is on the witness list.

Armstrong said Potts was scared and had a longtime girlfriend -- who is now his fiancee -- and needed time to figure out how to tell her and his parents about the child he would now be responsible for.

BS again! How many months and months did Dennis have to 'man up' and tell his parents and 'fiance' ( is this girl that dumb to still be with him?) . How hard it would have been to just man up about it, I guess when he is convicted "bubba" will be teaching him about manning up.
<snip>

Armstrong said Potts searched the Internet about death and murder because his father had suffered a couple of strokes in the past. Potts also had an interest in mixed martial arts, his attorney said.

So, are they saying DP would have tried killing his father? IS there medical proof his father EVER had any strokes?

Furthermore, Potts wrote a school paper on euthanasia that included those searches, according to his attorney.

And just when was this paper written? Was Dennis attending college at the time Tori and Dean were murdered? Was the instructor added to the witness list to verify this paper was actually written and turned in as a class assignment?

Potts' fingerprints were in the victim's apartment because he had been there at least three times in the past and remembered leaning against the door, Armstrong said.

IIRC, Tori had only recently moved into this apartment she shared with the roommates. IIRC from the earlier posts ( maybe last thread), it was one or two months at most and FWIC, Dennis was NEVER previously at this apartment.

Potts was at Corn's South Bay home working on a project for his father when Vienneau was killed, Armstrong said.
<snip>

An expert will testify that the "ping" off the cell tower near Vienneau's apartment could have come from a call that Potts' mother placed to him while he was at Corn's house at 6:44 the night of the murders, Armstrong said.

Um, and how is the defense going to then explain Dennis's father telling the news camera Dennis was 'right here at home' during the time Tori and Dean were murdered? Anyone recall that video clip from the news when Dennis's father slammed the door in their face? Whose lying? Dennis's dad? Dennis? Maxwell? Why would Dennis's mother be texting him if HE WAS AT HOME LIKE HIS DADDY SAID HE WAS? Conflicting evidence right there..... I hope the prosecution has that video of Dennis Potts father stating on the news Dennis was at home.

IMO, from this article alone, it sounds like the defense has a VERY WEAK defense and man oh man are they stretching it!

I hope there are more updates in the news before the trial ends. (and don't ask me what I would like to do to DP - I don't wish for a time out. )

I'd also like to add I am so sorry the defense has dragged DM into this. From what we know, he was a wonderful-platonic-friend to Tori, Dean, Dayna......

Our prayers are with you to David. Hang in there! This 🤬🤬🤬 will be found guilty soon! I have NO doubts about it!

Ditto that Cubby! I feel terrible that they dragged Daniel's name into this.

He and his mother are wonderful friends of Dayna's family, this is all so hard to hear.

I didn't realize this trial had finally started.

I do remember the interview with the dad where he slammed the door on the reporter's face. His wife was next to him but wouldn't show her face. She was telling the dad to close the door. I'm sure the pros has this......it would be strong evidence of his family lying for him.............which would not bode well for Potts....

This Corn guy will NOT make a very believeable witness if they expect to put him on the stand to verify the alleged alibi of Potts. I mean, he's already involved in the case by using his dna for the test.........the jury will NOT believe him, imho.

Key testimony given in mother-son murder
SDNN - San Diego,CA,USA

A man accused by a double murder defendant’s attorney of being the real killer of a mother and her 10-month-old baby testified today that he loved the child and helped take care of him after he was born.

Daniel Moen, taking the stand for the prosecution in the trial of Dennis Potts, testified that his life was changed when a friend called him the night of July 26, 2006, telling him that 22-year-old Tori Vienneau and her 10-month- old son, Dean Springstube, were found dead in a South San Diego apartment.

The friend who called initially told Moen that Vienneau killed the baby and then took her own life, Moen testified.

“That was the worst time,” he said. “It changed the rest of my life. It will haunt me forever.”

Witness denies killing mother, baby on stand
SDNN - San Diego,CA,USA

The night a young mother and her 10-month-old baby were found strangled in a South San Diego apartment was the “worst night of my life,” a friend of the woman testified today.

Daniel Moen — accused by the attorney for defendant Dennis Potts of being the real killer of 22-year-old Tori Vienneau and her 10-month-old son, Dean Springstube — testified that he didn’t believe it when a friend called him to say they were dead.

“(It was) the worst day of my life,” Moen told prosecutor Per Hellstrom. Moen, 24, said he went to police the night of the murders because “I wanted to assist them the best I could.”

His goal in speaking to detectives was “to put someone behind bars that did this,” he said. Asked point-blank by the prosecutor if he killed Vienneau and her baby, Moen said no. The witness testified on Monday that he loved the child and helped take care of him.
