I was a police officer for 29 years and have no objection to anyone looking at my personnel folder as regarding complaints, investigations, or instances that may be relevant to my employment. There may even be entries of a negative nature that I was not made aware of.

What is the governing law in NYS - Public Off Law 52? Yeah, that only works for THEM, not for YOU.

We had a retired SCPD LT as a witness. He retired with 30 years with Honor. They dredged up his IAB record going back 30 years. Some of the charges he honestly didn't remember. What is good for the GOOSE is not good for the GANDER.

The DA had one 🤬🤬🤬 LT that had received 18 complaints in less than 5 years in the PD. One complaint that was never made is when a judge threw out a burglary case because he believed the LT (then a PO) had tortured the man by knockiing out his teeth and suspending him by his arms rear cuffed. That fellow named Freeman would get 85K from Suffolk County. This BUM testified. Do you think his personnel record should have been available for a credibility issue.

Hawk, I found some case law to support your right to FOIL for a police officer's list of complaints.

Walker v. City of New York, 64 AD2d 980 (1978) --

Records of complaints and investigations of civil complaints against a particular police officer held to be available; records were relevant to the performance of duties and therefore disclosure would result in permissible as opposed to unwarranted invasion of personal privacy; in camera inspection resulted in a finding that the notes consisted of "factual data". Current Law: §§86(4), 87(2)(g), 89

And another...
People v. Pack, Criminal Court, New York Cty., NYLJ, April 27, 1978 --

Records of complaints and proceedings regarding particular police officer before Civilian Complaint Review Board held to be available. Original Law: § 87 (2) (a), § 86 (3), (4)

Guys,
All do respect....please take this off topic conversation to another thread. I have been fishing for the past 3 days and have 3 pages of replies to go through to get this stuff organized. You are only cluttering my radar and OUR cause. Anyone who wants to participate....GREAT! If you have some constructive criticism...even better. I do not want to sound like a jerk but this is going to be a decent amount of work on my end.
Lets do ths in steps.
1. Brainstorm Ideas and Paper/news organizations (Due byt Friday of this week)
2. Finalize participants (due Friday of this week)
3. draft letters (done by Oct 19th)
4. start sending them (should be done by Nov 3)
5. Resend all letters First week in December to drive the point home before Sg's body discovery anniversary.


I am willing to pay for anyone who is short on money and cannot afford the postage, paper, or stationary needed but wants to particpate. (this is on the honor system, please do not request a disbursement if you have 100k sitting in the bank or tell me that you are sending all of your letters via horsbeack messenger from Alaska)

Anyone who wants to do a foil request, please start another thread. Get mod approval, I do not want my battleship being sunk by the mods because we introduced new ideas after they approved this one....even though this campaign has nothing to do with websleuths.com

I am pretty sure no reputable media outlet will publish or even read unsigned letters. Most media outlets I have written to on other topics, require disclosure of name, address and contact numbers, and often prior to publishing will contact the sender to confirm validity.

Mysterymon7, this has been my experience. Check with the media outlets first.


Since Mr. Ray still represents SG's family, direct contact with him would be appropriate for his recommendations of the best approach.

Possibly he would be willing to contact the media outlets stating he has numerous voters and concerned citizens who have asked him to forward our concerns and are interested in this case being solved. We may have to disclose our identities to Mr. Ray, but he could keep them confidential.

Any of you guys who have contact with MG, would you mind asking her to let her attorney know that this is taking place? So he doesnt think so random wacko is calling his office.

MysterMom, I know you are only trying to help. And I will help with your project as well. Its just alot for me to filter through. Between running a business (30 employees....30 sets of problems), my fishing addiction, taking care of my wonderful girlfriend who puts up with all of my nonsense, trying to get to the gym 5 times a week, and trying to organize this.....its a bit much.

Everyone please check the list. Make sure everything is accurate (as far as participiants and ideas you may have submitted that I may have looked over). If I missed something, I appologize and just bring it to my attention and I will update accordingly.

Everyone have a good night...beautiful sleeping weather here on Long Island. About 70 degrees out and a nice cool breeze. Perfect for wrapping up in a blanket with a friend (man or woman depending of your lifestyle choices). Opeping up all the windows and having the coffee maker set for the morning.

Part of the reason why the 911 system works is that citizens are aware that their privacy will be protected when they report a crime or an emergency using the system. The government has an obligation to safeguard the integrity of that trust. 911 recordings are privileged and confidential. FOIL or no FOIL, the public does not have the right to receive copies of those recordings without the express permission of the people who made the calls or without a judge ordering the release.

Also, ME reports are medical records. The public does not have a right to view the medical records of complete strangers.

I know that some of you will try to debate this. All I can say is good luck with your FOIL requests. You will be waiting for about a year to learn that you are requesting information that is not within your right to obtain.

So....does this mean you are going to help write letters or not? If you are....welcome to the party. If not, there aremany other threads here on websleuths that might spark your curiosity.
