GUILTY Canada - Michael Gibbon, 60, fatally shot with arrow, Kitchener, 5 Oct 2015

  • #21
"He was actually heading home," she says, based on information she received about the arrow's trajectory.

So he was walking south on Margaret toward his street (Guelph). Since the arrow hit his chest, rather than his back, it is likely that the archer was to the south of where he was found, not at Breithaupt park....perhaps hidden in the spruce trees around the low rise multi-unit apartment building, across Union.

"This is the only comforting part for me: he went out and covered [Michael] with a blanket and held his hand and talked to him because my brother was still conscious at that point."

I do believe that LE has caught the right guy. I think I found his FB and one of the pictures shows he likes "Call of Duty - Black Ops" and when I went to look up that video game to see if any bows are used in the game I found this.

"The Crossbow is a special weapon that is featured in Call of Duty Black Ops"

So if this guy ends up being the culprit then I unfortunately think that this could be further indication that these violent video games may influence people to carry out crimes in the real world.

I bet the arrow came from a crossbow

Good sleuthing! Could you post a link to his FB, please? We're allowed, by Websleuths, to do that, as long as we don't post material from the FB page or quote it directly.

Thanks Forager.

Since I don't have 100 percent confirmation its his I can explain how I found what I am seeing.

The person's name that was arrested is from the news article link below:
"The man arrested has been identified as 29-year-old Eric Amaral from Kitchener."

And what you can do is put a period between his first and last name and then put that right after this.....

https://www.facebook.com/

.....And then just paste all that in the web address bar of your browser and hit enter.
Once there you should see like a profile cover photo page with a Bart Simpson picture and if you click on the Bart Simpson picture it allows you to scroll through about 5 pics. The 5th one is the Call of Duty Black Ops photo.

The picture with this article is on that Facebook profile too.

Kitchener man accused in pellet gun shooting appears in court

The man accused of firing a pellet gun at a Waterloo Regional Police officer made a court appearance Wednesday – the same day police confirmed that he is considered a person of interest in the region’s most recent homicide.
Eric Amaral, 29, appeared briefly before a judge and was remanded into custody until an Oct. 20 court appearance.
Wearing a grey jacket and blue jeans, he stood straight-faced in the prisoner’s box and looked out over the courtroom – not finding any familiar faces.

Interesting. Thanks for the update.

I wonder if LE was able to get a search warrant and found the weapon used. If it was a crossbow then he could have had similar arrows at his house. Or maybe he confessed.

Proving a certain bow shot a certain arrow is more difficult than like a gun with a bullet. But LE could determine his extra arrows came from the same manufacturer if he had extras at his house. Maybe prints on the arrow as well.

I'm a local and part of a local FB group. A lot of people that went to school with him are saying they are extremely shocked that he did this. I don't know him or any of his friends just thought I would share what was "said" hope it's allowed.
I hope the evidence is there and I hope Justice is swift and severe. Jmo

Preliminary hearing begins for Kitchener man charged with murder with an arrow

http://www.therecord.com/news-story/7069492-preliminary-hearing-begins-for-kitchener-man-charged-with-murder-with-an-arrow/

Eric Amaral, charged with murder after a man was struck and killed by an arrow, was in a Kitchener courtroom on Monday for the start of his preliminary hearing.

The Kitchener man is charged with first-degree murder in the Oct. 5, 2015, death of Michael Gibbon. The 60-year-old was out for a morning walk along Margaret Avenue in Kitchener when he was hit by an arrow.

Amaral also faces charges after a police officer was shot in the chin with a pellet gun during a traffic stop on Ottawa Street in Kitchener on Oct. 13, 2015.

The hearing, presided over by Justice Pamela Borghesan, will give lawyers the opportunity to question and cross-examine witnesses under oath and will determine if the prosecution's case is strong enough to go to trial.

If a trial is ordered, it probably will be held in the fall, Smart said outside the courtroom.

Man charged in Kitchener arrow killing to stand trial on first-degree murder charge

http://www.therecord.com/news-story/7142680-man-charged-in-kitchener-arrow-killing-to-stand-trial-on-first-degree-murder-charge/

Eric Amaral has been ordered to stand trial on a charge of first-degree murder for allegedly firing an arrow that killed a Kitchener man.

Justice Pamela Borghesan made the ruling earlier this month at the end of a three-week preliminary hearing. A trial date has not been set.

Amaral, 30, of Kitchener, is accused in the Oct. 5, 2015, death of Michael Gibbon. The 60-year-old was out for a morning walk along Margaret Avenue in Kitchener when he was struck by an arrow, police said at the time.

Eric Amaral pleads guilty in Kitchener crossbow shooting death of Michael Gibbon

Eric Amaral has pleaded guilty to second-degree murder in the 2015 crossbow shooting death of Michael Gibbon in Kitchener.

Court heard the macabre details of how Amaral was carrying his crossbow in a wooded part of Kitchener, saw a stranger out for his morning walk, then got down on one knee, took aim and shot the man in the "a random and unprovoked killing."

Amaral also pleaded guilty Thursday to shooting a police officer with a BB gun in a related incident.

Justice Gerald Taylor called the attack just before dawn "shocking" and said Amaral lacked "any reason for the taking of a human life."

"Eric Amaral was using Michael Gibbon for target practice," Taylor said.

Amaral was sentenced to life in prison with the chance of parole in 14 years for the death of Gibbon. He will also serve another two years for the shooting of the police officer concurrently.

Amaral addressed the court Thursday.

"I truly apologize for the death of Michael Gibbon. Nothing I could say can change the death of Michael Gibbon. I'm truly sorry for that."

'My brother never got a chance,' sister of crossbow shooting victim says

In her victim impact statement, Leinweber spoke directly to Amaral, who began to cry in the prisoner's box as the statement was read.

"You, Eric Amaral, accomplished your goal and my brother never got a chance," Leinweber wrote.

"I doubt that anyone who is capable of committing such a cold-blooded act of aggression towards another human being can possibly appreciate or understand the pain, the devastation or the absolute heartbreak that you have inflicted upon me and my family."

Leinweber said her brother was her best friend and someone she relied on for an honest opinion. He was a kind, considerate and loving brother and she is haunted by how afraid he must have been in his last moments.

"My heart will never mend," Leinweber wrote.

Sandra Watts, another sister, said Gibbon's death "destroyed our family."

"At night, when I go to bed and try to fall asleep, I can't get it out of my mind. What an awful way for my brother to die," she said. "Why would you murder a man, our Mike, someone you did not even know? It makes me ill just looking at you."

Sandra Street, Leinweber's step-daughter, read a prepared family statement to reporters outside the courthouse Thursday afternoon.

"Eventually Eric Amaral will be released from prison and will be free to enjoy the rest of his life," Street said. "But Michael will never have that opportunity."

"For us, there will only be this ongoing feeling of sorrow and profound sense of loss, which will be with us for the remaining years of our lives."

From the article quoted above:

"Amaral was sentenced to life in prison with the chance of parole in 14 years for the death of Gibbon. He will also serve another two years for the shooting of the police officer concurrently."

Why should he have the chance of parole in only 14 years? Why should the sentence for shooting the officer be served concurrently? Why not consecutively?? Where would the deterrent be when someone is fleeing LE?
:banghead:

What an insult to the victim's loved ones.
