Can I ask what the difference is between first degree and second degree charges? I can't remember the difference.

First degree murder is premeditated murder - planned with forethought, second degree means that the murder was a result of a conflict that occurred where one party is killed. First degree charges results in 25 years in prison before eligibility for parole, second degree means that parole eligibility can occur as early as 10 years. Time spent in jail prior to conviction is deducted from the length of the sentence.

Thankfully police have clarified that Shannon and her husband were married and that they were still living together in their shared home ... that there were no other homes, that neither party was staying with a friend, that a friend was not dog sitting, that neither Josh nor Shannon left home on a work night in the middle of the night to have a sleepover with a friend, and that nothing about Shannon's job, lifestyle, online presence, or acting career had anything to do with her disappearance.

This was nothing more than a straight forward domestic violence incident: spousal homicide.

Personally, I have to say that I'm very thankful that we can finally set aside all wild theories and what ifs in two Calgary cases, and return to looking at facts.

Oh my goodness. I'll have to read back and catch up. I'm glad she was found but this is so sad. RIP Shannon.

It was a recent discovery of something that they just obtained in the last week... Perhaps the unusually warm temps caused the neighbour's to complain about the smell. We have also had a ton of rain that may have eroded away a portion of the dirt making a body part visible.

Second degree murder is any murder that doesn't qualify under the first degree murder charge. First degree murders are planned and deliberate (or when a murder occurs during the commission of other specific offences as set out in the Criminal Code):

No wonder her family was so quiet and not really feeling the need to search everywhere. It must've been so hard for them to hold back and keep the accusations off social media, etc.

I called this one right from the outset as did many others. I would suspect the strike force had been watching this guy for many months to make sure he didn't move the body. Let's hope this creep gets the max sentence! Our laws against this type of creep in Canada are too lenient. He should be brought to justice for this.

At the press conference, the officer said that Josh initially appeared to be cooperative, and that he has been cooperative again in the past week. That suggests to me that they interviewed him, or attempted to interview him, several times between Dec 1 and Friday last week. He was uncooperative in the interim, but became cooperative last week. Perhaps there was a bad smell in the area ... that would make sense.

I don't follow your reasoning... The case was just handed over to Homicide this week, stating that the information they just obtained, led them to the discovery of the body. They would have had very little to interview him about these past few months... The Missing Persons Unit would touch base with him to see if he had heard from her, but he most likely was not interrogated by LE until this week after they discovered the body.

There was only one suspect in the investigation into Shannon's disappearance: Josh Burgess. If she wasn't with him, and wasn't contacting anyone, not using her cell phone, no electronic footprint, not showing up for work and family plans ... then she was presumed dead. Evidence to support that presumption became known a week ago, which led to a search warrant of the property, and the discovery of the body on Friday. That evidence also transitioned the official status of the investigation from missing person to homicide, but I don't think we can reversely assume that police assumed that Shannon was simply missing, they stumbled onto information that proved she was murdered, and then to their amazement this became a homicide case.

The case was just transferred over *this week* to Homicide. Much like we do here, LE will investigate every possible angle and cast a wide net, in order to avoid tunnel vision. They may have their suspicions but they wouldn't be doing their job's if they took a singular approach. Additionally, I am intimately aware of their procedures and policies. They MUST investigate every angle and often have seperate teams focused on different theories... even when they are confident that they know what happened.
