Looks like Susan Smith is pre-empting and testing the KC post penalty Defense strategy...... ineffective counsel.

Solicitor Kevin Brackett said Smith claims her attorney failed to adequately represent her when she was on trial 15 years ago. In a handwritten petition filed in Union County, Smith also claimed the trial was "unfair."

The appeal comes a month after her petition in federal court was dismissed.

Gotta admit, I'm 40 min north of the Big Smoke now but still consider myself one.

Yes, someone does seem awfully concerned and perhaps preoccupied with the money and costs. Perhaps the money jar is getting low.

Did it seem that there was more concern over court costs to the defendant rather than the new status as convicted felon and the ramifications of that new status? Or is this just being downplayed?

Defense Strategy: 12 Step Process

1. Get a big piece of poster board.
2. Place Photos of key people in the case except for Casey on the poster board. (also include a photo of aliens and the Chupacabra)
3. Buy some cheap plastic darts or "barrow" them from a bar.
4. JB buys a 1/5 of Wild Turkey.
5. Drink Wild Turkey and toss darts at the board.
6. Whoever the dart hits is the real killer/suspect.
7. Rinse and repeat item number 5 when the SA shoots that particular SODDI down.
8. Become talking head on talk show circuit, sell books, and acquire own show on TrueTV after case.
9. file appeal
10. Sell more books and be a guest on more shows after appeal.
11. Be present at execution to claim clients "innocence".
12. Sell more books, tv movie deals, and appear on talks shows relating to case.

I posted this on the check fraud thread but thought it belongs here too.
Has KC and JB abandoned the script theory? The script that was given to KC when ZFG and Samantha kidnapped Caylee from her at Blanchard Park. The one that she was supposed to follow for 50 or so days until Caylee's return on her birthday? Didn't CA talk about this script? KC was supposed to go on a shopping spree... she was supposedly going to see ZFG with Caylee at Target, etc. When asked about this theft from AH, KC told GA she did it in a time of desperation, and would not elaborate.
In her plea on the check fraud case, KC didn't say yea I did it, but I had a good reason... I was trying to save my daughter... I was made to do it... no, she just said I'm sorry and I should have been a better friend.

See Kentjbkent's post. I still don't know who "murt" is, and after reading what little was posted in this thread, I'm not sure I care. But I did conclude after my post that "mort" was the defense teams new PI. I would watch out if I were him. Look what the last PI got himself into.

This motion sums up the defense strategy, imo....the SODDI aside, they are going to attack the forensics and bank on that. It is OJ all over again.

Why doesn't the defense just depose these supposed members of TES, and add them to their witness list, and depose TM about whether or not they were in fact members that searched the area near where Caylee was discovered. They apparently have signed statements from these people, so why do they NEED these peoples' information from TES so bad? My guess is that they can't subpoena these witnesses for trial, without proof that they were "in fact", registered searchers with TES, who knows?

T.M. the day he stopped searching near there stating the area was under water. He had already lost a 4wheeler to mud and water.I remember TM. being on tv talking about it,they'd be back there later.:furious:

I was confused that time in the hearing Baez claimed that he felt duty bound to alert the court to a potential conflict of interest for Mr. Nejame to represent Texas Equusearch when he once worked for mom and pop. Immediately Brad said no.... and if there were such a conflict, the Anthonys do waive it. It is almost as if they do not speak to one another Brad and Baez, outside of court, ever. I do not live there but Mr. Nejame comes across as very experienced and well liked in that community. Taking uninformed shots at him seemed unwise, at best. Who's being thrown under the bus and can the defense really back away from the ZFG defense at this point?

I say they are going to be throwing Cindy under the bus and I think they are going to claim that Cindy is ZFG. I think at this point the defense is going to claim that Cindy was known by many people to be the provider and seragant mother for Caylee, and that Casey referred to Cindy as Zanny. I think they may possably even try and say that Cindy has MPD and Casey was protecting her mom from knowing that she (Cindy) had actually been the one to hurt Caylee. I feel that they are already setting the stage for this..... and Cindy being the one that always babysat for Casey, she technically was a nanny, also Cindy and George did have access to the car, Cindy was talking to Casey during the month...and Cindy sent DC to the woods.

I beleive they can not step away from the ZFG story now so they are going to try and make someone the Nanny and that someone be Cindy... and honestly I think they might be able to pull it off, or at least create reasonable doubt, with out something that directly links Casey they could definitely point the finger at Cindy.

Just so you know I believe Casey is responsible for Caylees death, I'm just trying to figure out the defenses defense and I think this may be where they are going... what do you think?

I am so happy you started this thread! I've been thinking about the exact same thing non-stop lately. I am curious to know how the defense is going to explain the ImagiZanny, because one thing for sure - they are MARRIED to that story in some form or another. There is no way around it. If I were on the defense team this would without a doubt be my biggest hurdle. It is not going to take anytime for the SA to DESTROY that theory -- it will be obvious early on that there never was a Zanny. Which in turn, means that it will soon be obvious that the defendant Casey Marie Anthony is a liar.

Somebody tell me how in the world they plan on bridging the gap between ImagiZanny and Roy Kronk? Now, THAT is gonna be a HUGE stretch.

They can't bridge the gap between RK and Zanny, so they are going to have to go another route. Maybe they are going to claim Cindy as the Nanny and Kronk disposed of Caylee, maybe thats where they are going to go with it. But I definitely see them using Cindy as ZFG, in so many ways I see that happening, and unless the state can directly tie Casey to murdering Caylee, I can see the jury seeing that Cindy has lied just as much and that she had the same opportunity as Casey to have done this.

I think all hopes of anyone being "thrown under the bus" are long gone. IMO...there is absolutely no hope but a plea agreement. Team Casey does not have enough moolah/clout to pull off an "OJ." It is finished. Taxypayers will cry foul! She simply is not a sympathetic figure....nor is her family...nor is she a beloved celebrity....that the good citizens of Orange County care if she gets a good (fake/contrived) defense. End this farce now....please....someone with an American conscious....this is about a precious, defenseless baby....and Jose...go home to your wife and family...they miss you...

For example I think they will try to bring in Roy Kronk's ex-wive's testimony to try to implicate him, with Cindy they might say she was the last person publicly seen with Caylee, etc. I think they will go right on down the line w/either all or some of Casey's ex-friends and associates to try to create reasonable doubt. I don't think it will work, but the defense might try it. If they don't try to throw someone under the bus, they only thing they have left is to try to dispute the state's evidence. Either way, they really have no defense. It will be interesting to see what approach they take at trial.

but what about Casey's own claims of the nanny being the last person she saw with Caylee. Its in the 911 tapes, in her statement, the media, jail house tapes, all the witnesses were told this... they can not say all of them are the nanny... Their defense at least has to make since, and blaming everyone doesn't make since when she claimed she gave Caylee to the Nanny and spent 31 days all her resources and everything to find the Nanny.
